The Privilege from Arrest Clause provides a Member of Congress a privilege from civil arrest only, but not from other civil processes. Even the privilege from civil arrest would be valid only while Congress is in session.

 

Civil arrest is the physical detainment of a person, by lawful authority, to answer a civil demand against him. At the time the Constitution was adopted, civil arrests were common. Long v. Ansell (1934). The Framers likely feared this tool could be misused to interfere with the legislative process. Civil arrest is rarely, if ever, practiced, so this clause is virtually obsolete and has little application today.

 

The Supreme Court interpreted the language "in all Cases, except Treason, Felony, and Breach of the Peace" to encompass all crimes. Williamson v. United States (1908). Tracing the origins of the clause to parliamentary privilege, the Court found this identical language was used to qualify Parliament's privilege from arrest so that the members of Parliament were not immune from criminal prosecution. The Court concluded that the Framers' use of the identical phrase, without any explanation, indicated that Congress's privilege was to have the same limitation regarding criminal actions as did the parliamentary privilege from which the language was borrowed. The clause, therefore, does not provide Congress with any immunity from criminal prosecution.

 

The Supreme Court, applying the Framers' intent, later declared that the clause also did not provide any privilege from civil process. Long v. Ansell. Hence, civil litigants can compel Members of Congress to appear in a court of proper jurisdiction to defend against civil actions. Furthermore, the Court has so narrowly interpreted the clause that Members of Congress may even be compelled by subpoena to testify in criminal and civil actions while Congress is in session.

As Westerners Become Strangers in Their Strange Lands, Only Dead Philosophers Can Save Them

 

Each passing day Westerners are confronted with yet more evidence that their world is one of constant discord and disconnect. Foreign concepts have infiltrated their lands like invasive weeds, threatening to make their way of life redundant in the best case, extinct in the worst. The philosophical teachings of long-gone European thinkers may just be their last hope.

 

In search of some reading material to make it through a torrential weekend, I chanced upon a book in my humble collection entitled, ‘Conversations with Isaiah Berlin.’ Since, like many people, I have been pondering the fate of Western civilization as it passes through a period of tumultuous social and political upheaval, the words on the page I had randomly opened to almost knocked me clean out of my chair.

 

“Solitude doesn’t mean that you live far from other people. It means that people don’t understand what you are saying.”

 

Eureka! The dilemma of enforced multiculturalism summed up in two sentences.

 

Berlin was quoting a friend, a native of the Balkans, who had sought refuge in the United Kingdom some forty years earlier. Although the émigré spoke perfect English, it was not nearly enough to fully assimilate into his new culture. There were simply too many other layers of separation that prevented him from being understood on the most fundamental level by his gracious hosts. It wasn’t his fault, or his host’s; it’s just the way it is.

 

The quote succinctly describes the quandary facing Western man as he is expected to absorb – with absolutely no say in the matter – millions of people from faraway lands with very distinct and different backgrounds. Although it has become politically impolite to even raise the question, can people with dramatically different religions, cultures, manners and language find any real sense of ‘home’ amongst those who could be considered ‘blood strangers’?

 

The conversation in the book turned to the German philosopher, Johann Gottfried Herder (1704-1803), who is said to have anticipated later luminaries, including Fichte, Hegel, Otto von Bismarck and many others. So what could a man who lived over 200 years ago possibly teach modern men in these turbulent times? As it turns out quite a lot.

 

Herder was one of the first thinkers to acknowledge that belonging to a community or tribe is a basic human requirement, just as vital as eating, drinking and shelter. And as it turns out, full membership in the tribe has its privileges.

 

As Berlin explained, “For [Herder] ‘to belong’ means that people understand what you say without your having to embark on explanations, that your gestures, words, all that enters into communication, is grasped, without mediation by the members of your society.”

AZ Lawmaker Forced to Apologize for Stating the Obvious: Arizona Is Starting to Look Like South America

 

Republican lawmaker Sen. Sylvia Allen was caught on tape saying Arizona is starting to look like South America with the hundreds of thousands of illegal migrants flooding into the state.

 

The liberal media says this is racist.

