Federal appeals court upholds California's 'sanctuary state' laws

 

A federal appeals court upheld California's so-called "sanctuary state" laws late Thursday, reinforcing a lower court ruling to keep them in place.

The three-judge panel of the U.S. 9th Circuit Court of Appeals unanimously rejected challenges by the Trump administration against California laws SB 54, AB 103 and AB 450, aimed at protecting immigrants in the state from arrest and deportation.

For AB 54, which limits cooperation between local law enforcement and federal immigration authorities, the court ruled the state's "refusing to help is not the same as impeding" efforts to enforce federal immigration laws.

The judges said they had no doubt "SB 54 makes the jobs of federal immigration authorities more difficult," but noted California has the right to refrain from assisting in federal efforts.

 

The panel ruled AB 103, which prohibits state and local agencies from entering into immigration contracts with the federal government, was not invalid because "even if AB 103 treats federal contractors differently than the state treats other detention facilities," the United States failed to demonstrate that it treated other facilities more favorably.

Lastly, the panel ruled AB 450 – which requires U.S. Immigration and Customs Enforcement to obtain a judicial warrant before entering a place of business, and restricts employers from sharing information with the agency – does not "violate the intergovernmental immunity doctrine." The court said, "An employer is not punished for its choice to work with the federal government, but for its failure to communicate with its employees."

Thursday's decision upheld a ruling last July by U.S. District Judge John Mendez that dismissed the United States' argument against the three laws.

 

California Attorney General Xavier Becerra said the court ruling allows states' rights and the 10th Amendment to thrive.

Warren spends big on staff in high-stakes 2020 gamble

 

Sen. Elizabeth Warren (D-Mass.) is investing heavily in hiring staffers in some of the first primary and caucus states, placing a bet that such early organizing efforts will pay dividends when voting starts next year.

But that strategy comes with a big price tag.

Warren’s presidential campaign spent nearly $1.9 million in the first three months of 2019 to hire and retain more than 160 staffers, including many in crucial early voting states like Iowa and New Hampshire, campaign finance records show. Salaries alone cost the campaign roughly $1.2 million.

The Massachusetts senator raised $6 million in the first quarter of the year, putting her in the middle of the pack of 2020 Democratic contenders.

But she spent roughly 87 cents of every dollar, giving her one of the highest burn rates of any candidate in the primary field.

 

One of the biggest financial challenges for Warren will be raising a steady enough stream of cash to support an already large operation and sustain her high burn rate.

“History is littered with campaigns that had burn rates like that,” Ferson said. “That’s putting everything on black. It’s a gamble.”

Five former Obama ambassadors back Buttigieg

 

A group of five former ambassadors who served under former President Obama are lining up behind Pete Buttigieg, giving the South Bend, Ind., mayor a jolt of institutional fundraising support amid his meteoric rise in the Democratic presidential primary.

The Obama diplomats — Timothy Broas (Netherlands), John Phillips (Italy), Tod Sedgwick (Slovakia), David Jacobson (Canada) and Bill Eacho (Austria) — raised millions of dollars for the Obama-Biden ticket in 2008 and 2012.

The ambassadors are now planning a fundraiser for Buttigieg in Washington, D.C., in May.

Jacobson is also planning a Chicago fundraiser, putting Buttigieg’s fast-rising campaign in position to tap into Obama’s deep network of wealthy donors.
