U.S. bankruptcy filings hit 35-year low thanks to government pandemic aid

U.S. bankruptcy filings for 2020 hit their lowest level since 1986 as a flood of government support programs offset at least temporarily the full brunt of the coronavirus pandemic and a related recession, Epiq AACER reported on Friday.

The firm’s compilation of bankruptcy cases showed the Chapter 11 filings used to reorganize larger businesses still jumped 29% in 2020 to 7,128, compared to 5,158 in 2019, a tally that included major retailers like J.C. Penney driven under by the biggest economic downturn in a century. But overall filings, including all personal and other business bankruptcies, for the year were 529,068, compared to nearly 800,000 annually in recent years, and triple that in 2010 at the end of the last recession.

The low level of bankruptcies has been one of the more perplexing dynamics of a pandemic era that has seen millions of jobs destroyed, record numbers of people collecting unemployment insurance, and small businesses forced to close to combat the spread of the coronavirus. Government unemployment insurance, business loans and other programs ended up replacing much of that lost income, pushing savings to record levels and keeping households and businesses afloat – at least for now.

A further $900 billion recently approved by Congress may continue to push a full reckoning down the road.

Scammers have taken $36 billion in fraudulent unemployment payments from American workers

The U.S. has pumped billions of dollars into the unemployment system since the spring — a magnet for criminals that’s led to surging theft and fraud attacks. This has contributed to at least $36 billion being taken from out-of-work Americans.

Now, the federal government and states are clamping down. The $900 billion Covid relief package signed last month adds steps for workers to prove their eligibility for benefits. But those rules may slow aid to those who need the money, according to labor officials and worker advocates. Most of the theft has focused on Pandemic Unemployment Assistance, a temporary program created by the federal CARES Act in March. It offers unemployment benefits to workers who don’t ordinarily qualify, like the self-employed, gig workers, freelancers, contractors and part-timers.

Con artists are attracted to a potentially hefty payday — perhaps more than $10,000 or $20,000 per fraudulent claim — and lax security measures initially put in place to rush money to ailing Americans. By early November, at least $36 billion of the $360 billion in CARES Act unemployment benefits was lost to improper payments, mostly from fraud, according to a conservative estimate from the Office of the Inspector General for the Department of Labor.

Investigations related to unemployment benefits account for 70% of the watchdog’s caseload — nearly six times the level before the coronavirus pandemic. Fraudulent claims for benefits can account for roughly 35% to 40% of new applications in some states with generous weekly payouts, Hall said. International organized crime rings from countries like China, Ghana, Nigeria and Russia account for most attacks, he said.

Their fraud can take many forms. The most common is identity theft, whereby criminals steal personal data to file a claim in someone else’s name, Hall said. In some similar scams, attackers convince victims to verify their identity to get a job or win a prize.

Judge nixes latest Trump bid to invalidate Georgia election

ATLANTA — A federal judge rejected President Donald Trump's latest bid to overturn his election loss in Georgia during a hearing Tuesday that the president's lawyer blocked members of the public from listening to remotely amid the coronavirus pandemic.

U.S. District Judge Mark H. Cohen ruled from the bench to deny a motion seeking to de-certify Georgia's election. But only those present in the courtroom were able to watch the hearing held via videoconference because Trump's lawyer did not consent to remote access for the public, the judge's staff said.

Officials across the country have routinely allowed members of the media and the public to watch or listen to legal proceedings remotely throughout the coronavirus pandemic to keep people from packing courthouses.

An email seeking comment was sent to Trump's attorney after the hearing.

The ruling in a last-ditch lawsuit filed by Trump last week is the latest in a string of legal defeats the president has suffered in his futile attempt to undo Democrat Joe Biden's victory.

It comes a day before Congress meets to count the Electoral College votes affirming Biden's win. In a phone call made public on Sunday, Trump pressured Georgia Secretary of State Brad Raffensperger to "find" enough votes to reverse the state's election outcome.

