If they had a FISA warrant on him he wouldn't be able to be part of the prosecution, which is what will dominate the next 2 years. Will he return, or get his 'Bama Senate seat back?
There's sufficient reason to believe they ran a FISA on him, too, which would have precluded him from prosecuting any of this anyway.
Note, too, that his resignation letter was publicized over a year ago and it was UNDATED. His departure was planned long ago.
