Federal appeals court upholds California's 'sanctuary state' laws

A federal appeals court upheld California's so-called "sanctuary state" laws late Thursday, reinforcing a lower court ruling to keep them in place.

The three-judge panel of the U.S. 9th Circuit Court of Appeals unanimously rejected challenges by the Trump administration against California laws SB 54, AB 103 and AB 450, aimed at protecting immigrants in the state from arrest and deportation.

For AB 54, which limits cooperation between local law enforcement and federal immigration authorities, the court ruled the state's "refusing to help is not the same as impeding" efforts to enforce federal immigration laws.

The judges said they had no doubt "SB 54 makes the jobs of federal immigration authorities more difficult," but noted California has the right to refrain from assisting in federal efforts.

The panel ruled AB 103, which prohibits state and local agencies from entering into immigration contracts with the federal government, was not invalid because "even if AB 103 treats federal contractors differently than the state treats other detention facilities," the United States failed to demonstrate that it treated other facilities more favorably.

Lastly, the panel ruled AB 450 – which requires U.S. Immigration and Customs Enforcement to obtain a judicial warrant before entering a place of business, and restricts employers from sharing information with the agency – does not "violate the intergovernmental immunity doctrine." The court said, "An employer is not punished for its choice to work with the federal government, but for its failure to communicate with its employees."

Thursday's decision upheld a ruling last July by U.S. District Judge John Mendez that dismissed the United States' argument against the three laws.

California Attorney General Xavier Becerra said the court ruling allows states' rights and the 10th Amendment to thrive.

Laura Ingraham, the Fox News host who recently laughed at the death of a murdered man hours after his funeral, thinks that a whole lot of people need to apologize to her, and more importantly, to the president of the United States, for being wrong about the outcome of the Mueller investigation and for saying a bunch of mean things about Fox News.

On her show the Ingraham Angle Thursday night, Ingraham demanded that Democrats, the media, and “rabid Never-Trumpers” say they’re sorry for believing the president was colluding with Russia to influence the 2016 election, despite the Mueller report containing any number of disturbing revelations about Trump and his inner circle.

“All of them, no words for their calumny, their lies, and their false accusations,” Ingraham said. “Are they really paying you enough to say that stuff, guys?”

This, to which I also say: OK Google, play “Sorry” by Beyoncé.

Throughout her show’s intro, in which she cast all of the mean things people have said about the president as baseless, Ingraham also played media clips of people calling Trump a traitor and a betrayer of the nation and of people criticizing Trump’s family and children, who have embarrassed themselves pretty well on their own, Mueller investigation aside. Ingraham also demanded that We The Other People apologize for criticizing Attorney General Bill Barr’s handling of this mess.

“And to those who branded the primetime hosts on this network as ‘state news’ for daring to tell the truth, not just our truth, but the truth? You owe us an apology,” Ingraham said, just before playing clips of people calling Trump watching Fox News an “echo chamber.”

“No wonder they were so angry today. It was ‘sedition,’ ‘treason.’ Now, ‘Oh, Fox News,’” she continued.

Ingraham is just one of many people eating up Mueller’s conclusion that the campaign didn’t directly collude with Russia to swing the election, which is fine—have your day, pop your champagne, pat yourself on the back and feel vindicated, whatever. But Ingraham, Trump, Trump’s children, Fox News, and anyone mentioned in that bit of hers don’t get to demand apologies, particularly given how they’ve willfully mislead voters and viewers and vilified and stoked violent rage against immigrants, American Muslims, and anyone who is a shade darker than they are.

Chinese State Media Reveals Mysterious Hypersonic Aircraft

China’s China Central Television has briefly revealed the country’s new hypersonic aircraft under development. According to the report, the China Aerospace Science and Technology Corporation is currently working on a hypersonic vehicle, which is capable of traveling on the speeds of about 5-20 mach for about 5 hours.

China's aggressive push into hypersonic technology began in early 2018, when Chinese researchers first revealed a novel design for an ultra-fast plane they say will be able to take dozens of people and tonnes of cargo - "anything from flowers to bombs, and likewise, passengers could be tourists or military special forces" - from Beijing to New York in about two hours.

The plane would travel around 6,000km/h (3,700mph) or about five times faster than the speed of sound, according to the team, which is also “involved in China’s top-secret hypersonic weapons programme,” according to the South China Morning Post. Today’s current journey from Beijing to New York depending on the jet stream is roughly 13 to 14 hours. An 80% reduction in travel time is a game changer for civilian aviation, but also a red flag if the aircraft is converted into a hypersonic heavy bomber.

