Judge Rips DOJ Prosecutors, Gives Comey Another Win in Federal Criminal Case
A magistrate judge on Wednesday ripped DOJ prosecutors and accused them of a slap dahs indictment against James Comey.
A grand jury in the Eastern District of Virginia indicted former FBI Director James Comey in September. He was indicted on two counts – false statements and obstruction of a congressional proceeding.
Comey’s false statements charge is related to his September 2020 Senate testimony on whether he authorized leaks to the media.
In 2020, James Comey lied when he told congressional investigators that he never gave anyone permission to anonymously leak information about Hillary Clinton’s email investigation to the media.
However, evidence presented by prosecutors proves Comey gave his friend-turned-lawyer Daniel Richman permission to leak to The New York Times – and cheered it on.
The Justice Department also has other materials related to Comey’s case “on a desk” at the FBI headquarters. Comey’s lawyers accused the DOJ of withholding evidence in violation of the Constitution.
Magistrate Judge William Fitzpatrick scolded prosecutors for their handling of the case and said they quickly moved to “indict first, investigate second.”
Fitzpatrick also ordered the Justice Department to turn over all grand jury materials to Comey’s attorneys by Thursday.
Comey’s attorneys are arguing that some of the documents used in the indictment may be privileged.

A federal judge on Wednesday criticized the Justice Department’s prosecution of former FBI Director James Comey, saying he was concerned by the department’s “highly unusual” handling of the case by moving to “indict first, investigate second.”
Magistrate Judge William Fitzpatrick in Alexandria, Virginia, also ordered the Justice Department to turn over all grand jury evidence and other materials to Comey’s legal team by close of business Thursday, underlining his apparent criticism of federal prosecutors’s actions in the case.
The evidence at issue Wednesday is troves of data that the Justice Department gathered between 2019 and 2020 in a past Justice Department investigation during the first Trump administration known as “Arctic Haze.”
The investigation, detailed in a memo declassified by the bureau earlier this year, sought to figure out how classified details on the FBI’s investigation into Clinton’s use of a private email server made their way into a 2017 New York Times article, which looked at Comey’s decision-making while leading the politically fraught probe. No one was charged in the investigation.
One of Comey’s attorneys, Rebekah Donaleski, said there are four different warrants that were executed on Richman in the “Arctic Haze” investigation that she knows of and evidence returned from those seizures could be used as part of the Justice Department’s case against Comey. She said nobody on Comey’s legal team has been given access to that information yet, and they have not been able to screen that data, which includes hard drives and phone and email records, for potentially privileged information that could have been used in the indictment.

High-profile socialist and Muslim backers of Zohran Mamdani’s successful mayoral campaign — including controversial figures such as Linda Sarsour and Siraj Wahhaj — took a victory lap in the wake of the self-described democratic socialist’s victory in New York City's mayoral race.
Mamdani, a member of the Democratic Socialists of America, leaned heavily on the backing of the DSA and of Muslim activist groups to win both the Democratic primary in June and the general election on Tuesday.
A wide-assortment of Muslim, socialist, and other far-left groups and figures celebrated Mamdani’s win Tuesday, with many arguing that it pointed toward growing momentum for socialism and Muslim politicians in America.
Linda Sarsour, a high-profile anti-Israel and pro-Palestinian activist, celebrated Mamdani’s win on Instagram on Tuesday.
“When what we were told was impossible becomes the reality. From 1% in the polls to New York City Hall,” she said. “Congratulations @zohrankmamdani, thank you for taking us all on this incredible journey and helping us believe in democracy again.”
A Just the News review previously found that Mamdani embraced a nearly decade-long association with Sarsour as he rose from an activist to New York State assemblyman and now the Democrat Party’s nominee to run America’s largest city. Sarsour’s commentary and views on Israel have stirred years of controversy and accusations of anti-Semitism, an allegation she denies.
Sarsour and her Muslim activist group MPower Change also posted a lengthier celebration on Tuesday.
“Zohran Mamdani has become the first Muslim mayor of New York City, and we are elated. This election win is not simply about the man who will lead New York City in January — it is also about the mass of people, the communities, and the solidarity that lifted Zohran to victory,” Sarsour and her groups said on Instagram.