One-fifth of El Salvador already lives in the United States.

Five million illegal migrants from Latin America plan on relocating to the United States this year.

 

There currently are at least 1.1 million Salvadoran immigrants in the United States.

The number represents about one-fifth (19.1 percent) of the total population of El Salvador (5.7 million in 2007 according to the Salvadoran Department of Statistics and Censuses).

 

But if you complain about this planned strategy by the Democrat Party to flood the country with dependent third world migrants — you’re a racist!

 

It is now racist to state the obvious.

The US is being invaded by hundreds of thousands of illegal aliens.

 

The AP reported:

 

The Republican from Snowflake, Arizona, who is white, also said the U.S. has to regulate immigration so the country can provide jobs, education, health care and other needs.

 

“We can’t provide that if people are just flooding us and flooding us and flooding us and overwhelming us,” she said.

 

Wendy Rogers, a Republican running for the state Senate seat now held by Allen, issued a statement Saturday denouncing Allen’s comments as “very racist” and said Allen should retire from the Legislature.

 

Democratic state Sen. Martin Quezada told the Arizona Republic that the “tone and perspective” of Allen’s remarks on migrants were “insulting, to say the least.”

Chinese Bank With $100 Billion In Assets Is Bailed Out

 

Step aside Baoshang Bank, it's time for Chinese bank bailout #2.

 

Last Thursday, when reporting on the imminent failure of yet another Chinese bank in the inglorious aftermath of Baoshang Bank's late May state takeover, we dusted off a list of deeply troubled Chinese financial institutions that had delayed their 2018 annual reports…

 

… and noted that the #2 bank on this list, Bank of Jinzhou - with some $105 billion in total assets - recently met financial institutions in its home Liaoning province to discuss measures to deal with liquidity problems, and in a parallel bailout to that of Baoshang, the bank was in talks to "introduce strategic investors" after a report that China’s financial regulators are seeking to resolve its liquidity problems sent its dollar-denominated debt plunging.

 

Fast forward just three days later, when said failure-cum-bailout is now official: three months after Baoshang Bank was seized by the government in a historic first, Bank of Jinzhou was just bailed out, winning government-backed "reinforcement" on Sunday as three state-controlled financial institutions said they would take at least 17.3% in the troubled lender, whose shares have been suspended since April.

 

Industrial and Commercial Bank of China (ICBC), the country’s largest lender by assets, China Cinda Asset Management and China Great Wall Asset Management, two of China’s four largest distressed debt managers, said on Sunday they would take stakes in Bank of Jinzhou, Reuters reports.

 

To avoid further repo market lockups and freezing in the interbank funding market where in a freak incident, the Chinese government bond repo rate last Friday shot up to a whopping 1,000%…

Baltimore Sun Op-ed, 2016: Trump’s Right: Declare Baltimore a ‘Disaster’ and Rebuild It

 

The Baltimore Sun published an op-ed on Nov. 9, 2016 — the day Donald Trump was declared the winner of the 2016 presidential election — in which the author called for Baltimore to be declared a disaster, and rebuilt.

 

The op-ed, by Sean Kennedy, reads in part:

 

Donald J. Trump is known for his hyperbole, but not all of his ideas are a stretch. Our inner cities are a “disaster,” as he said in the final presidential debate — and they should be officially declared so.

 

Mr. Trump said on the campaign trail that he would “empower cities and states to seek a federal disaster designation for blighted communities in order to initiate the rebuilding of vital infrastructure, the demolition of abandoned properties and the increased presence of law enforcement.” Now that he’s captured the presidency, let’s hope he follows through.

 

The idea is radical, revolutionary and just what urban America needs: a federal disaster declaration for our most impoverished neighborhoods hard hit by crime, urban blight and economic malaise.

When the president declares an area to be a disaster, additional federal assistance can be applied while regulations and rules for rebuilding and revitalizing the affected area are often waived or reduced.

 

 

Declaring our most beleaguered neighborhoods to be “disaster zones” and encouraging entrepreneurial activities through access to capital and microloans would inject capital, expedite much needed infrastructure and give our inner cities hope again.
