The important access standards became roughly:

So if someone remembers Trump saying something along the lines of “instead of waiting forever at the VA, go see a private doctor and we'll pay for it,” that's basically the policy he was describing.
Did Biden get rid of it?
No.
The MISSION Act remained federal law throughout the Biden administration, and the Community Care system continued operating. Veterans continued receiving large amounts of non-VA medical care through it.
There were political fights over how broadly VA should refer veterans to private providers, and critics argued during the Biden years that VA administrators sometimes made community care harder to obtain than Congress intended. But that's different from Biden repealing Trump's program.
In fact, the VA's current rules still explicitly use the MISSION Act eligibility framework.
And there's been another change under Trump now
This part is interesting because the story continued after his return to office.
In May 2025, Trump's VA announced that it was eliminating an additional internal review that had sometimes been required before community-care referrals were approved. The VA said that when a veteran and the referring clinician determine community care is in the veteran's best medical interest, it no longer requires approval by a second VA doctor.
So as of 2026, community care is very much alive.
But here's the big catch: “ANY hospital”
For ordinary/non-emergency treatment, a veteran generally cannot simply walk into any private hospital, show a VA card, and have VA pay the bill.
Usually the veteran needs VA authorization/referral and uses a provider in the VA Community Care Network. The VA's current 2026 benefits guide says routine community care generally requires a written VA referral.
Emergencies are different. If a veteran reasonably believes their life or health is in danger, the VA says:
“call 911 or go to the nearest emergency department.”
No advance VA authorization is required. There are still eligibility/payment rules afterward, and VA generally needs to be notified within 72 hours."
