Yes, the courts SHOULD operate according to the actual laws. That would be great. It COULD do that, yet it seems to have a difficult time actually doing that. (Not sure why that is, honestly.) Maybe a lawfag can weigh in on what's up with that?
Yet, the justice system ultimately relies on precedence, which is basically "bad ideas perpetuating themselves until every last American citizen is fucked over and afraid".
