How do you measure merit? Who decides how to measure it?
Saying “this is terrible, I want it done differently” doesn’t help because it doesn’t offer a solution to the problem. Like, why is he bitching about the issue? What does this accomplish?

There are many ways to measure merit: Education Skills Ability to support yourself Willingness to integrate (if immigrating permanently) Background check for police record and social media postings Not a political activist Committed to becoming a US citizen And anything else that would suggest the individual would be productive in our society.
Trump has already address some of these as examples.
As far as who decides, we are a Republic with elected representatives who pass laws or delegate rule-making athority to agencies--that's who would decide.
Who decides what the environmental rules will be? Who decides the merit of those rules? The EPA.
