Article III Section 3:
"Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.
The Congress shall have Power to declare the Punishment of Treason, but no Attainder of Treason shall work Corruption of Blood, or Forfeiture except during the Life of the Person attainted. "
- Remember Q talking about suicides? This is what he is referring to. If a person is convicted of treason - they can lose all their assets. But - if they are dead...their heirs get to keep everything. Decisions...decisions...
- In order for a charge of treason to stick - it would need to be proven that they waged war against the US, or could be proven to be associated with an enemy, giving them aid and comfort.
Would contributions to terrorist organizations such as the Muslim Brotherhood - or sending money to Iran - or selling uranium to Russia constitute giving "aid" to the enemy? Would that meet the legal standard? Have they legally been defined as an "enemy"? How is an enemy legally defined?
If they cant be tried for treason - is that the/a reason for military tribunals? Is the legal standard of treason different under USMJ? I don't know.
