This is a legislative issue. Loopholes abound. Florida needs to tighten up the laws (or as another anon said prosecutors need to charge the right crime).
What I'd like to see: dude walks out of the FL courthouse doing a victory dance and ICE picks his ass up for being here illegally. may not have won the FL case but his ass is now locked up on Federal charges.
