Right now, Americans can legally brew beer and make wine at home, but distilling whiskey, gin and other spirits can expose you to a federal felony charge.
An Ohio home-brewing enthusiast is challenging that 150-year-old ban, arguing the government has gone too far.
Now the fight is in front of the Supreme Court. Two federal appeals courts have already disagreed over whether the government can ban home distilling, setting up a showdown that could change the rules for home whiskey making.

Marco Rubio’s White House role is now permanent.
President Donald Trump signed a commission formally making Rubio his national security adviser, three administration officials confirmed to Fox News Digital. Rubio had served in the role on an interim basis since May 2025.
The secretary of state is only the second person in U.S. history to hold both posts simultaneously, following Henry Kissinger in the 1970s.

“Looksmaxxing” influencer “Clavicular” is facing rape and drugging charges in Massachusetts after a woman accused him of getting her drunk and having sex with her without her consent when she was 17.
Court records obtained by Fox News Digital say Braden Peters, known online as “Clavicular,” allegedly invited the teenager to his Cape Cod home after connecting with her on Instagram.
Police say Twitch clips captured part of the night, including the teenager saying, “Wait, I’m so drunk though.” Investigators said they believed she was too intoxicated to consent.
Peters and his representative have denied the allegations, pointing to messages and a handwritten letter they say support his position.
