It's clear one cannot infer that there "was no spying", however one CAN infer that the spying matter/s are CURRENTLY being investigated, which OBVIOUSLY means they not only KNOW spying occurred but also suspect that spying was ILLEGAL, or it wouldn't be under investigation at all.
