Barbra Streisand: Adam Schiff Would Make a Great President

Pop icon, Constitutional scholar, and noted political pundit Barbra Streisand says she sees in Adam Schiff (D-CA), the face of the Democrat impeachment campaign against President Donald Trump, a man who “would make a great president.”

“Adam Schiff is so impressive. His knowledge of the law… his passion… his articulateness. His sincerity!” Barbra Streisand said, pouring praise on the partisan lawmaker. “He speaks the truth and would make a great president.”

Babs may want to pomp the breaks because as it stands, only 27 percent of America has a positive opinion of Rep. Schiff according to YouGov data. The same polling outfit reports that President Trump’s approval among Americans sits at 39 percent.

This wild declaration from Streisand comes just a month after the two-time Academy Award-winner and apparent Constitutional law expert said “impeachment is the sober process envisioned by the Founders to counter such a threat” as President Trump.

Streisand followed that whopper of a hot take up by listing six reasons why she thinks Trump should be impeached. Including:

1. Trump bribed and extorted the Ukraine with taxpayer money to investigate a political rival for personal gain.

2. Trump believes he is above the law. He thinks presidents can do anything.

3. Trump threatened a witness, a career diplomat, during the impeachment inquiry.

4. Trump clearly lied and obstructed justice in the Mueller investigation.

5. Trump dismisses intelligence briefings about Russia’s role in undermining our democracy, and repeats Kremlin disinformation on Ukraine.

6. Trump is personally profiting from the presidency, violating the emoluments clause. He charges our government to stay at his resorts.

Harvey Weinstein says he hired Israeli firm Black Cube ‘for days like this’

Disgraced producer, on trial for rape, questioned about use of private investigators to track and silence journalists and accusers

NEW YORK (AP) — Harvey Weinstein offered an unscripted defense Thursday of his use of private undercover investigators who allegedly tried to silence his accusers, saying he did it “for days like this.”

The remark came as the former Hollywood producer left his New York City rape trial and a reporter asked him why he hired Black Cube, a firm founded by former intelligence analysts from the Israel Defense Forces.

Prosecutors say the firm’s investigators used fake identities to meet with journalists and track the accusers to thwart publication of stories about Weinstein’s alleged sex offenses.

The jury heard testimony about the Black Cube deal on Thursday from a lawyer who helped arrange it. Weinstein hired the firm in 2017, as reporters from The New Yorker and The New York Times were looking into his behavior with women.

Those stories, published in October 2017, ushered in the #MeToo movement as scores more women came forward with allegations against Weinstein and other prominent figures in industries from Hollywood to Wall Street.

The jury of seven men and five women saw an email from Weinstein to someone at Black Cube reading: “Red flags are the ones of interest” — what prosecutors say was a reference to list of names marked in red to identify accusers.

Those names included “Sopranos” actress Annabella Sciorra, who testified last week that he overpowered and raped her after barging into her apartment in the mid-1990s.

Weinstein, 67, is charged with forcibly performing oral sex on Mimi Haleyi, at the time a “Project Runway” production assistant, in 2006, and raping another aspiring actress in 2013. That woman could testify Friday.

Weinstein has insisted any sexual encounters were consensual.

On the seventh day of testimony, jurors also heard the ex-boyfriend of a fledgling actress describe how she came home “pretty shocked, upset, angry” and “kind of overall appalled” after a hotel room meeting where she says Weinstein offered her movie roles in exchange for three-way sex.

Lincoln Davies, who was dating Dawn Dunning at the time in 2004, was called as a prosecution witness to bolster emotional testimony by Dunning and another aspiring actress on Wednesday, accusing Weinstein of preying on their vulnerabilities while pushing the notion that sex could lead to stardom.

Dunning also said Weinstein put his hand up her skirt and fondled her genitals a few weeks earlier that same year. But Davies said that she never told him about that.

Also taking the witness stand was the manager of the celebrity hangout where Tarale Wulff, then a cocktail waitress, alleged that Weinstein masturbated in front of her on a secluded terrace. Maurizio Ferrigno testified he saw Weinstein and Wulff heading up a stairway, but conceded on cross-examination that prosecutors helped jog his memory of the moment, which Wulff says happened about 15 years ago.

The experiences of Dunning and Wulff, who also claims Weinstein raped her in his SoHo apartment in 2005, are not part of the underlying criminal charges against him, but their testimony could be a factor in whether he goes to prison at the end of his landmark #MeToo-era trial.

Prosecutors called them as witnesses under a state law that allows testimony about so-called prior bad acts, enabling them to explore things like motive, opportunity, intent and a common scheme or plan.

Weinstein’s lawyers objected to Davies testifying, arguing that it was unheard of to allow corroborating witnesses for accusers whose allegations aren’t part of the underlying case. Weinstein lawyer Arthur Aidala argued that bringing in witnesses to support those women’s allegations was “an attempt by the prosecution to poison the jury with extrinsic evidence.”

