Biden commie Judge David Leibowitz from Florida ruled in favor of a Jamaican national because it was federal prosecutors who brought the case under a federal statute against non-citizens voting.

Leibowitz claims only states can decide whether noncitizens can vote. WTH?

U.S. District Judge David Leibowitz (Southern District of Florida, nominated by President Biden) dismissed a federal criminal case on October 1, 2026,against Chelsea Cox, a Jamaican national, ruling that the federal statute criminalizing noncitizen voting in federal elections is unconstitutional.

Cox entered the United States as a tourist in 1999 and remained after her visa expired the following year. She used a fraudulent U.S. Virgin Islands birth certificate to obtain a Florida driver’s license and registered to vote in 2012. She cast ballots in federal elections from 2012 through 2020.

Only the 2020 vote fell within the statute of limitations when she was charged in October 2025 under 18 U.S.C. § 611 (“voting by an alien”), a 1996 law that makes it a misdemeanor for a noncitizen to vote in elections for president, vice president, or members of Congress.

Biden Judge Leibowitz held that the Constitution assigns the power to set voter qualifications to the states, not Congress.

He wrote that Florida already prohibits and can punish the conduct at issue under state law, and that it is for Florida—not the Department of Justice—to enforce that requirement.

The opinion states: “Can the State of Florida prohibit and punish the exact conduct Defendant Cox allegedly engaged in here? This has already been decided elsewhere and is not addressed here: Florida can and does.” He concluded that “the Constitution does not authorize Congress to legislate voter qualifications for federal elections.”

Cox’s attorney welcomed the dismissal. Of course.

Leibowitz should be immediately disbarred. Are there any Republicans with a spine? Anyone?

Trump Makes Sinister Midterm Threat as Panic Grips GOP

President Donald Trump has refused to rule out using the Insurrection Act to deploy the military against voters at the midterm elections.

With his approval numbers at record lows, Trump once again raised the prospect of an extraordinary use of presidential power as Republicans fight to retain control of Congress.

Asked in an interview with TIME if he would rule out declaring a state of emergency in the lead up to the midterms, the president replied: "I don't rule anything out or in. We'll see."

"You mean the Insurrection Act?" Trump then asked, referring to the federal law that allows presidents to deploy the military or federalize National Guard troops in order to quell what he deems an insurrection against the United States.

When TIME clarified yes, Trump replied: "No, I've never used it. I could use it. A lot of people think I should use it sometimes."

The comments come as the president embarks on a 32-day campaign blitz, with much of it through Republican territory, starting with a trip to Texas and Oklahoma on Thursday followed by Alabama on Friday and Ohio on Saturday.

The Texas trip could end up being awkward for embattled Senate candidate Ken Paxton, who is scrambling to make amends with Trump after leaked audio revealed him trashing the president's midterm convention in Dallas.

Trump also acknowledged this week that he had done a poor job selling his message to voters, raising the stakes of each campaign appearance.

"I've done a very bad job of explaining how good the country is doing," Trump told a supportive crowd at a Hispanic Heritage Month event at the White House.

"The country's doing better than it has ever done."

Told by TIME reporters in the interview that his polls "have never been lower," Trump replied: "They're fake numbers. I would beat anybody running today by 20 points. Your numbers that you have are fake. The pollsters are corrupt. They're almost as corrupt as the writers."

The latest Reuters/Ipsos poll has Trump with an approval rating of 32 percent and a disapproval rate of 61 percent.

The fact that Republicans are losing ground amid the president's war in Iran and affordability has also raised fears that he could end up taking drastic measures to cling to power.

According to CNN, current Director of National Intelligence Jay Clayton is likely to be appointed the AI/SI Czar. If that is accurate, and not a leak trap – which considering the source is sketchy, then that leaves the DNI position open again.

• (VIA CNN) – President Donald Trump is expected to pick Jay Clayton to be the White House’s new czar of artificial intelligence, two sources familiar with the discussion told CNN.

The president could announce his decision about Clayton, who is director of national intelligence, as early as Friday, one of the sources said.

Trump announced last month that he was planning to create an “AI Force” and name an AI czar as the government faces growing calls to impose guardrails on the technology’s rapid development.

Trump gathered several AI and technology CEOs at the White House on Tuesday for a meeting that culminated in the signing of a new commitment aimed at better “self-policing” their companies’ AI models.

If it is accurate that Clayton is going to the Super Intelligence Czar position, and considering the sudden reappearance last week at the White House,is there a possibility of someone returning to the administration as DNI?