The lawsuit recycles baseless claims of "illegal voting" that have already been flatly rejected by courts across the country. Lawyers representing Georgia blasted the case, saying in court documents that "a barrage of allegations and suits does not undermine the facts and should not undermine our democracy."

Judges have denied or dismissed dozens of cases backed by Trump and his allies, who have pushed unsupported charges of widespread fraud in battleground states.

America's Most Admired Man is President Donald Trump, according to a Gallup poll.

For 12 years, former President Barack Obama won the title of America's Most Admired Man. According to a Gallup poll, Trump broke Obama's winning streak with 18% of the vote. Obama came in second with 15%, while Joe Biden came in third with 6%.

Pat considered it odd how the president could poll so high among Americans for most admired man after allegedly losing the popular vote in the 2020 election.

Peter Navarro releases second volume of election integrity report: The Art of the Steal

One day ahead of Congress's meeting to certify the 2020 Electoral College results, White House adviser Peter Navarro has released Volume II of his report on the November election.

Volume I of the report, called "The Immaculate Deception," was released last month. It detailed six key ways in which Navarro believes the Nov. 3 presidential election functioned irregularly. He called for "a thorough investigation prior to Inauguration Day."

In part II, which he is calling "The Art of the Steal," Navarro continues his examination of election irregularities in the six battleground states that decided the 2020 election.

The document will, according to Navarro, provide a "comprehensive, objective assessment of the fairness and integrity of the 2020 election."

Navarro's thesis centers on the possibility that there "may very well have been a coordinated strategy to effectively stack the election deck against the Trump-Pence ticket."

Russia deepens China ties with expanded energy exports

Eyeing an opportunity to strengthen energy exports to China, Russia has launched new ventures and pipelines that will deliver coal, natural gas and petrochemicals to the world's largest energy consumer.

One of these projects envisions doubling Russia's coal exports to China – enough to replace imports from Australia, with which China's relations have deteriorated. Chinese President Xi Jinping and Russian President Vladimir Putin agreed to pursue greater cooperation across a range of fields, including large-scale energy and industrial projects, in a phone call on Dec. 28.

Describing 2020 as an "extraordinary year," Xi said that "true gold can stand the test of fire, and the difficult period has given more prominence to the unique strength and great value of the China-Russia relationship," according to China's official Xinhua News Agency.

"By strengthening strategic cooperation, China and Russia can effectively resist any attempt to suppress and divide the two countries, and meanwhile forge a solid shield to safeguard international fairness and justice," he said, suggesting that the two countries form a united front against headwinds from the U.S. and Europe. Elgaugol, the company behind the Elga coal project in the Russian Far East, agreed on Dec. 15 to launch a joint venture with China's Fujian Guohang Ocean Shipping (Group) that will export metallurgical coal to China. The Elga project is expected to ship 30 million tons of coal to China in 2023, which would almost double Russia's total coal exports to China from about 33 million tons in 2019.

The countries' cooperation on coal is partly intended to deliver a blow to Australia. China has imposed restrictions on several Australian exports, including coal, after Canberra called for an independent inquiry into the origins of the coronavirus outbreak. About a quarter of China's coal imports came from Australia in 2019. Elgaugol Director-General Aleksandr Isaev said his company will replace most of the shipments to China from the U.S. and Australia.

Russian petrochemical company Sibur Holding on Dec. 28 also announced a joint venture at the Amur Gas Chemical Complex with China Petroleum & Chemical Corp., or Sinopec. Construction of the plant is expected to begin in earnest now that the companies have received the relevant approvals, and is slated for completion in 2024. Sinopec will own 40% of the facility. The trend extends to natural gas as well. State-backed Gazprom has kicked off an 800 km extension of the so-called Power of Siberia pipeline, which began transporting natural gas from Russia to China in December 2019. The extension will connect the pipeline to the Kovykta gas field in eastern Siberia by the end of 2022, in a step toward Gazprom's goal of boosting flows through the pipeline to 38 billion cu. meters annually by 2025. Flows came to 3.8 billion cu. meters for the first year.

