…What makes this Horowitz statement so ridiculous, political and hypocritical, is that only four days earlier IG Horowitz was so alarmed at the gross incompetence of Atkinson that he submitted an interim memorandum noting extreme deficiencies in the FISA work product of Michael Atkinson as legal counsel for the DOJ-NSD.

 

The DOJ and FBI have an internal FISA self-check mechanism. The DOJ National Security Division (DOJ-NSD) chief counsel Michael Atkinson, and the chief counsel for every FBI field office are required to conduct an “Accuracy Review” of selected FISA applications. One per field office (25 to 30 field offices),which are also sent to DOJ-NSD (main justice) for general counsel Atkinson inspection.

 

Horowitz detailed 39 examples of Michael Atkinsons’ willful violations of law and policy within 42 “accuracy review” files at the DOJ-NSD. The error rate within the DOJ-NSD files that Atkinson was responsible for was over 93%.

 

IG Michael Horowitz was so alarmed by the gross incompetence he sent an urgent interim memorandum to the DOJ and FBI notifying the Attorney General and FBI Director of the systemic violations discovered. Two days later the FISA court responded to the IG memorandum by demanding the DOJ/FBI reveal the names of the application targets.

 

So it is more than a little disingenuous and self-serving for Michael Horowitz to be clutching his pearls about Michael Atkinson getting fired as ICIG, when only a few days earlier Horowitz was raising alarm bells about Atkinson’s gross incompetence in his former position as general counsel for the DOJ National Security Division.

 

Perhaps Horowitz didn’t think anyone would notice?

 

Perhaps Horowitz was so assured of MSM providing cover, that he didn’t think anyone would connect the dots from his recent memo on the DOJ-NSD incompetence, to the man who held the job, Michael Atkinson?

 

Regardless of Horowitz’s anticipatory outlook, the recent IG report outlining Atkinson’s gross incompetence in the FISA scandal, vis-a-vis the 42 DOJ-NSD Accuracy Reviews, is the atomic shield against the political narrative Horowitz, Atkinson and their political allies might attempt to deploy.

Two of the more common applications of the word are as part of the terms "with prejudice" and "without prejudice". In general, an action taken with prejudice is final. For example, "dismissal with prejudice" forbids a party to refile the case, and might occur either because of misconduct on the part of the party who filed the claim or criminal complaint, or the result of an out of court agreement or settlement. Dismissal "without prejudice" (in Latin, salvis iuribus) allows the party the option to refile, and is often a response to procedural or technical problems with the filing that the party could correct when filing again.

A caution on the Flynn case.

Following the government’s motion to dismiss the case, the defense has agreed to withdraw all pending motions, including the plea to withdraw the guilty plea and compel further productions from Covington. This will probably be filed very soon (or while I’m typing this)

Obviously this makes sense from the individual standpoint of General Flynn, who surely wants the case over with after 3+ years of hell

But from the standpoint of spygate, it means we won’t be seeing the original 302 & any other evidence that could have been disclosed via more court filings. In fact, the motion relies on the “edited” version of the 302, rather than the original, and doesn’t say if it still exists

It also means, after Sullivan accepts the governments motion, the case obviously never goes to trial. So no Strzok, Comey, McCabe, Yates or Pientka on the witness stand. No pre-trial discovery. No extensive press coverage leading up to & during the trial. No “not guilty” verdict

And the DOJ’s motion, while devastating to the credibility of Comey and co, withdraws the case on the least bad outcome for the DOJ/FBI, basically a poor application of process defense: e.g. the lack of a “predicted” investigation, and “materiality” statute requirements not met

The motion doesn’t accept that egregious misconduct occurred. Or that the interview was a set up to entrap Flynn (though it hints it). It just says there was no basis for the FBI’s interview, which isn’t the same thing at all. It doesn’t say WHY Comey & co. did what they did

It’s a little like the IG report in that respect

 

DOJ: The FBI had no basis to open a case on Flynn and no basis to interview him, as no crime occurred

 

ALSO DOJ: We don’t say why that case was really opened, why the interview occurred, who ordered it, & covered it up, and why

Maybe that will be part of Durham’s investigation. Maybe it wont. But what we can say for sure is that the DOJ’s motion ensures we won’t find out those answers via the legal route of the Flynn case

Flynn’s had to carry enough of a burden over the last few years though. It’s not on him to keep this case open just to expose what happened to him AND everyone else. Thats AG Barr’s job. And he needs to finish it.

Materials from the Committee's Investigation into Russian Active Measures

In 2017 and 2018, the House Permanent Select Committee on Intelligence (HPSCI) undertook an investigation into Russia’s interference campaign targeting the 2016 U.S. election. The Committee’s investigation came on the heels of an Intelligence Community assessment, which found:

 

“Russian President Vladimir Putin ordered an influence campaign in 2016 aimed at the US presidential election. Russia’s goals were to undermine public faith in the US democratic process, denigrate Secretary Clinton, and harm her electability and potential presidency. We further assess Putin and the Russian Government developed a clear preference for President-elect Trump.”

 

Democrats on the Committee affirmed that judgement, as did Special Counsel Robert Mueller, and the bipartisan Senate Intelligence Committee. Throughout its investigation, the Committee uncovered significant evidence of Trump campaign efforts to seek, make use of, and cover up Russian help in the 2016 presidential election. To date, two witnesses have been convicted and sentenced to prison terms for lying and attempting to obstruct the Committee’s investigation.
