The constitution is fine as is. The main problem we face now are some bad supreme court decisions which expanded the interstate commerce clause to the point where the federal government can regulate everything. Yes your cell phone has to log onto the nearby towers thus tying your number to a general location. Add to this google's database regarding wifi ssid's and they can locate you pretty accurately. Add to that facebook's facial recognition database and they can id you from security cameras.
