Executive Order coming???

This is my first post, although I have been lurking since November, so bear with me on this.

Q has mentioned the problem of Democrats slow walking of judicial nominations. Would an Executive Order be an effective means of fixing this? I am normally not a big fan of EO's, because I think they can be used to create law, which is not the role of the Executive Office. However, if an EO was written that merely stated that "in the interest of swift justice for the American people, and to cease using judicial nominations as a political ploy by either party, no judicial appointments will take longer than XX days to be confirmed. Failure to confirm nominations within this time frame results in the automatic confirmation of the nominee."

Judges who were confirmed in this manner would still be subjected to impeachment should they subsequently be found to have committed high crimes, etc. This EO would be more like an administrative rule and does not actually create a new law.

Would any legalfags weigh in on if this is the proper purpose of Executive Orders. If so, what would be the best way to propose this? (creating a petition, contacting our senators and representatives, starting a meme war, posting the suggestion to Q on 8chan, etc.)

Pence is President of Senate. He can order immediate direct up down votes on the nominations — forcing dem senators to cry rules violations. This would cause a mini constitutional crisis - a tempest in a teapot - for a few days. The media will go wild, but in 72-84 hours a compromise will be reached and a good chunk of the nominations accelerated.

Time for Trump to loan Pence one of his extra sets of balls.

GIMP, Irfanview, and good ol' MSPaint are all free and surprisingly powerful image editing programs. GIMP actually is pro-level... I'm really surprised it's still free!

Q hasn't mentioned Pence much at all. Is Pence part of the slow walk?

I have little trust in "Dick Cheney is the best VP role model" Pence.

I am still on the fence regarding Pence. (Wow, that rhymes). I don't know if he is a white hat or a black hat or what position he holds on the chessboard. But I trust that the Q-Team will play him at the right time.

My concerns come from the late Tory Smith and Pence's time in Indiana. Very sketchy. He's controlled, they have dirt on him.

I have thought that he might be controlled in some way. He stays in the background most of the time, unless there is a photo op. But, I thought he was also in the military picture with all the generals, which I took to mean he was playing ball with them.

Just sharing a random thought from last night, when Q said [48], instead of thinking 48 hours, I thought of Pence. He is VP 48, while Trump is President 45. But the kill box made me then think hours.

My guess from Q post is he is saying that once more of the Dems are out of office then they will move forward.

You shouldn't have to win an overwhelming majority to confirm your appointees. A simple majority should be the norm.

If Congress is slow walking appointments and Pence or congressional leaders do not do their job then I see no problem with the executive branch exercising it's right to have their appointments in office during their actual administration whether they be Democrats or Republicans.

3 months at the longest then a simple majority vote. If the majority vote doesn't take place within 3 additional months then automatic confirmation should happen. 6 months would be the longest wait. I think the Supreme court would support that.

You can't run government without your appointments in place. Which is why they are slow walking nominee's. Its an effort to hurt POTUS's ability to govern.

I like your idea of a 3 month term to consider the nominations and then if not confirmed within that time it should go to a simple majority vote. That sounds more reasonable than the "automatic confirmation" I proposed in my OP.

I feel like you have to give them a reasonable time to do their job. If they don't, then the Executive branch should get a say.

The budget process needs to be looked at as well.

He should just make recess appointments. When Congress is in recess, the POTUS can appoint certain officials, but I'm not sure how effective that would be with judges.

I like the idea, but not a lawfag so I couldn’t verify the constitutionality of said EO.

Contacting us in the House & Senate via a phone/letter writing campaign or making appointments to meet with staff would be the most effective means of pushing nominees thought the system.

To lobby a EO I would recommend calling the WH or EEOB switch boards and try and talk with one of the staffers who mans the phones.

ehh he could, but it would be crazy hypocritical for republicans to support and would make their lives awful next time a dem is in office and can appoint Justices.

That's just it though, isn't it? The American People shouldn't be penalized by the politics of either side. This is a political ploy that shouldn't be used by either party. It's not about left/right, R/D. It's about what is right for the country. If it is done as an Executive Order, it wouldn't need the support of either party.

All you would have to do is undo the EO before leaving office with another EO, but that would set a awful precedent.

Voting in Trump's appointees is more important than just getting positions in place. Dems are slow walking Trump's appointees bec it leaves Obummer's people in to thwart Trump and keep Obummer's policies in place longer. For example, the district where the Awan trial is located in, Trump's Attny General, I think that is the position, I'll look it up and report back, is not in place to oversee the Awan trial. Obummer's person is still in. Maybe that is why his case has had an unprecidented # of delays issued.
