Hateful Memes Challenge and data set for research on harmful multimodal content

 

We’ve built and are now sharing a data set designed specifically to help AI researchers develop new systems to identify multimodal hate speech. This content combines different modalities, such as text and images, making it difficult for machines to understand.

 

The Hateful Memes data set contains 10,000+ new multimodal examples created by Facebook AI. We licensed images from Getty Images so that researchers can use the data set to support their work. We are also releasing the code for baseline-trained models.

 

We are also launching the Hateful Memes Challenge, a first-of-its-kind online competition hosted by DrivenData with a $100,000 total prize pool. The challenge has been accepted as part of the NeurIPS 2020 competition track.

 

In order for AI to become a more effective tool for detecting hate speech, it must be able to understand content the way people do: holistically. When viewing a meme, for example, we don’t think about the words and photo independently of each other; we understand the combined meaning together. This is extremely challenging for machines, however, because it means they can’t just analyze the text and the image separately. They must combine these different modalities and understand how the meaning changes when they are presented together. To catalyze research in this area, Facebook AI has created a data set to help build systems that better understand multimodal hate speech. Today, we are releasing this Hateful Memes data set to the broader research community and launching an associated competition, hosted by DrivenData with a $100,000 prize pool.

 

The challenges of harmful content affect the entire tech industry and society at large. As with our work on initiatives like the Deepfake Detection Challenge and the Reproducibility Challenge, Facebook AI believes the best solutions will come from open collaboration by experts across the AI community.

 

We continue to make progress in improving our AI systems to detect hate speech and other harmful content on our platforms, and we believe the Hateful Memes project will enable Facebook and others to do more to keep people safe.

Building a data set for hateful multimodal content

 

The Hateful Memes data set consists of more than 10,000 newly created examples of multimodal content. The memes were selected in such a way that strictly unimodal classifiers would struggle to classify them correctly (as illustrated in the examples below). We also designed the data set specifically to overcome common challenges in AI research, such as the lack of examples to help machines learn to avoid false positives. It covers a wide variety of both the types of attacks and the groups and categories targeted. (More information on the data set is available in this paper.)

US Defence Department Awards Boeing $2.6 Billion in Cruise Missile Contracts

 

US aerospace giant Boeing won two cruise missile contracts worth over $2.6 billion combined to support foreign military sales to Saudi Arabia and six other countries, the Defence Department said in a press release.

The ruling found that the European Central Bank’s (ECB) purchase of German government bonds are unconstitutional. This could present a problem for the ECB’s effort to make loans available for Eurozone countries that have been hit especially hard by the pandemic — Italy and Spain in particular.

 

“The ruling poses a threat that could destroy the European Union as an institution based on the rule of law, precisely because it was delivered by the German constitutional court, which is the most highly respected institution in Germany,” Soros said. “Before it delivered its verdict, it had consulted with the European Court of Justice and then decided to challenge it. So you now have a conflict between the German Constitutional Court and the European Court of Justice. Which court has precedence?”

Confirmed: China Pressured WHO Against Declaring Coronavirus Global Health Emergency

 

China pressured the World Health Organization (WHO) against declaring the coronavirus pandemic a global health emergency, a senior U.S. intelligence official told the Daily Caller News Foundation.

 

That official’s account confirms aspects of Newsweek’s reporting, which cited a CIA report stating that China urged the WHO not to declare the pandemic a global health emergency.

 

The WHO, the health arm of the United Nations, was supposed to decide on Jan. 22 whether to declare a global health emergency, but WHO Director-General Tedros Adhanom Ghebreyesus ended up delaying the decision until the next day.

 

In his statement announcing the delay, Tedros praised “the cooperation of China’s Minister of Health, who I have spoken with directly during the last few days and weeks.”

 

“The decision about whether or not to declare a public health emergency of international concern is one I take extremely seriously, and one I am only prepared to make with appropriate consideration of all the evidence,” Tedros added.

 

The next day, the WHO opted not to declare a global health emergency. “I am not declaring a public health emergency of international concern today,” Tedros, who won his position in 2017 with China’s backing, said on Jan. 23.

 

“As it was yesterday, the Emergency Committee was divided over whether the outbreak of novel coronavirus represents a PHEIC or not,” he continued. “Make no mistake. This is an emergency in China, but it has not yet become a global health emergency. It may yet become one.”

 

The WHO didn’t declare a global health emergency until Jan. 31.

Exiled Businessman Exposes Sweeping Chinese 'Disinformation Campaign' On Social Media

 

Were you surprised by the sheer volume of vitriolic tweets about President Trump's decision to use the phrase "Chinese virus"? Well, one London-based Chinese businessman/dissident says he has evidence that might explain this phenomenon, and shed some light on how Beijing manipulates social media platforms to exploit and shape public opinion far beyond the borders of the mainland.

