Here's a screenshot of part of Article III Section II, listing the kinds of judicial cases that have federal jurisdiction. The PACER count is for sealed documnets in the FEDERAL court system, and does not include cases in the state courts. So if there is some attack vector against the deep state besides DOJ (USA v [ ]), then presumably it would be one of the other kinds of cases listed in the Constitution as having Federal jurisdiction. Then the question becomes which (if any) of these other types of cases can have records sealed.

 

It appears federal court jurisdiction does include cases between a State and a citizen of another State; and cases (from Federal or State) against foreign governments or foreign citizens.

 

From the Constitution:

 

The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority;—to all Cases affecting Ambassadors, other public Ministers and Consuls;—to all Cases of admiralty and maritime Jurisdiction;—to Controversies to which the United States shall be a Party;—to Controversies between two or more States;—between a State and Citizens of another State; —between Citizens of different States, —between Citizens of the same State claiming Lands under Grants of different States, and between a State, or the Citizens thereof, and foreign States, Citizens or Subjects.

An anon was speculating that some of the cases contributing to the PACER count were civil, not criminal. So I was asking if the PACER count was criminal only.
