I don't think a state of emergency is the way to go. It may be easier to challenge that declaration than his existing authority as CIC under 10 U.S.C. 284. There is a suspicious amount of "push" behind the emergency declaration idea, so I think that is the favored route for the opposition.
He failed to get the abortion bill through, and made a mess of the situation, so they are looking to get rid of him in favor of the Lieutenant Governor, who will get it done on the next go-round. Moral of the story: don't let the cabal down.