 

China has been using armies of "bot" accounts on platforms like twitter to harass and criticize those who speak out against the Chinese government in Beijing and its handling of the outbreak, and spread disinformation about the origins of the virus that - you guessed it - blame the American military for unleashing the virus in Wuhan.

 

The dissident said that during the week before last, he identified more than 1,000 bot accounts on Twitter which he believes to be part of a government-backed "Swarm". He's also identified dozens of suspicious pages on Facebook.

 

Between April 25 and May 3, Strick said he identified more than 1,000 accounts on Twitter that were associated with the Chinese disinformation effort, as well as more than 50 different pages on Facebook. He estimated that 300 or 400 new Twitter accounts were joining the network each day, as part of the Chinese campaign.

 

"The network has evolved and is still growing," said Strick, in an interview. "I believe it’s a state-backed Chinese campaign."

 

Strick said his research is just the latest to highlight one aspect of China's sweeping propaganda campaign to rewrite history as far as the virus is concerned. Yet, liberals who complain constantly about Fox News brainwashing are acting as the CCP's "useful idiots" by amplifying these fake voices.

 

Strick’s work is the latest research suggesting China has ramped up disinformation around the coronavirus, to dilute their own culpability and shift blame elsewhere, although some have cast doubt on certain findings or suggested they may warrant further investigation.

 

In research published last week on the investigative website Bellingcat, Strick described the operation as a "well-structured information campaign” that was working in a coordinated way “to skew the narrative around varying topics, and to push set agendas."

 

The operation bears some of the same hallmarks as a network of 900 accounts that Twitter uncovered in August last year, which the company identified as “a significant state-backed information operation focused on the situation in Hong Kong,” operated from mainland China.

A spokesperson for the Joe Biden presidential campaign responded to the public furor surrounding the revelations about the unmasking of Mike Flynn, and then implied that racism was the cause for the alarm.

 

Biden faced intense criticism on Wednesday when it was revealed that he was included in the group of Obama era officials that called for the unmasking of Michael Flynn's identity in surveillance reports.

 

Many used the report to accuse Biden of being part of a politically motivated witch hunt to entrap Flynn in order to force him to testify against President Donald Trump.

 

The Biden campaign denied the claims in a statement from Andrew Bates, the director of rapid response.

 

"Donald Trump's attempt at dishonest media manipulation to distract from his response to the worst public health crisis in 100 years has backfired. These documents simply indicate the breadth and depth of concern across the American government including among career officials over intelligence reports of Michael Flynn's attempts to undermine ongoing American national security policy through discussions with Russian officials or other foreign representatives," the statement read.

 

"Importantly, none of these individuals could have known Flynn's identity beforehand. These documents have absolutely nothing to do with any FBI investigation and they confirm that all normal procedures were followed – any suggestion otherwise is a flat out lie," Bates added.

 

"What's more, it's telling that these documents were selectively leaked by Republicans abusing their congressional powers to act as arms of the Trump campaign after having them provided by a partisan official installed for this very purpose," he continued. "The only people with questions to answer are [acting Director of National Intelligence] Grenell, Sen. [Chuck] Grassley (R-Iowa), and Sen. [Ron] Johnson (R-Minn.) for their gross politicization of the intelligence process."

 

Bates retweeted a message that implied the outrage over the unmasking was actually an expression of racism against former President Barack Obama.

May 13 (UPI) – The Senate on Wednesday passed an amendment providing increased protections for targets of Foreign Intelligence Surveillance Act warrants but failed to approve new restrictions on the federal government's ability to search Internet history. Leahy on Wednesday praised the passage of his amendment which would make outside reviews of warrants on U.S. citizens be conducted in FISA court. "BIG win tonight for the protection of Americans' privacy and civil liberties!" Leahy wrote on Twitter.

 

The passage of the amendment, however, will send the legislation back to the House, which must pass the measure again before sending it to President Donald Trump for approval. IBCS (Integrated Air and Missile Defense Battle Command System) Goes Agile.

 

A year ago, after the U.S. Department of Defense called for a movement to Agile development methodologies, one of the Northrop Grumman IBCS software teams was part of a pilot program with the U.S. Army. The experience and results were well received and, last November, the Army awarded a $70 million, 28-month contract to transform the entire IBCS software development process to an Agile framework.

 

Under the contract, Northrop Grumman and the Army are partnering to prototype an Agile development process in order to build, test and field capabilities faster to respond to current and emerging needs.

 

“We’ve been developing and delivering software to the Army under our Agile framework for months,” said Kim Robbins, Northrop Grumman software lead for IBCS. “One of the reasons for our success has been the partnership with our customer in creating our quick feedback loop.”

 

Regular feedback among the team members and the customer is a core tenet of Agile methodology, which involves the delivery of products or capabilities in regular Program Increments (PIs). For IBCS, they are three-month PIs, comprised of three-week “sprints” in which each team tackles their specific tasks and issues required to deliver. A product owner from the Army’s Integrated Air and Missile Defense office is a member of the team.