Gazprom, which holds a monopoly on the export of gas through pipelines, transported 200 billion cu. meters of gas to Europe and Turkey in 2019. But the company has been shifting its focus east, and last year began a feasibility study for another pipeline that would deliver 50 billion cu. meters of gas to China via Mongolia.

Russia also began operating a new oil pipeline to northeastern China in 2011.

As the world's top energy consumer, China has long enjoyed a complementary relationship with Russia, a key energy exporter. Their ties have become even stronger in recent months in the face of political pushback from the U.S., Europe and Australia. Xi is rushing to diversify his country's energy supply, with the U.S. only expected to increase its pressure on China under President-elect Joe Biden. Russia is a key part of his plan.

"Russia will play an even bigger role in China's energy security, given that tensions with the U.S. are expected to persist over the long term," an industry insider said. Russia, too, has also had to deal with harsh pushback and sanctions by the U.S. and Europe since it annexed the Crimean Peninsula in 2014. With Europe also planning to significantly increase renewable energy use, the country is under pressure to boost exports to China in order to underpin its oil and gas industry. Xi and Putin aim to double bilateral trade to $200 billion by 2024, largely in natural resources.

But an increased focus on China comes with risks for Russia. Because much of Russia's exports are commodities like crude oil, gas and logs, experts say the country could find itself in a subordinate position to China economically. Russia struggled in price negotiations against China on natural gas exports, and an economic dependence on the Asian superpower could force Moscow to eventually compromise politically as well.

Pence Said to Have Told Trump He Lacks Power to Change Election Result

A day before he presides over a joint session of Congress to ratify Joseph R. Biden Jr.’s victory, the vice president tried to lower the president’s expectations while seeking ways to mollify him.

Vice President Mike Pence told President Trump on Tuesday that he did not believe he had the power to block congressional certification of Joseph R. Biden Jr.’s victory in the presidential election despite Mr. Trump’s baseless insistence that he did, people briefed on the conversation said.

Mr. Pence’s message, delivered during his weekly lunch with the president, came hours after Mr. Trump further turned up the public pressure on the vice president to do his bidding when Congress convenes Wednesday in a joint session to ratify Mr. Biden’s Electoral College win.

“The Vice President has the power to reject fraudulently chosen electors,” Mr. Trump wrote on Twitter on Tuesday morning, an inaccurate assertion that mischaracterized Mr. Pence’s largely formal and constitutionally prescribed role of presiding over the House and Senate as they receive and certify the electoral votes conveyed by the states and announcing the outcome.

Mr. Pence does not have the unilateral power to alter the results sent by the states to Congress.

More Republican senators came out on Tuesday against attempts to undermine the results, including Tim Scott of South Carolina and James M. Inhofe of Oklahoma, who said he viewed challenging any state’s certification as “a violation of my oath of office.”

In a process that is likely to go on for many hours, Mr. Pence will preside on Wednesday over a roll call of the states. If at least one senator and one House member object to the results from a state, they can force a debate of up to two hours about those results. Each chamber will then vote separately on whether to certify that state’s results.

For results to be overturned, both the House and the Senate would have to agree to do so. Because the House is controlled by the Democrats, there is no realistic possibility of any state’s outcome being rejected. In addition, many if not most Senate Republicans appear likely to join all Democrats in rejecting challenges to the results.

The House and Senate are expected to debate objections to the results in at least three states — Arizona, Georgia and Pennsylvania, all of which went to Mr. Biden — but ultimately to certify Mr. Biden’s 306-to-232 Electoral College victory.

Lawmakers anticipated possible objections for up to three more states — Michigan, Nevada and Wisconsin — although it was not clear whether they would draw the required backing from a member of both the House and the Senate.