“It will take only a couple of hours to travel from Beijing to New York at hypersonic speed,” head of hypersonic research Cui Kai wrote in a paper this month in Physics, Mechanics and Astronomy, published by Science China Press.

The team said they had tested a scaled-down prototype of the hypersonic plane in a wind tunnel at the Chinese Academy of Sciences in Beijing. Researchers carried out aerodynamics evaluations on the aircraft pushing it to 8,600km/h (5343 mph) and discovered it performed exceptionally well, with low drag and high lift.

The project reflects China’s ambition to overtake the US on developing new strategic weapons: according to the head of hypersonic research Cui Kai "This will require original rather than knock-off designs,” adding that the I-plane was part of a new family of aircraft in development that had not been reported until now. “It could lead to a huge step forward in hypersonic technology,” he said.

China has tested various types of hypersonic vehicles over the Gobi Desert in recent years, some capable of reaching 10 times the speed of sound. It is also building the world’s fastest wind tunnel to simulate hypersonic flight at speeds of up to 12 kilometres per second (or 43,200km/h). At such velocity, a Chinese hypersonic vehicle could reach the west coast of the United States in less than 14 minutes.

Google to Block Logins From Embedded Browsers to Prevent Phishing

Google on Thursday announced that it will soon block login attempts from embedded browser frameworks in an effort to prevent man-in-the-middle (MitM) phishing attacks.

The tech giant says phishing attacks that involve traffic interception are difficult to detect when an embedded browser framework or a different type of automation platform is used for authentication.

As an example of an embedded browser framework Google provided its Chromium Embedded Framework (CEF), which is designed for embedding Chromium-based browsers in other applications.

Since its systems can’t make the difference between legitimate logins and MitM attacks when such frameworks are used, Google has decided that, starting with June, it will block sign-ins from these frameworks.

The company says this latest move is similar to webview sign-in restrictions announced in April 2016.

“The solution for developers currently using CEF for authentication is the same: browser-based OAuth authentication. Aside from being secure, it also enables users to see the full URL of the page where they are entering their credentials, reinforcing good anti-phishing practices,” said Jonathan Skelker, Product Manager of Account Security at Google.

These measures come after last year Google informed users that they must enable JavaScript in their web browser due to the introduction of a new security mechanism for the login process. Specifically, when the username and password are entered on the sign-in page, a JavaScript-based risk assessment is conducted and authentication is only successful if nothing suspicious is detected.

WASHINGTON (Reuters) - Secretary of State Mike Pompeo said U.S. diplomatic efforts will continue toward the goal of denuclearization of North Korea, a day after a North Korean official said it no longer wanted to deal with him in talks.

“Nothing has changed. We’ll continue to work to negotiate; still in charge of the team. President Trump’s obviously in charge of the overall effort, but it’ll be my team,” Pompeo told reporters in Washington.

He added that U.S. diplomats led by Special Representative for North Korea Stephen Biegun would continue efforts to achieve North Korea’s denuclearization, which he said North Korean leader Kim Jong Un committed to last June.

“I am convinced we will have a real opportunity to achieve that outcome,” Pompeo said at a joint news conference after talks with Japan’s foreign and defense ministers.

According to The Hollywood Reporter, the Beyoncé soundtrack will hit all major streaming services on April 23rd.

A charity connected to convicted sex offender and Harvard donor Jeffrey E. Epstein gave tens of thousands of dollars to the Hasty Pudding Institute of 1770 and a non-profit linked to a Harvard professor, according to tax filings obtained by The Crimson.

Epstein served as president of a private foundation called Gratitude America, Ltd. in 2014. Gratitude America donated $50,000 to the Hasty Pudding — an umbrella organization that includes the Hasty Pudding Club, Hasty Pudding Theatricals, and the Harvard Krokodiloes — in 2016. As recently as Wednesday afternoon, the Hasty Pudding website listed Epstein as one of its 2018 donors who have given more than $50,000.

In 2016, Gratitude America also gave $110,000 to Verse Video Education, the non-profit organization that funds English Professor Elisa F. New’s television show and digital initiative “Poetry in America.”

Gratitude America operates out of the United States Virgin Islands, where Epstein lists his permanent address. Its 2014 filings list Epstein as the president and Darren K. Indyke and Erika A. Kellerhals as the treasurer and secretary, respectively. Tax filings from 2015 to 2017 still list Indyke and Kellerhals as employees for the charity, but Richard Kahn replaces Epstein as president.