 

“Before Agile, it wasn’t unusual to wait a month or more to learn whether your ‘bug fix’ or software change worked well for the warfighters who will use IBCS,” said engineer Josh Bagwell, of the Support Operations (SO) software team. “Now, through quick communication with a soldier, we bounce ideas off each other. It helps us ‘fail fast, fail early’ so time isn’t wasted on a bad idea.”

 

“The regular communication with soldiers helps busy IBCS team members see themselves and their work in the Army’s mission,” said IBCS Deputy Program Director Alana Henley. She has also noticed another benefit as the mindset shift accompanying Agile has empowered the engineers.

 

“Because of the regular communication and the development atmosphere, I’ve seen entry-level engineers become more comfortable raising issues and talking with their more experienced peers,” Alana explained. “They’re embracing ownership of problems and signing up for work, and that’s a big deal.”

 

In their first sprint after the contract award last fall, the teams developed software that was used in IBCS Flight Test 5 at White Sands Missile Range in December 2019 — the most complex flight test to date, in which two target cruise missiles were intercepted simultaneously by the soldiers at the system’s controls.

 

“Northrop Grumman has long been an Agile pioneer, transforming processes to speed development while increasing communication with customer end-users and increasing quality,” said Mark Rist, Northrop Grumman IBCS, program director. “We are shifting the paradigm, because every aspect of the program can benefit from the increased communication and incremental nature of Agile.”

Jones is a top-tier conspiracist, a professional one, too, and I visited him at his headquarters to find out for myself if he actually believed the idiocy he peddled—that the government controls the weather; that Bill Gates is secretly a genocidal eugenicist. The list of absurdities has no end. It always seemed outlandish to me that otherwise smart people (Mustafa Mahmoud was one of Egypt’s leading physicians) could sincerely believe in theories that stand in opposition to logic

He has even begun to question the official coronavirus death toll, which he sees as evidence of a dark plot against him. How is he different from Alex Jones, from the conspiracy manufacturers of Russia and the Middle East?

Part of that historic piece of legislation was a directive that allowed Attorney General Barr to direct the Bureau of Prisons (BOP) to use Home Confinement when emergency conditions exist. The purpose of such a directive was to reduce the inmate population so that some means of “social distancing” could be achieved in prison institutions and to allow the release of inmates who have underlying conditions that could lead to a tragic outcome if they contracted COVID-19 (age, immunity issues). However, the BOP has created a deal of confusion about its own policy about who will be released to Home Confinement.

May 13 (UPI) – Bankrupt satellite company OneWeb could get Defense Department funding, a Space Force official said while warning China to stay away from the company's assets. Startup companies specializing in space research have been hit hard by the coronavirus pandemic. OneWeb, a British company contracted to provide Internet access for the U.S. Space Force in Arctic regions with a consumer-grade, low-earth orbit satellite constellation, declared bankruptcy in March.

 

Started in 2015 to great fanfare in the business community, the company raised over $3 billion in startup financing, largely from the Japanese investment firm SoftBank. The Defense Department is considering action to help OneWeb and other contractors facing insolvency, Lt. Gen. David Thompson, vice commander of Headquarters Space Force, said on Tuesday. "I will say with respect to OneWeb specifically and others, we continue to work," Thompson said. "We work with the White House and we'll be working with Congress, not just focused on OneWeb but all of the commercial space companies that face bankruptcy and face those concerns." He added that the department's Space Acquisition Council collected a list of proposed investments for space companies which need a rapid infusion of capital to ensure that emerging space technologies remain available to the U.S. military. Thompson stressed that an added consideration is the possibility "that potential adversaries don't have the opportunity to acquire those capabilities."

 

Reports surfaced last week that proposals to buy OneWeb's assets in bankruptcy proceedings were received from two companies with links to the Chinese government. Got in a "debate" over the value of cloth masks with a "true believer" a few days back. He ignored the passage of single virii and claimed that clumps of virii were the culprit anyway.

Two problems. 1) a cube of WUFLU consisting of over 20k individual 11nm virus particles clumped together would still freely pass through the 300nm holes in most particle masks. 2) a cluster of WUFLU with more particles than that would fall out of the air all on their own. When I was operating woodworking tools in my basement, the air I was breathing was cleaner than the air outdoors. I don't claim to be a rocket surgeon, but the math involved isn't all that challenging.

Dole was born the only daughter of John Van Hanford and Mary Cathey Hanford, wealthy merchants in the floral industry. Dole excelled academically and was elected class president during her first year in high school. She earned a degree in political science from Duke University in Durham, North Carolina, in 1958 and a master’s and a law degree from Harvard University in Cambridge, Massachusetts, in 1960 and 1965, respectively. Upon finishing her education, she moved to Washington, D.C., to work in national politics.

