If Congress disagrees, they should appeal to the courts, not negotiate witnesses with one Justice (possibly compromised) being the tiebreaker in the Senate.
As Dersh noted yesterday, these proceedings have repercussions well beyond the present and proper separation of powers must be maintained, else the federal system devolves into parliamentary chaos.
