Samuel Alito says Supreme Court responding to Trump acting 'aggressively'

Supreme Court Justice Samuel Alito said President Donald Trump has used his executive power “very aggressively,” in an interview with Italian news outlet Corriere della Serra.

 

Alito, a conservative appointed by President George W Bush, told the outlet that over the past 10 years, there has been “an inclination by presidents to try to do more and more and more, using their own power, or what they believe to be their own power.”

 

“And now, under President Trump, it’s just gone on like this, and he’s used his executive power very aggressively,” Alito told the outlet. “And what we have seen since the beginning of his second term, since January, is that so many of these things that he has done are immediately challenged in court. We have 680 district court judges. A district judge says ‘it’s unconstitutional, or it’s unlawful’, and then the case comes to us as an emergency matter.”

Alito also discussed how recent presidents exercised their executive power in the interview with Corriere della Serra.

 

“In 2014 after the midterm elections, President Obama was in office. His party lost its majority in Congress. He said:‘OK, but I have my pen and my phone’. The pen: he was going to use with executive orders regulations.So that started to go up,” Alito said. “Then, during the first Trump administration, it went up. Then, during Biden, he did it on same very important things: forgiving student loans, putting a moratorium on mortgage foreclosures during COVID, requiring every employee (in companies) above a certain size to receive the COVID vaccine.”