The Associated Press does not typically identify people who say they have been victims of sexual assault, unless they agree to be named or have gone public with their stories, as Haleyi, Wulff, Sciorra and Dunning have done

Trump Flatly Denies Report He Asked Bolton To Set Up Meeting For Giuliani In Ukraine

President Donald Trump issued a statement Friday denying a New York Times report that claimed he asked former National Security Adviser John Bolton to get involved in Rudy Giuliani’s anti-corruption efforts in Ukraine.

Giuliani began traveling to Ukraine in the spring of 2019 in the hopes of uncovering damaging information about Burisma, a Ukrainian gas company, and the Biden family. The Times reported that Bolton’s unpublished manuscript of his forthcoming book describes the president’s efforts to get him to set up a meeting between Giuliani and Ukrainian president Volodymyr Zelensky.

“Mr. Trump told Mr. Bolton to call Volodymyr Zelensky, who had recently won election as president of Ukraine, to ensure Mr. Zelensky would meet with Mr. Giuliani, who was planning a trip to Ukraine to discuss the investigations that the president sought, in Mr. Bolton’s account. The president denied the allegations in a statement.

A new bill could punish web platforms for using end-to-end encryption

A Section 230 change could have an ulterior motive

A new bill would reduce legal protections for apps and websites, potentially jeopardizing online encryption. The draft bill would form a “National Commission on Online Child Exploitation Prevention” to establish rules for finding and removing child exploitation content. If companies don’t follow these rules, they could lose some protection under Section 230 of the Communications Decency Act, which largely shields companies from liability over users’ posts.

Reports from Bloomberg and The Information say that Sen. Lindsey Graham (R-SC) is behind the bill, currently dubbed the Eliminating Abusive and Rampant Neglect of Interactive Technologies (or EARN IT) Act. It would amend Section 230 to make companies liable for state prosecution and civil lawsuits over child abuse and exploitation-related material, unless they follow the committee’s best practices. They wouldn’t lose Section 230 protections for other content like defamation and threats.

The bill doesn’t lay out specific rules. But the committee — which would be chaired by the Attorney General — is likely to limit how companies encrypt users’ data. Large web companies have moved toward end-to-end encryption (which keeps data encrypted for anyone outside a conversation, including the companies themselves) in recent years. Facebook has added end-to-end encryption to apps like Messenger and Whatsapp, for example, and it’s reportedly pushing it for other services as well. US Attorney General William Barr has condemned the move, saying it would prevent law enforcement from finding criminals, but Facebook isn’t required to comply. Under the EARN IT Act, though, a committee could require Facebook and other companies to add a backdoor for law enforcement.

Riana Pfefferkorn, a member of the Stanford Law School’s Center for Internet and Society, wrote a detailed critique of the draft. She points out that the committee would have little oversight, and the Attorney General could also unilaterally modify the rules. The Justice Department has pushed encryption backdoors for years, citing threats like terrorism, but they haven’t gotten legal traction. Now, encryption opponents are riding the coattails of the backlash against big tech platforms and fears about child exploitation online.

Techdirt founder Mike Masnick also notes that Section 230 doesn’t cover federal crimes — so the Justice Department could already prosecute companies if they’re enabling abuse. This bill would just let it write a new set of rules by threatening much broader liability.

A spokesperson for Graham’s Senate Judiciary Committee emphasized to Bloomberg that the bill isn’t final. And the Justice Department is taking a closer look at Section 230 next month, holding a public workshop to discuss potential changes.

Bloomberg is aiming to direct online traffic to his campaign while also attempting to steer eyes away from Trump’s reelection bid. Germany Cancels $2.5 Billion Deal to Buy Giant US Surveillance Drones

Will buy far cheaper manned Canadian aircraft instead

The German government has called off a $2.5 billion deal to purchase four MQ-4C Triton surveillance drones, deciding instead to deploy crewed business jets modified for surveillance.

The lost contract is a disappointment for Triton manufacturer Northrop Grumman. But the reasons given for the decision should alarm not just Northrop, but all defense contractors hoping to see drone sales rocket higher in the years to come.

Low-tech affordability wins the day

The U.S. State Department in April 2018 approved Germany’s request to buy four Triton surveillance aircraft for $2.5 billion, a deal that would have marked the Triton’s introduction into the European market. The order followed a failed effort by Northrop Grumman to sell a modified version of its RQ-4 Global Hawk drone, dubbed the EuroHawk, to Germany.

The State Department agency that approved the sale said at the time the deal would “support legitimate national security requirements” and “close a crucial capability gap” between the U.S. and its NATO allies.

Developed during the last decade at an estimated program cost of more than $12 billion, the Triton is the next generation of U.S. high-altitude, long-endurance unmanned aerial vehicles (UAVs). The drone, working with a ground control station, is designed to patrol vast swaths of oceans and coastal regions.