Although a member of the Democratic Party, Dole served as deputy assistant for consumer affairs under Pres. Richard Nixon from 1969 to 1973. In 1973 Nixon appointed her to a seven-year term on the Federal Trade Commission (FTC). In 1975 she married Sen. Bob Dole of Kansas and became a Republican. She took a leave of absence from the FTC during her husband’s vice presidential bid with Gerald Ford in 1976 and resigned from her position in 1979 to campaign for her husband’s 1980 presidential run.

 

During the Reagan administration Dole served as the director of the White House Office of Public Liaison from 1981 to 1983 and as the first female secretary of transportation from 1983 to 1987. She implemented a requirement that new automobiles include a third brake light and successfully raised the drinking age from 18 to 21 by withholding 10 percent of federal highway funds from states that failed to comply. From 1989 to 1990 Dole served as secretary of labor under Pres. George Bush. In 1991 she became the president of the American Red Cross, a position she held until 1999 when she resigned to pursue the Republican presidential nomination.

 

Known for her down-to-earth style of political communication, Dole was catapulted into national consciousness at the 1996 Republican National Convention when she gave a speech on behalf of her husband’s presidential bid. Her ability to connect with her audience—both television and live—established her national reputation and opened the door for her own presidential run in 2000.

 

Dole’s attempt to secure the 2000 Republican Party presidential nomination uncovered some of the barriers for women seeking election to the highest political office in the United States. She garnered less media coverage than expected for the second most popular Republican candidate and was less likely than other candidates to be mentioned first in news stories or be included in front-page articles. The press also discussed her personality and physical features in disparaging, gendered ways and repeatedly talked about Dole as the “first woman” to be a serious presidential candidate, suggesting that she was a novelty in the race. Failing to close the gap between her and Texas Gov. George W. Bush and lacking in campaign funds, Dole quit the race in October 1999.

 

In 2002 Dole went on to win a seat in the U.S. Senate from North Carolina. She served as the chair of the National Republican Senatorial Committee from 2005 to 2007 and left the Senate in 2009 after an unsuccessful bid for reelection. In 2012 she established the Elizabeth Dole Foundation to support the caregivers of injured soldiers.

Why Was the FBI Investigating General Flynn?

There appears to have been no basis for a criminal or intelligence probe.

National Security Adviser Michael Flynn was dismissed amid a torrent of mainstream-media reporting and disgraceful government leaks (but I repeat myself).Among the most intriguing was a New York Times report the morning after Flynn’s resignation, explaining that the former three-star Army general and head of the Defense Intelligence Agency was “grilled” by FBI agents “about a phone call he had had with Russia’s ambassador.”

 

No fewer than seven veteran Times reporters contributed to the story, the Gray Lady having dedicated more resources to undermining the Trump administration than the Republican Congress has to advancing Trump’s agenda. Remarkably, none of the able journalists appears to have asked a screamingly obvious question — a question that would have been driving press coverage had an Obama administration operative been in the Bureau’s hot seat.

 

On what basis was the FBI investigating General Flynn?

 

To predicate an investigation under FBI guidelines, there must be good-faith suspicion that (a) a federal crime has been or is being committed, (b) there is a threat to American national security, or (c) there is an opportunity to collect foreign intelligence relevant to a priority established by the executive branch. These categories frequently overlap — e.g., a terrorist will typically commit several crimes in a plot that threatens national security, and when captured he will be a source of foreign intelligence.

 

Categories (a) and (b) are self-explanatory. It is category (c), intelligence collection, that is most pertinent to our consideration of Flynn.

 

At first blush, this category seems limitless: unmooring government investigators from the constraints that normally confine their intrusions on our liberty (e.g., snooping, search warrants, interrogations) to situations in which there is real reason to suspect unlawful or dangerous activity. Intelligence collection, after all, is just the gathering of information that can be refined into a reliable basis for decisions by policymakers.

 

As we shall see, it is not limitless. But we should understand why it needs to be broad.

 

Most people think of the FBI as a federal police department that does gumshoe detective work, albeit at a high level and with peerless forensic capabilities. That, indeed, is how I thought of the FBI for my first eight years as a federal prosecutor, before I began investigating terrorism cases and became acquainted with the FBI’s night job. Turns out the FBI’s house has a whole other wing, separate and apart from its criminal-investigation division. Back in pre-9/11 days, this side of the house was called the foreign counter-intelligence division. Now, it is the national-security branch. Whatever the name, it is our domestic security service, protecting the nation against hostile foreign activity — espionage, other hostile intelligence ops, terrorism, acquisition of technology and components of weapons of mass destruction, and so on.

