The Constitution is constructed so that the Executive (Trump) has the highest authority in a time of emergency or war. The Executive is elevated ABOVE the Congress and Courts when a state of Emergency or Military law is imposed.
They can't 'out-legislate' or bring a successful court case against the President to nullify the design of the Constitution.
