Yes that’s one scenario, but it wouldn’t come to that. If a Dem Sen/Cong gets convicted, they are not voting anymore and the Democrats would want the seat to be declared vacant so they could presumably get another Dem in there ASAP to restore their full voting block. Only exception would be where a purple district or state could easily go to a Republican. Frankly if enough seats stay vacant, it might help the Republicans more to leave them vacant, effectively cutting Dem majority in the House and getting closer to the 3/5ths needed to get a lot stuff done in the Senate. Unlike the SC, Sen/Cong have to be on the floor to cast their vote. So —- maybe there’s an advantage to having Sen/Cong sitting in jail and not allowing them to get replacements.