 

Most of the national-security branch’s work is done in secret, never intended to see the light of day in courtroom prosecutions. In some countries, including Britain, domestic security is handled by an agency (MI5) independent of domestic law enforcement (MI6). In our country, it is handled by a single agency, the FBI, based on the assumption (a sound one in my opinion) that the two missions are interrelated and that one can leverage the other more easily under one roof.

 

The FBI also has the foreign-intelligence gig because the Bureau is fully constrained by the Constitution and other federal law. Our other intelligence agencies — the best example is the CIA — are prohibited from “spying” inside the United States, largely because their foreign operations are outside the jurisdiction and fetters of American law. We understand that our security requires that our domestic security service have wide intelligence-gathering latitude; but we do not permit it to be limitless — it must respect our constitutional rights.

 

So how do we make sure the FBI does that if we’re giving it license to investigate people even when it does not suspect a crime or a threat? We do it by dividing the subjects of its intelligence investigations into three classifications and giving the FBI commonsense authority to deal with each.

1. Aliens acting as overt foreign agents

 

The first classification, and the easiest to grasp, consists of aliens who overtly work as foreign agents. Such a person — for example, Sergey Kislyak, the Russian ambassador with whom General Flynn communicated — is a non-American (i.e., one who does not have the full-blown constitutional rights of an American citizen) and is openly acting on behalf of a foreign regime — in the case of Russia, a regime notoriously hostile to U.S. interests. Clearly, there is no problem with his being targeted by the FBI for intelligence-gathering purposes.

 

Note that, because the FBI is constrained by federal law, even overt foreign operatives have significant protections. It is still necessary, for example, for the FBI to get a judicial warrant to search a foreign agent’s home or intercept his phone and e-mail communications — and more on those warrants momentarily. Within the wide parameters of federal law, though, the FBI is free to monitor an overt foreign operative’s activities very aggressively, even when there is no suspicion of criminal wrongdoing or national-security threats. The presumption that our government is entitled to observe what foreign governments are up to on our soil is sufficient — and, of course, American officials operating overseas are routinely monitored by host governments (most of which are not so fastidious about civil liberties).

 

2. Americans acting as foreign agents — overt and covert

 

The second classification is more complicated: American citizens who act as agents of foreign powers. Contrary to the legal illiteracy dismayingly peddled by Fox News from time to time, one can be an American citizen and nonetheless be an agent of a foreign power, and therefore subject to investigation under the FBI’s foreign-intelligence-gathering authority, even if there is no suspicion of criminal wrongdoing.

The easy example in this second classification is an American who openly and formally declares himself to be a foreign agent. Many Americans do work for and advocate on behalf of foreign regimes. Our law mandates that they register with the Justice Department. They must make periodic disclosures detailing their relationship with the relevant foreign country, their activities on its behalf, the financial arrangements, and so on. The FBI is free to investigate such American foreign agents just as it investigates alien foreign agents; in fact, the point of the disclosure requirements is to make the foreign-intelligence something our government can passively collect rather than expend investigative resources to gather.

 

The more complex example is Americans who act as covert foreign agents. The detection of these Americans is obviously tougher but of greater urgency. After all, if their activities on behalf of foreign powers were benign, they would not be acting covertly — and here it is worth pointing out that, under federal law, “foreign powers” are not just other countries; they include international terrorist organizations. Some of the terrorists I prosecuted in the 1990s, for example, were American citizens (some born as such, some naturalized) who were operatives of foreign jihadist cells.

Whether they are Americans or aliens, covert foreign agents merit heightened scrutiny, such as eavesdropping on phone calls and e-mails, or “sneak and peek” searches (when agents covertly look around a home or office, maybe take pictures and plant bugs, but don’t leave evidence that they’ve been there). To get that kind of authority, as presaged above, the FBI and Justice Department must seek warrants from the secret court established by the Foreign Intelligence Surveillance Act of 1978 (the FISA Court).

 

This requires a showing of probable cause. Significantly, this does not mean probable cause that a crime has been or is being committed — the traditional law-enforcement standard. Under FISA, the government must show probable cause that the target of its surveillance is acting as an agent of a foreign power. Libertarians complain that this is a lower standard, a sinister pretext to make it easier to hassle Americans in the absence of evidence that they’ve broken the law. But it is not a lower standard; it is the same standard (probable cause) for making a different showing (that one is a foreign agent). If you are a covert foreign agent, it should be easier for the FBI to investigate you, especially when it is doing so under judicial oversight.

 

3. Americans who are not foreign agents but may possess foreign intelligence

 

Covering overt and covert foreign agents does not complete the FBI’s intelligence mosaic. There are many Americans who do not act on behalf of foreign regimes but who are possessed of information that would be of great value to the FBI in understanding what foreign powers are up to — owing, for example, to their travels, business dealings, or academic concentrations. Plainly, we want the FBI to be able to seek this information. Yet we don’t want these Americans to be investigated — they should be thanked, not hassled. So how should our fellow citizens in this wholly innocent classification be handled? The FBI’s guidelines for domestic operations strike the right balance: “The FBI should . . . operate openly and consensually with U.S. persons to the extent practicable when collecting foreign intelligence that does not concern criminal activities or threats to the national security.”