Kahn and Indyke have also worked on the boards of previous charities tied to Epstein. In addition to being Epstein’s longtime lawyer, Indyke served as vice president of Epstein’s previous foundation, the C.O.U.Q. Foundation.

Epstein, a billionaire investor, faces allegations that he ran an underage sex ring out of his Palm Beach, Fla. home from 2001 to 2006, according to a November 2018 Miami Herald investigation. The Herald identified around 80 women who say Epstein molested or sexually abused them before 2006, when a team of lawyers — including Harvard Law School Professor Emeritus Alan M. Dershowitz — struck an extraordinary plea deal with the District Attorney’s office.

The Daily Beast first reported Epstein’s connections to Gratitude America in an April 16 article. The foundation has also donated to MIT, the Crohn’s Colitis Foundation of America, and Friends of Elton John, according to its tax filings.

Kellerhals, who is listed on the tax forms as the foundation’s bookkeeper, did not respond to a request for comment.

Epstein’s lawyer also did not respond to a request for comment for this story.

Though Epstein is neither a Harvard alumnus nor a faculty member, he has given millions of dollars to Harvard over the past three decades.

Before Wednesday afternoon, the Hasty Pudding listed Epstein as a 2018 “Guardian of the Sphinx,” a designation given to its highest donors — those who have given at least $50,000.

Hasty Pudding Institute Chairman Andrew L. Farkas ’82 and other representatives from the Pudding did not respond to multiple requests for comment. Shortly after The Crimson reached out to the Pudding on Wednesday, Epstein’s name disappeared from, and an anonymous donor was added to, the 2018 donors page. Hours later, the 2018 page was replaced with a new list of 2019 donors, which does not include Epstein.

The Poetry in America website lists Gratitude America as one of the organization’s funders. The organization is both a PBS television series that first aired in 2018 and a “multi-platform digital initiative” that offers free online courses.

New declined to comment on the donation.

The Hasty Pudding and Poetry in America initiative aside, Epstein has a long history of strong financial ties to the University. He has pledged donations of up to $30 million to individual researchers and funded the construction of the building that houses Harvard Hillel, among other contributions.

Epstein also maintained an office in Cambridge for several years and forged close personal friendships with current and former faculty and administrators including Dershowitz, former University President Lawrence H. Summers, and former Dean of the Faculty of Arts and Sciences Henry Rosovsky.

Cancer-causing chemical taints water after California blaze

The drinking water in Paradise, California, where 85 people died last year in the nation's worst wildfire in a century, is contaminated with the cancer-causing chemical benzene, officials said.

Officials said they believe the contamination happened after the November firestorm created a toxic combination of gases in burning homes that got sucked into the water pipes as residents and firefighters drew water heavily, the Sacramento Bee newspaper reported Thursday.

Officials say that may explain why benzene, which has been linked to anemia and leukemia, has been found in tests at various spots rather than from one source in Paradise, which was largely destroyed.

The chemical occurs naturally in fire; is part of crude oil, gasoline and cigarette smoke; and is used to make plastics, synthetic fibers and other products, according to the federal Centers for Disease Control.

Melted plastic meters and plastic pipes also may have sent benzene into the system, water officials say.

Paradise Irrigation District officials say they have taken about 500 water samples around town, and they have found benzene 30 percent of the time.

"It is jaw-dropping," said Dan Newton of the state Water Resources Control Board. "This is such a huge scale. None of us were prepared for this."

Those who have assessed the problem say the water district may be able to clean pipes to some homes later this year, but it will take two years and up to $300 million before all hillside residents can safely drink, cook or bathe in the water.

About 1,500 of the town's 27,000 residents are living in the few surviving houses. Water officials have warned them not to drink, cook, bathe or brush their teeth with tap water and to only take quick showers with warm water. Those residents are living on bottled water deliver daily and water tank deliveries.

Norman Stein, 84, drives 15 minutes each week to the water distribution center, loads his trunk with bottles and stacks them in his garage.

He and his wife, Darlene, disagree on the risk posed by their tap water in Paradise. She opened the sink tap to show how clear the water is.

"I could feel an oily substance before. But it's cleared up now," she said. "This is good water."

"Only it's got benzene in it," her husband retorted. "I won't even brush my teeth in that stuff."

Stein is thinking about buying a purifying system, which some of his friends have done. But water officials have said that they don't know how well in-home filters protect residents if there is benzene in their taps.
