The CARES Act did more than provide much needed funding to individuals and small businesses during this COVID-19 viral pandemic. Part of that historic piece of legislation was a directive that allowed Attorney General Barr to direct the Bureau of Prisons (BOP) to use Home Confinement when emergency conditions exist. The purpose of such a directive was to reduce the inmate population so that some means of “social distancing” could be achieved in prison institutions and to allow the release of inmates who have underlying conditions that could lead to a tragic outcome if they contracted COVID-19 (age, immunity issues). However, the BOP has created a deal of confusion about its own policy about who will be released to Home Confinement.