 

Openly and consensually. That means FBI agents should tell Americans in this “non-foreign agent” classification that they are not under investigation or suspicion, and that their voluntary cooperation is requested to help the FBI protect the country against potentially harmful foreign activities. They should not be “grilled” as if they were suspects.

 

General Flynn’s situation

 

That brings us back, finally, to General Flynn. Anonymous intelligence officials (a category that may include the FBI — though we do not know who the leakers are) outrageously revealed to the New York Times that Flynn was subjected to FBI interrogation (“grilled,” the Times says) and that the Justice Department suspects that Flynn did not provide truthful, accurate information. That does not sound like a cordial, “open and consensual” conversation. It sounds like an investigation.

 

Why would Flynn be the subject of an investigation by the FBI and the Justice Department?

 

We are told that the FBI was monitoring the phone calls of Russian ambassador Kislyak under FISA. Makes sense — he’s an overt foreign agent from a hostile government. Flynn called Kislyak on December 29, 2016. It was not a nefarious communication: Flynn was a top adviser of then-president-elect Trump, a part of the Trump transition team, and just three weeks from formally becoming the new president’s national-security adviser. His communications with Kislyak were just some of the many conversations Flynn was having with foreign officials.

 

FBI agents did not need to ‘grill’ Flynn in order to learn about the call — they had a recording of the call.

 

The call to Kislyak, of course, was intercepted. No doubt the calls of other American officials who have perfectly valid reasons to call Russian diplomats have been intercepted. It is the FBI’s scrupulous practice to keep the identities of such interceptees confidential. So why single Flynn out for identification, and for investigation? FBI agents did not need to “grill” Flynn in order to learn about the call — they had a recording of the call.

 

They also knew there was nothing untoward about the call. We know that from the Times report — a report that suggests an unseemly conjoining of investigative power to partisan politics.

Maritime Standoff Between China And Malaysia Winding Down

 

A standoff between China and Malaysia over potential natural gas and oil reserves beneath the South China Sea appears to be ending as research vessels from both nations moved away from each other following stepped-up U.S. Navy presence in the last several weeks.

 

On Tuesday, West Capella, a Panamanian-flagged drillship hired by Malaysia’s state-owned Petronas, completed its scheduled work in a part of the South China Sea also claimed by Vietnam and China, according to a report by Reuters.

 

For several weeks this spring, West Capella was tailed by China’s government-owned research vessel Haiyang Dizhi 8 and armed Chinese coast guard and China Maritime Militia vessels, Reuters reported.

 

To counter the implied threat posed by China’s armed ships, USS Gabrielle Giffords (LCS-10), USS Montgomery (LCS-8) and USNS Cesar Chavez (T-AKE-14) conducted presence operations near West Capella. In late April, USS America (LHA-6), USS Bunker Hill (CG-52) and USS Barry (DDG-52) sailed with the Royal Australian Navy frigate HMAS Parramatta (FFH-154) in the same part of the South China Sea.

 

“There is no better signal of our support for a free and open Indo-Pacific than positive and persistent U.S. naval engagement in this region,” Rear Adm. Fred Kacher, the commander of Expeditionary Strike Group 7, said in a Navy news release.

 

As of Wednesday, the Chinese ships appeared heading in a different direction from West Capella and a nearby Malaysian naval auxiliary ship, KA Bunga Mas 5, according to publicly available ship tracking data.

 

Last year, Haiyang Dizhi 8 was involved in a similar standoff with the Vietnamese drilling ship Hakuryu 5, in Vietnam’s exclusive economic zone near the Fiery Reef, according to a December report by the Asia Maritime Transparency Initiative at the Center for Strategic and International Studies.

 

The standoff started in June and lasted for months, according to CSIS. During this time, Haiyang Dizhi 8 was escorted by Chinese Coast Guard ships and other Maritime Militia ships. The CSIS report concludes Haiyang Dizhi 8’s survey area “closely matched a group of oil and gas exploration blocks that the China National Offshore Oil Corporation unsuccessfully offered up for foreign bidding in 2012.”

The report informs us that as the FBI set its sights on Flynn, its agents were consulting with “Obama advisers.” Interesting, no? Ever since Hillary Clinton’s loss to Donald Trump on November 8, Obama’s Democratic party had been pushing a narrative that “Putin hacked the election.” The narrative continues to have two major flaws. First, while the Russian dictator may have preferred Trump to Clinton, there is no evidence that his Russian regime did anything to compromise the voting process. The media-Democrat complex has desperately sought to obscure this problem by emphasizing Putin’s likely role in publicizing embarrassing Democratic e-mail communications. Notwithstanding Democratic talking points, that is a far cry from “hacking” the voting process.

