SCOTUS Slaughter case had Roberts and Barrett for the first time ever showing their cards that they are 100% ruling to undue Humphry's. That actually means destruction of the 4th branch of Government which we call the Deep State. No left wing rag even tries to dispute it or defend the alternative.
Why now did Roberts and Barrett make their position known? They are always coy and leave people wondering how they will rule until the end of their term. No question about this decision. 6-3. Imagine a ruling that destroys a 90 year old law that the defense of the law was "well, it has been here for almost 100 years and nobody complained before" That was it! That was the counter argument as to why 30-50 agencies that ruin our lives should exist. These agencies are said to have quasi article 1 and/or article2& 3 because they make rules (not laws) they inspect (not enforce) and fine ( not jail) . Now if this gets ruled in favor of Trump, he gets the pseudo power congress turned over until Congress fixes their fuck up. Yes, Trump can fire these people and put in place his people and policies until Congress passes a veto proof law to take back their power of "rule" making and give back the power of "adjudication through fines" to Judicial Branch
now let's get into why Roberts and Barrett are screaming "Uncle" to Trump in the Slaughter case.
Simple… Autopen. Ketanji is not subject to the scrutiny no matter what people say unless Trump proves 2020 elections were fraud and even then it would require her do the right thing and step down. BUT… 234 Judges are subject to that. 43 are without a doubt GONE because they are post debate. If Trump blows up the 234 Judges improperly appointed by Biden using autopen and lack of documentation to prove Biden was engaged in the decision( key) then it blows up the facade of power the 3rd branch of government has. It can never recover from that. They have failed this Country every single time we needed them so they deserve it but that is a story for a different day. The weakest branch of the government has been the cause of every conflict our Country has faced because they wait until the matter is over by a few years and say. " oh , by the way, that action was unconstitutional"
Comer focused on Biden's autopen activities from a date post debate where his decline is unquestionable. This removes 43 Judges without question because it is multi pronged. Both autopen and cognitive decline. the other 191 face an additional hurdle but not as bad as people will claim. It's just the 43 are easy and no brainer.
We wont see this immediately because Trump is surrounding these assholes. That is why he didnt explicitly name judicial nominations as part of his post about voiding anything signed by autopen. he just fired a shot across the bow with the "any other document" language. What has to happen first? Military has to happen first. Take the Mark Kelly case where Sec of Navy is investigating and the report is due today. If Kelly is able to be recalled for Court Martial or otherwise, Mark Milley comes next. Trump said pardons are void. Military cases go through their own Court and their own Appeals process BUT subject to SCOTUS the same as a Federal case. They just do it faster. much faster. We could see the other 6 seditionists reach SCOTUS in as much as 10 years from now, but the Military Court of Kelly will be there in less than 12 months. How does that work if SCOTUS rules Kelly guilty long before the other 6 assholes get a trial in a lower Court? Ha! so while Kelly case runs in military Court, a parallel case is happening in federal Courts for the other 5.Transfer this to Mark Milley and his void pardon. His case is in Military Court rapidly going through the system to reach SCOTUS as Biden family ( excluding Hunter because Joe signed his pardon) runs through our slow Federal Courts. How can SCOTUS rule 1 way for the military then later a different way for the same crime and same situation in a federal case? They can't. Ruling Military pardon void also means all other pardons void. It also means all Judges signed by autopen void. Once Trump gets 1 ruling of autopen voiding he gets 234 judges. Their past rulings stay in place because of a de facto law that they acted in a good faith belief of being legit. They do however have to exit the bench and cease collecting tax payer funded paychecks and benefits.
