Dear Warden Stancil,
On December 5, 2025, President Donald J. Trump issued a full and unconditional pardon to my client, Tina M. Peters. At approximately 5:55 p.m. on December 12, 2025, I personally served a copy of the Presidential Pardon on armed DOC staff at the LaVista Correctional Facility and requested that they release Mrs. Peters.
Instead of releasing Mrs. Peters as required by federal law, DOC personnel stated that they would not comply with President Trump's Pardon. Their refusal is categorically unlawful. A presidential pardon is self-executing and immediately terminates all legal authority for continued custody. Your refusal to release Mrs. Peters is not a clerical delay—it is a willful deprivation of liberty under color of law, in direct violation of 18 U.S.C. § 242. If more than one DOC employee acted in concert to block her release, it further constitutes a conspiracy to deprive rights under 18 U.S.C. § 241.
I expect Mrs. Peters to be released immediately. If she is not, her attorneys will pursue all available civil and criminal remedies against every state officer or official who knowingly participated in obstructing the enforcement of a Presidential Pardon.
Please provide written confirmation without delay identifying the precise time Mrs. Peters will be released in order to create a plan to safely receive her.