 

The second flaw is that, although Trump has made disturbingly flattering remarks about Putin, there is no evidence his campaign has given or promised Russia any actual accommodation in exchange for Putin’s favor. Democrats hope to erase this problem by finding something, anything, that could be spun as a quid pro quo. Obviously, they hoped the Flynn–Kislyak conversation would answer their prayers. No such luck. As the Times puts it:

 

Obama officials asked the FBI if a quid pro quo had been discussed on the call, and the answer came back no, according to one of the officials, who like others asked not to be named discussing delicate communications. The topic of sanctions came up, they were told, but there was no deal.

 

Asked not to be named discussing delicate communications. That’s a good one. Let me translate: The officials don’t want you to know who they are because they are corrupt — (a) FISA intercepts are classified, so disclosing them to the press is a crime; (b) by revealing the Flynn–Kislyak conversation to the press, the “officials” inform the Russians that whatever countermeasures they are taking against U.S. surveillance have failed, assuring that the Russians will alter their tactics, making the job of our honorable intelligence agents more difficult; and (c) the FBI’s investigative powers are not supposed to be put in in the service of a political party’s effort to advance a partisan storyline, like “Putin hacked the election.”

 

So since there was no impropriety in Flynn’s call to the Russian ambassador, why did the Bureau continue investigating Flynn? Why did FBI agents interrogate him?

 

Misleading statements by presidential administrations are not grounds for FBI investigations. They are left to the political process to sort out, and we don’t want the FBI turned into a political weapon.

 

According to press reports of other rogue intelligence leaks, the FBI was sicced on Flynn after Trump officials gave inaccurate public statements about his conversation with Kislyak, to wit: They said that it had not touched on the punitive actions President Obama took against Russia on the same day the conversation took place, when in fact there had been some discussion of that topic — which the FBI and Justice Department knew from the recording. Specifically, Flynn denied any discussion of these sanctions, unnamed Trump officials denied it to the Washington Post, Vice President Pence denied it in a CBS interview shortly before the inauguration, and finally White House spokesman Sean Spicer denied it again on January 23. According to the Times, it was the Spicer denial that triggered the FBI’s interrogation. It was as if the Bureau and Justice Department intentionally waited to pounce until Trump was in power — which meant that any misstatement could now be framed as a false representation by the sitting president.

 

But just ask anyone who knows that you can’t keep your health-care plan and your doctor if you like them, that the Benghazi massacre was not caused by a video, that the IRS really did harass Americans over their political beliefs, and that Iran will be allowed to develop nuclear weapons. Anyone who knows those things — that would be all of us — also must know that misleading statements by presidential administrations, even egregious ones, are not grounds for FBI investigations. They are left to the political process to sort out, and we don’t want the FBI turned into a political weapon.

 

So how come the FBI got involved here?

 

Is the FBI saying that Mike Flynn is an agent of a foreign power? A covert Russian operative? That would be absurd. As I’ve detailed, Flynn is on record — unambiguously, in the core theme in his bestselling book — urging Americans to view Russia as an implacable enemy of the United States that must be checked. Now, are you unhappy — as I am unhappy — with the Trump administration’s blandishments toward the murderous, anti-American Putin regime? Again, political disagreement is not a rationalization for drawing a ridiculous legal conclusion (“maybe he’s a ‘foreign agent’”) as a pretext for an investigation by the FBI.

 

Fear of blackmail? That is a theory purportedly advanced by former acting attorney general Sally Yates, an Obama political hack who was eventually fired for insubordination by Trump (who had foolishly retained her). The blackmail theory is almost too stupid to regurgitate. If you can follow this, the idea is that the Russians knew that Flynn withheld information about his Kislyak call from the Trump administration and was therefore vulnerable to extortion — i.e., the Russians could expose his concealment if he didn’t do their bidding. It should go without saying that blackmail works only if the compromising information is not in the possession of the aggrieved party. Here, the United States — i.e., the Trump administration itself — had a recording of the Flynn–Kislyak call, a fact that both Russia and Flynn (who is deeply versed in intelligence craft) had to know was highly likely.

 

Finally, there’s Flynn’s supposed potential criminal violation of the 1799 Logan Act. Recall what we said at the start: The FBI’s criminal investigation and domestic security functions overlap. If there is not a valid foreign-intelligence basis to investigate someone, a potential law violation could do the trick. But . . . the Logan Act? Are you kidding?

 

The statute is a discredited relic of the President John Adams administration’s over-criminalization of political speech on the grounds of its purported seditiousness. It is a highly dubious prohibition against foreign-policy freelancing by American citizens acting without executive-branch permission. As Jeremy Duda comprehensively explains in the Washington Post, in its 218-year history, there has been just a single Logan Act prosecution, ever — an unsuccessful, aborted charge brought in 1803 by an Adams-appointed U.S. attorney.

