The guy in the background looks like Jeff Kent, who is the director of the press photographer's gallery at the Senate, who works under the Sgt. At Arms. It looks like the photographer is getting permission from Jeff before the photo is taken, and he's watching over things while the hearing is adjourned.
Also, just an FYI, taking photos of documents left out is a loooong tradition. A quick search of AP, Getty or any other wire service would show this isn't a big deal, or usually of any interest to legislators.
