Besides all the other things that could happen, would it be possible to have a class action lawsuit for lying to us? They must have some sort of superior duty, that the daily show wouldn't have. I don't know, people can sue about anything these days. breach duty cause harm. Do we have this?

Breach duty cause harm. What we know is that these media organizations have very deep pockets. We would also figure they'd like to avoid this.

 

In a defamation case, there are the people being defamed, and there are the people who get the wrong information about the defamed. People hear, wrongly that X is bad, and people choose Y instead, and people are getting the inferior product, service, experience because they are basing their choice on bad information, defamation. The people who were steered away from the X product with a quality level of 90, instead choosing Y product with a quality level of 70, because the X product was falsely accused of having a quality level of 50, suffered a quality loss of 20. It's not easy to precisely quantify, but you can see where we as people, as a class, can suffer losses. We wanted to get the best value / highest quality, someone told us that the best value / highest quality wasn't, and we ended up choosing not the best value, highest quality. The difference in value/quality for all the people in the class would be the damages, and then you treble damages punitive.