 

It is not enough to say it is ludicrous to contemplate a Logan Act prosecution against a transition official who was the incoming national-security adviser over a phone call with a foreign ambassador. Beyond that, we must refer to the high-profile July 2016 press conference held by FBI director James Comey.

 

In contrast to General Flynn, as to whom there is no evidence of criminal wrongdoing, there was a Mount Olympus of damning proof that Hillary Clinton committed felony violations of a law against mishandling classified information. Yet Director Comey concluded that “no reasonable prosecutor” would consider indicting Mrs. Clinton. Why? Because behavior of the type in which she engaged is never prosecuted. Now it happens that Comey was wrong about Clinton — to make his assertion, he had to paint a narrowly skewed picture of her misconduct and ignore several prosecutions of military officials for far less serious violations. Nevertheless, he does run the Bureau, and so we must assume that his explicit guidance governs its investigative standards: “Responsible decisions . . . consider the context of a person’s actions, and how similar situations have been handled in the past.”

 

If that is the standard, there was no conceivable chance that Flynn could ever be prosecuted for a Logan Act violation. Using the Logan Act as a pretext for interrogation would have been improper.

 

And Flynn is not a foreign agent.

 

And there was no need to “grill” him over the contents of a conversation of which the FBI and Justice Department already had a recording.

 

COMMENTS

And the FBI has no business probing the veracity of public statements made by presidential administrations for political purposes — something it certainly resisted doing during the Obama administration.

 

There appears to have been no foreign-intelligence or criminal-investigative purpose served by the FBI’s interrogation of General Flynn. It is easy to see why Democrats would want to portray Flynn’s contact with the Russian ambassador as worthy of an FBI investigation. But why did the FBI and the Justice Department investigate Flynn — and why did “officials” make sure the press found out about it?

Wish it were so anon. This sets precedent only in WI. The issue would have to reach a FEDERAL district court and that court would have to rule it unconstitutional per the U.S. Constitution for it to set precedent for other states.

 

Even then, a different Federal district court could rule completely different than the first court but it would have to "distinguish" its case from the case decided by the first district court, i.e., explain in its decision how the facts and the underlying law of its case were different enough to allow it to depart from the first case precedent.

 

To really become law of the land, the U.S. Supreme Court would have to decide to hear a similar case on appeal from a lower federal court. The SC judges would then spar over the case with the majority justices writing the decision in the matter with other justices writing separate concurring or dissenting opinions. Depending on the political winds (never mentioned) the majority could write a sweeping broad decision or a very narrow one. Anyway, lawyers.

The United States is starting to turn on its top coronavirus expert, Dr Anthony Fauci, with prominent voices in the country’s media suggesting he has too much influence.

 

Dr Fauci, an expert in infectious diseases who’s led the National Institute of Allergy and Infectious Diseases since the 1980s, has been President Donald Trump’s most visible scientific adviser throughout the crisis.

 

He serves on the White House’s coronavirus task force, and often appears at the President’s televised media briefings.

 

In recent weeks, as Mr Trump has urged states to reopen their economies, Dr Fauci has been more circumspect, stressing the risks that come with lifting restrictions prematurely.

 

That apparent division between the President and his adviser was on display yesterday when Dr Fauci fronted a Senate hearing. He said America should be “focused on the proven public health practices of containment and mitigation”.

 

The US has recorded 1.4 million confirmed cases of the virus, and its death toll stands at 85,000. Reopening too quickly, Dr Fauci said, could cause another spike in deaths.

 

“There is a real risk that you will trigger an outbreak that you may not be able to control, and in fact paradoxically, will set you back – not only leading to some suffering and death that could be avoided, but could even set you back on the road to try to get economic recovery,” he told the senators.

 

His comments were met with scepticism by some of the senators from Mr Trump’s Republican Party.

 

“As much as I respect you, Dr Fauci, I don’t think you are the end-all. I don’t think you’re the one person who gets to make a decision,” said Senator Rand Paul, from Kentucky. Senator Paul is also a physician.

 

“We can listen to your advice, but there are people on the other side saying there is not going to be a surge, and that we can safely reopen the economy. And the facts will bear this out.

 

“I hope that people who are predicting doom and gloom, and saying, ‘Oh we can’t do this, there’s going to be a surge,’ will admit they were wrong if there is not a surge. Because I think that is what’s going to happen.”

I live in NC and am (sort of) involved with the local GOP. They endorsed Burr for this last run purely on the promise that he would retire after this. That was a bad decision on our part and won't (if I can make MY voice heard) be repeated.

The only problem this presents for us is that it is too late (probably) for a special election and we have a shit breath Democrat for governor who can't be trusted to make a decent nomination for interim Senator.
