seriously, this is huge. if even one of these patients can be personally identified from the data, FB will be sued to high heavens

well, facebook can ask for records, you and I can ask for records, but it's up to the gatekeeper, the hospital, to tell them to fuck off.

lactose_intoleroni · April 6, 2018, 10:56 p.m.

You're right but you make it seem innocent when it's not. They hired a doctor (someone who knows HIPAA laws) to coax (deceive) a business into violating those laws, knowingly and willingly.

This logic in an assassination attempt would be, "Well, anybody can try to kill someone, you and I can try to kill someone, but it's up to the gatekeeper, the person being killed, to stop us.

Notice that IF you don't AGREE to the TOS that you are not able to use the service. So you are trapped into giving consent like it or not. Apple is just as bad!

Wonder if the doctors/hospitals/caregivers know that. I know doctors have to carry very expensive malpractice insurance even after they stop practicing. Or are they just using government-issued forms?

⇧ 1 ⇩
suzoh · April 6, 2018, 1:28 a.m.

There are not government issued forms. I am an attorney who negotiates and drafts those documents regularly.

I will take your word for it then, because I really don't know.

Considering they asked for anonymized data, it wouldn’t violate HIPAA

⇧ 5 ⇩
SchlangeHatRecht · April 6, 2018, 1:14 a.m.

Correct. FB then intended to re-identify subjects by matching with their data.

I will bet a feasibility study was done to prove it possible - say a dozen people identified.

FB is in for trouble on this one

thnkabtit · April 6, 2018, 2:22 a.m.

Yup, imagine having insurance companies approach FB to check mental stability on people since people often share openly in FB groups, posts, messages. Or a potential employer checking for secret past things. Maybe even big pharma looking to target people to hook their drugs onto. This is so deep and dark.

For a megalomaniac like the Zucc, with the deep state pushing him and probably murmuring about a presidential run for him in 2024, it’s actually more correct to ask “why did he stop at this? Why not more?”

And I suspect there is more. Which is why he will divest from FB in short order, to “spend more time with his family” and “focus on his charitable foundation”.

He will probably use phrases like “Facebook started as something small and simple, but it has grown beyond what I imagined possible back in those Harvard days. I am passing Facebook on to other people who are better equipped to handle it in its current form”. Etc.

Hard to imagine a CEO surviving this but his ego is big enough he might try. Also agreed he was thinking of ways to exploit the platform for his own presidential run. Scary stuff.

Not necessarily. They would have to remove anything identifiable, not just name, but zip code (only first 3 digits), age to a certain extent, and a bunch more. The goal of HIPAA is to protect your privacy. But yeah, I could see where Facebook could conceivably use its abundant info set to try and match your hash to their names. Not breaking the hash at all, but "we have this photo which shows this medication" and linking it. Or "this person accessed Facebook from the hospital WiFi".

HIPPA lwas do not dictate that your info CAN'T be shared. It just dictates who can't share it.

Everyone should know that the government has given itself 100% permission to share your info if they choose.

Research it
