You are going to have to change the laws pertaining to the rights of illegal immigrants once they arrive on our soil. They are going to fight you on that; saying that if they are under our legal jurisdiction for trials/crimes etc then they are "under the jurisdiction of". You are going to need a completely separate subsection of law classifying migrants' rights as separate or qualifiers for them to have the rights they are afforded right now.
ie: if you came through a proper port of entry and declared asylum or refugee status upon entry at an official port of entry then you are afforded migrants' rights/"are under jurisdiction of the US". If you cross illegally then you are considered an illegal invader and then have given up your rights and are not protected by the US in anyway, will he treated as an enemy combatant, will be deported from the country.
