Playing devils advocate, the difference is that Flynn was doing 'diplomacy' without a FARA while NOT working for the govt (pre-election, pre-NSA role).

Clinton was literally the sec of state, which is a govt role which implies diplomacy.

The pay-to-play is still a problem for the Clintons.

But the narrative is really more about 'citizen' Flynn or Trump negotiating with foreigners on policy issues.
