Former Mayor Mike Bloomberg has been reinstated as a defendant in a civil case brought against his financial data empire, Bloomberg LP, by a former employee who claims she was raped by a manager.
The explosive 2016 suit, filed by an unidentified former employee, claims the billionaire former New York City mayor was partly responsible for a toxic culture at Bloomberg that led to her assault.
In a five-page order on Monday, Justice Fernando Tapia ruled that he had “misapprehended” New York’s human rights law in December 2017 when he’d removed Bloomberg, the CEO of his namesake financial data company, from the case.
In that earlier decision, the judge ruled that the woman, who goes by Margaret Doe in the suit, didn’t meet the three “prongs” of the human rights law to argue her case — and that Mayor Mike had no connection to the case.
On Monday, however, the judge wrote that the woman only has to meet one of the three prongs — and that she had by showing Bloomberg had “ownership interest or any power to do more than carry out personnel decisions made by others.”
Margaret Doe didn’t need to show that the former mayor had known of the behavior or failed to take action, the judge ruled.
“At this stage, as no discovery has taken place, it is unknown the extent of his involvement with the decision-making process at Bloomberg [LP],” the judge wrote of the former mayor.
“It is unknown his alleged role if any in creating, encouraging, and condoning a culture at Bloomberg [LP] that plaintiff asserts caused her claims of civil rights violation, employment discrimination, and sexual harassment,” he added.
The woman claims her manager Nick Ferris raped her twice in early 2013, plied her with drugs, and threatened her job if she wouldn’t sleep with him, according to the 2016 suit.
Bloomberg fired Ferris in 2015, after the woman went on leave from the company. Ferris has not been charged with any crime.
