NEW🔥: The Supreme Court appeared sympathetic to a challenge against a federal law barring users of illegal drugs, including marijuana, from possessing firearms.
In Monday’s arguments, Texas resident Ali Danial Hemani — a regular marijuana user whose 2022 home search yielded a handgun — argued the restriction violates the Second Amendment under the history-and-tradition test from the 2022 Bruen ruling.
Justices including Amy Coney Barrett and Neil Gorsuch questioned the government’s evidence linking occasional marijuana use to dangerousness, comparing it to founding-era “habitual drunkard” laws.
The 5th Circuit had already dismissed Hemani’s indictment, ruling prosecutors must prove impairment at the time of possession rather than mere use.
