You are right the DOJ was given an assertion. If Tina Peters is guilty of backing up data then so is any company that backed up the data and code, including any repositories such as git or gitlabs. Therefor, copying data is not a crime, only altering it is. This could free her legally, but will set a precent.

Agreed. The DOJ was given another assertion that they could try besides backup is not a crime, only altering data; and that is, is that all election software technically belongs to WTP because they replaced our paper ballot systems and have been closed sourced, thus taking away our right to transparency. Therefor, the election process, which affects all Americans, elected or civilian, belongs to WTP. Both made notables and both have not been acted upon.
