Reminds me of a former neighbor with zero legal education telling me (law fag) that making the Federal Government making us pay income taxes was Unconstitutional. He was following some tax avoidance schemer. It all depends on how the Constitution is interpreted, but you know how the Courts will interpret as witnessed by all of the followers who went to prison for income tax evasion.
Seems to me the "Enabling Clause," gives Congress the authority to pass all laws, and for a law to be considered Unconstitutional, the USSC has to rule on it. (Or a lower Court rules it so, and the USSC declines to hear the case.)
