ObamaCare bill history in the House and Senate

Obamacare violated the US Constitution in that bills of revenue must originate in the House. The bill was introduced and passed in the House as H.R. 3590 Service Members Home Ownership Tax Act of 2009. Upon being sent to committee in the Senate, the entire bill text except the purpose was replaced by amendment SA 2786. The title was then amended by reconciliation after passing in the Senate. The action of Pelosi, Reid and Chief Justice Kennedy blatantly violated the intent of the US Constitution as the bill that originated in the House was replaced by amendment with a revenue bill that originated in the Senate.

“This is the Senate's health care bill. The bill started off with text regarding an unrelated matter but the Senate is co-opted this bill as a vehicle for passage of their reform and changed the text in whole to the health care bill. They do this because the Constitution requires all revenue bills to start in the House, and their health reform plan involves revenue. So they have chosen to work off of a bill that started in the House, even if that bill is unrelated.”

Obamacare is an example of how the [Hussain] administration worked to decimate the United States Military. By replacing the text of Service Members Home Ownership Tax Act of 2009, service members received no tax credit provisions as intended in the original bill.

BILL SUMMARY

H.R. 3590 would modify the first-time homebuyers' tax credit for Armed Forces members, as well as Foreign Service and Intelligence Community employees on extended duty. The bill would waive recapture of the credit for qualifying individuals who must sell a residence after December 31, 2008, due to government orders for extended duty.

H.R. 3590 also extends the tax credit for taxpayers who serve on duty outside of the U.S. for at least 90 days in 2009, and who purchase homes before December 1, 2010. Qualifying taxpayers would also be permitted to treat a purchase made between December 31, 2009, and July 1, 2010, as a purchase made in a prior year for tax purposes. The extension would apply to residences purchased after November 30, 2009.

Note, Dem Ways and Means statement is inaccurate that the bill was signed into law P Law 111-92 supplemental appropriatiions legislation. Section 12 did provide for first time homeowner credits under bill HR 3548, not the HR 5390. The service member tax credit in HR 5390 was not incorporated into the final law.
