Trader gets painted stones instead of $36m of copper

A commodities trader was given painted stones instead of $36m (£26m) of copper from a Turkish supplier in a fraudulent deal last summer.

Geneva-based Mercuria Energy Group says it's been the victim of cargo fraud following its purchase of 10,000 tons of copper blister. When the cargoes started arriving in China, it found containers full of painted stones instead. The bizarre case happened despite security and inspection controls.

Last year, Mercuria agreed to buy the copper blister, an impure form of the metal, for delivery to China. About 6,000 tonnes was loaded for shipment in more than 300 containers on eight vessels. But before its journey from a port near Istanbul, the copper was switched with paving stones, spray-painted to resemble the semi-refined metal. Mercuria, one of the five-biggest oil traders in the world, is seeking redress in Turkish and UK courts against the copper supplier Bietsan Bakir.

Turkish police have taken a number people into custody in relation to the faux-copper scheme. "Suspects have been taken under custody who are thought to be involved in the various parts of this organised crime against Mercuria," the company said in a statement while thanking the Istanbul Financial Crimes Department. It appears the copper was initially loaded into the first shipment of containers, before being surveyed by an inspection company. Seals used to prevent fraud were fixed to the containers.

But the containers were opened and the copper replaced with paving stones, Istanbul law firm KYB told media. The fraudsters switched between fake and real container seals to avoid detection.

With the vessels at sea, Mercuria paid $36m over five installments. The fraud wasn't discovered until the ships began arriving in the Chinese port of Lianyungang later that month.

"There has been a criminal investigation petition by the buyer against the seller and two intermediaries," Turkish police said in a statement. "It's been determined that the incident is the outcome of fraud perpetrated in an organised manner." In cases of non-delivery a trader could make a claim against a cargo's insurance policy. But Mercuria found that just one out of seven contracts used by the Turkish company to insure the cargo was real. The rest had been forged.

Bietsan Bakir, the Turkish firm which sold Mercuria the copper, did not respond to requests for comment when contacted by Reuters. More hearings on the case are expected this week.

Covid-19: Several European countries suspend AstraZeneca vaccinations over blood clot fears

Seven European countries – Denmark, Norway, Austria, Estonia, Latvia, Lithuania and Luxembourg – have suspended all or part of their AstraZeneca vaccine roll-out as a precaution while they investigate concerns relating to blood clots.

Danish health authorities on Thursday suspended all AstraZeneca vaccinations for two weeks after a 60-year old woman who had been vaccinated formed a blood clot and died.

The move "follows reports of serious cases of blood clots among people vaccinated with AstraZeneca's Covid-19 vaccine", the Danish Health Authority said in a statement.

But it cautiously added that "it has not been determined, at the time being, that there is a link between the vaccine and the blood clots".

Norway soon followed suit, supending all AstraZeneca vaccinations.

Austria earlier announced it had suspended the use of a batch of AstraZeneca vaccines after a 49-year-old nurse died of "severe blood coagulation problems" days after receiving an anti-Covid shot.

Four other European countries – Estonia, Latvia, Lithuania and Luxembourg – have also suspended the use of vaccines from this batch, which was sent to 17 European countries and consisted of one million jabs.

Spain said Thursday that it has not registered any cases of blood clots related to AstraZeneca's Covid-19 vaccine so far and will continue administering the shots.

Spanish Health Minister Carolina Darias said she had been informed of cases of blood clots among recently vaccinated people in Austria, but added that "so far, no causal relation between the vaccine and the blood clot events has been established", and the European Medicines Agency (EMA) was evaluating the situation.

Blackstone and investors get zapped with bet on Mexico's electricity market

U.S. private equity firm Blackstone in 2016 unplugged a Texas power plant that it owned from the state’s grid in a bet that it could make a fortune as the only American-based generator selling electricity exclusively to Mexico. That bet has gone south. Nearly five years later, Blackstone’s gas-fired plant, Frontera Holdings LLC, is struggling to exit bankruptcy after burning investors holding nearly $1 billion of its debt - the victim of a succession of problems ranging from a power market collapse in Mexico in 2020 to last month’s severe cold snap.

Frontera filed for bankruptcy protection last month in Houston, extinguishing loans and notes held by U.S. hedge funds, mutual funds, pensions and private equity firms, according to U.S. regulatory filings.

While the company has since secured $145 million in financing for a fresh start, its future is uncertain: Mexico has announced market reforms that could undo Frontera’s business model, and the facility is at risk of big fines for failing to deliver power during the regional deep freeze.

Early last month, Mexican President Andres Manuel Lopez Obrador said he would crack down on his country’s wholesale electricity market, saying power producers are among those that have made excessive profits.

He is also now armed with a new law that would open the door to renegotiating and potentially terminating contracts with independent producers such as Frontera. About two weeks later, the deep freeze hit Texas and northern Mexico, knocking Frontera and other power generators offline. Lawyers for Frontera say the plant may face penalties for not being able to supply power for several days.

Blackstone Group LP declined to comment on the impact of the developments on Frontera’s plans to exit bankruptcy. Frontera attorney Matthew Fagen of Kirkland & Ellis told U.S. Bankruptcy Judge Marvin Isgur late last month, after the cold snap, that the company’s planned exit from bankruptcy in the spring remains on track. Frontera’s bet was going well before things fell apart.

The plant, for example, generated about $87 million in profit on nearly $200 million of revenue in 2019, according to disclosures in U.S. Bankruptcy Court in Houston. That year, Blackstone paid itself a dividend of about $116 million, following a similar payout of $120 million the previous year, from operating cash and incremental debt, court disclosures show.

Frontera owns 100% of its transmission line to Mexico and has exclusive use of it. New U.S.-based entrants likely would not have that advantage because of rule changes at the U.S. Department of Energy. But last year peak pricing for electricity in the Mexican market tumbled 70%, in part because of the coronavirus pandemic’s impact on the economy.

Frontera posted a $9 million operating loss on $79 million in revenue that year, court disclosures show.
