House mgrs have said many times, "A trial must have witnesses and docs." But it's not that simple.

Trope used to disguise the real issues, the real decisions you'd be making re witnesses. What's really at stake; will explain.

No need for that. Why? Bc the articles on their face are defective.

2nd article on obstruction; no fact witnesses will make any difference. BC he asserted constitutional rights.

1st article: also defective. Just focuses on POTUS' subjective motives. Today again: he defied the foreign policy of the US.

"This is not a constitutionally coherent stmt."

Way too maleable = maladminstration. We've heard from a lot of witnesses (192 vid clips from 13 witnesses plus 28000 of docs).

Trial: w/impeachments, doesn't work the same way as regular trial. Worked should have been done in the House.

If procedures used in the House this time are the "new normal," that's a problem. Sets a precedent.

Would also set a precedent to seek new witnesses in the Senate (ones they didn't ask or pursue in the House).

Would mean the Senate becomes the investigatory body.

And the Chief Justice can't be the one to decide whether executive privilege applies, either. Would result in a lot of litigation.

 

Impeachment was rushed thru in 78 days, v fast as compared with previous impeachments. For 71, POTUS was "entirely locked out."

Impeachment process needs to be swift; not good for the country otherwise. A delay promotes "intrigue and corruption." - Hamilton

If new normal is a half-baked House process and long Senate trial, that makes the process very political, espec in an election year.

[lists witnesses from House; for each one, "we did not have the opportunity to cross examine".

They say their case is "overwhelming." Nadler: "There is no doubt."

House investigates; Senate deliberates. They want you to investigate.

The idea that they haven't had witnesses: that's the smokescreen. Even so, doesn't prove an impeachable offense.

They got their impeachment by Christmas. But now they want you to do the work they didn't do.

Witnesses: would take a LOT longer than one week.

We came here to try this case based on the record they presented.

But what they presented doesn't meet the stds for an impeachable offense.