The U.S. Navy is the primary customer for the Triton, with plans to buy as many as 68 drones, but contractors often can boost profitability by selling systems developed for the U.S. government to allied nations. Australia and India have been mentioned as potential buyers, but Germany was the firmest expression of interest.

But German officials in a confidential letter obtained by Reuters said that the drones would not be ready for delivery until at least 2025 and the high cost of the program could not easily be financed.

Instead, Germany will buy a fleet of Bombardier Global 6000 aircraft packed with sensors. The Global 6000 is certainly a safer choice. The plane has been in service since 1999 and is used by the U.S. and a number of other nations for military surveillance. The unit cost, listed at about $62 million apiece, is considerably less than the estimated $120 million price for each Triton.

Airspace concerns

While timing and cost seem to be the primary reasons for Germany’s decision, there were also concerns about the drone’s ability to operate within European airspace. Germany, according to reports, was concerned about the Triton’s ability to win European Union Aviation Safety Agency certification.

Concern about airspace navigation was one reason that Germany gave for abandoning the Eurohawk, and this time military officials had hoped Northrop would be able to develop a technology safety package that would meet European regulatory scrutiny. Those hopes took a hit when Italy late last year was given tight restrictions on its fleet of Global Hawk drones when flying over land.

The issue is a concern not just for Northrop Grumman, but for others including Boeing, Kratos Defense & Security, and AeroVironment that are betting on a proliferation of drones in the years to come. In 1871 The United States became a corporation with a new constitution. The original constitutional government was vacated, however it was never terminated. February 21, 1871, the 41st Congress came to session. On this date the congress passed an act titled An Act To Provide A Government for the District of Columbia, also known as the Act of 1871.

Congress, under no constitutional authority, created a separate form of government, the District of Columbia. This new corporate government know as THE UNITED STATES was born. This was a construct of the British Crown and the Vatican.

After the Civil War, the unofficial British corporate government established a corporate office called "The United States Postmaster General" to perform the day to day functions of the international office (previously called Post Master). As the corporation had no ability or authority to appoint the Land Trustee, the actual office of United States Post Master was vacated and remained so (as was the Constitution). Even though the functions mandated by the Postal Union Treaty were performed by the de facto Postmaster General, there was no Trustee to defend the jurisdiction of the Constitution overall.

Senate Republicans said Friday the final votes to acquit President Trump of two articles of impeachment could drag into Saturday, or longer, if lawmakers agree to a lengthy final debate. The Senate is expected to defeat a motion late this afternoon to call additional witnesses in the trial, clearing the way for final consideration of the abuse of power and obstruction of Congress charges hanging over the president. While Trump is certain to be acquitted, Democrats are likely to insist at that point on further deliberations, in public, that allow each senator a time to speak publicly about the case against the president for up to 10 minutes. That could take days.

Republicans leaving a closed-door meeting Friday said the trial is slated to end “soon,” but nobody knows exactly when. “I have no best guess,” Sen. Roy Blunt, a Missouri Republican and member of the leadership team, said as he left the meeting and headed into the Senate chamber for the start of final arguments in the impeachment trial. A senior GOP aide said the final votes to acquit Trump on the two articles are not expected tonight.

Senate Democrats are expected to introduce motions that would extend the trial, although Sen. Chuck Schumer, a New York Democrat, declined to say what procedural maneuvers he is considering. Sen. Thom Tillis, a North Carolina Republican, said late night acquittal votes seemed unlikely but could come later this weekend. “I don’t expect it to wrap up tonight,” Tillis said. "That just doesn’t make sense from an operational perspective. I’d like it to wrap up tomorrow, but we’ll have to see what’s up.” Most Republicans who stopped to speak to reporters in the Capitol Friday said they want the trial to end soon and opposed extending it into next week.

Senators have sat in the trial six days a week since Jan. 21, and many of them are eager to go home or take a break from the grueling proceedings. They are also eager to return to regular legislative business. “We’ve sat for 11 or 12 hours a day, for nine days,” said Sen. Lamar Alexander, a Tennessee Republican. “We’ve heard the arguments, we’ve had video of nearly 200 witnesses presented to us, so it’s been a good, fair process and for me, I’m ready to come to a conclusion whenever the procedure allows it.” The conclusion of the trial became more certain Friday when a second swing Republican, Lisa Murkowski of Alaska, announced she would not vote to call for additional witnesses. Murkowski followed Alexander, who announced his opposition to new witnesses Thursday night. Murkowski’s announcement removes ambiguity by preventing a tie vote for new witnesses, which would have opened the door for Chief Justice John Roberts to intercede. Now the vote for new witnesses will fall to 49 votes, with 51 lawmakers opposed.

Sen. Lindsey Graham, a South Carolina Republican, said the trial should end “no later than tomorrow.” He does not want to extend deliberations on a final verdict, even if Democrats insist on it. The president’s State of the Union is scheduled for Feb. 4. “It would be a mistake, and it would blow up in their face, and there would be no reason for it,” Graham said.
