An impeachment resolution was just filed against Chief Judge James Boasberg for approving Special Counsel Smith's access to telephone records of GOP members. I have been highly critical of the orders, but I do not believe that this meets the standard for impeachment…
…The resolution comes before all of the facts are known in the matter. Moreover, while I have long been critical of Judge Boasberg's rulings, these are legal disputes addressed through our appellate process. I believe that the use of impeachment in such disputes is unwise and unwarranted…
…The resolution has speculative and vague elements, such as "Boasberg does not appreciate basic statute and contributed to the legal inquiries that violate the law indicating he is unfit to serve as Chief Judge." Such a fluid basis for impeachment would undermine the judiciary and frustrate the original intent to reserve impeachment for the most egregious violations.
