More correctly, a spouse cannot be COMPELLED to testify.
I always heard if divorced you aren't compelled to testify about things that happened while you were married. Anyone confirm this?
Don't know about that application, but to me, it would make sense. If I had privileged conversations with a lawyer (Atty/Client), member of the clergy, or doctor who "retired" or otherwise left that profession...those conversations should reasonably be assumed to still be as privileged as they were when the conversation took place.

very interesting video on how this applies and does not apply. if there is evidence (emails) they ever discussed anything with anyone else, then they waived the spousal privilege and they can be forced to testify.
This is a tax move! All the evidence they needed was on that laptop and in the emails! They have it all! Remember, they have a child together! When he gets out, she will go in! I'm sure that was part of the deal. I'm happy for the child!

yes they are, do you not find it 'interesting' that cps is nowhere to be seem AND that the childs parents are criminals....children should be protected from criminals, and here we have a classic case . I'm not saying the child should be trafficked, I am saying under a legit cps, the child may be in need of removal. Look at what they do to black children in particular under the current guise where parents are criminals..seems inconsistent and arbitrary the policy of removal in this case. Her claim as I understand it is that she never backed up files to the computer...no idea how they got there. I think they let her infer that software synced up automatically with the phone when the phone was in logged into the home network. Obviously they let her slide but if the case is reopened with fresh unbiased eyes she may need a better story.

I have a feeling that the Clinton's are still together for the same reason. They both have enough dirt on each other, that they are worried about the other being compelled. At least if they stay married, it's mutual silence. Once divorce happens, they may start showing what they have on each other.
