In today's SCOTUS hearing, The Federalist- Number 23 was brought up, specifically pertaining to Executive Branch powers of Foreign commerce. So this brings up a couple of questions:
According to the Constitution, congress has the sole authority to levy taxes.
Also according to the Constitution, the Executive Branch has sole authority over foreign commerce.
Has Congress ever levied (brought to the floor, voted on, and passed) tariffing tax a foreign country for their commercial goods?
If so, can anyone cite it please?
If not, why is this case even being entertained by SCOTUS? Shouldn't it have been thrown out, as President's have been the only entity toevertariff Foreign countries since the inception of the Constitution?
Side note: I found it interesting that The Federalist (pdf attached) was number 23. Is this where the pain reference originates from? Is this what brings the whole corrupt diseased temple down on their heads (along with the Constitution)????
