Either Durham is completely incompetent and just running out the clock, or Durham is completely competent and running out the clock.

I still think the play on this is to show that the current justice system is far too corrupt and compromised to handle a crisis like this. The military is the only way, remember? So, whether these dead-end investigations by Huber and possibly Durham are deliberate or not doesn't really matter, it still serves the purpose of handing it to the military.