When the results from all of the states have been considered, Mr. Pence, who as vice president also serves as presiding officer of the Senate, will be called on to read out the Electoral College votes for each candidate, formalizing Mr. Biden’s victory.

Mr. Pence has spent the past several days in a delicate dance, seeking at once to convey to the president that he does not have the authority to overturn the results of the election, while also placating the president to avoid a rift that could torpedo any hopes Mr. Pence has of running in 2024 as Mr. Trump’s loyal heir.

Even as he sought to make clear that he does not have the power Mr. Trump seems to think he has, Mr. Pence also indicated to the president that he would keep studying the issue up until the final hours before the joint session of Congress begins at 1 p.m. Wednesday, according to the people briefed on their conversation.

One option being considered, according to a person close to Mr. Trump, was having Mr. Pence acknowledge the president’s claims about election fraud in some form during one or more of the Senate debates about the results from particular states before the certification. Mr. Pence will preside over those debates.

Mr. Trump has been cajoling Mr. Pence in public and private to find a way to use his role on Wednesday to give credence to his unfounded claims — rejected by the states and in scores of court cases and backed by no evidence — that the election was stolen from him through widespread fraud.

The president has told several people privately that he would rather lose with people thinking it was stolen from him than that he simply lost, according to people familiar with his remarks.

Mr. Pence has spent hours with parliamentarians and lawyers in recent days. His allies said they expect him to carry out his constitutional duties on Wednesday.

If Mr. Pence were for some reason unable or unwilling to carry out his role as president of the Senate, that role would fall to Senator Charles E. Grassley, Republican of Iowa, the chamber’s longest-serving Republican member.

There was brief confusion on Tuesday morning when Mr. Grassley was quoted saying that he would be the one presiding over the certification, and not Mr. Pence, because “we don’t expect him to be there.”

Mr. Grassley’s aides later said he was suggesting a hypothetical, should Mr. Pence step out for a break at some point.

How much leeway Mr. Pence could have to interject his views or to stage manage the proceedings is a subject of debate among experts.

“The way Trump is phrasing it, there’s no merit,” said Edward B. Foley, director of the election law program at Ohio State University. “What Trump is asking for is control of the outcome that will lead to him being declared the president. That is definitely not within Pence’s power.”

But Mr. Foley said Mr. Pence would be able to add some “drama to the theater,” if he so chooses. As an example, Mr. Foley said the vice president could present “rival” packages of electoral votes for some states and force Congress to debate both simultaneously.

“We know the end result,” he said, “we just don’t know when we will get there or what procedure we will take to get there.”

In the days immediately after the election on Nov. 3, Mr. Trump was in shock but understood that he had lost, advisers said. But the more time that has passed, and the more that he has been enabled by a small group of people who have fed his belief that there is a mechanism to wipe away Mr. Biden’s win, the more invested in trying to reverse the outcome Mr. Trump has become.

Some of the president’s closest advisers publicly tried to give Mr. Pence cover on Tuesday as Mr. Trump stepped up the pressure on him.

“Some have speculated that the vice president could simply say, ‘I’m not going to accept these electors,’ that he has the authority to do that under the Constitution. I actually don’t think that’s what the Constitution has in mind,” Jay Sekulow, one of the president’s personal lawyers, said on his radio program on Tuesday, without mentioning that his client was one of the people making that assertion.

“If that’s the case, any vice president could refuse any election,” he said. “It’s more of a ministerial procedural function.”

Several allies of Mr. Pence said the vice president was getting mixed advice on what to do, and was desperate to find some middle ground.

One ally said that Mr. Pence would follow the rule of law, but that he was looking for a way to “thread the needle” so that his words were not played back on social media and used to ding Mr. Trump.

Another said that his advisers were being “realistic” about his options.

But some conceded that he would have benefited from telegraphing more aggressively over the past few days that he was not going to be able to rescue the president from defeat, rather than allowing suspense to build while attracting more attention to what they see as a no-win situation.

They said he could have also better explained to the public the ceremonial nature of the role rather than giving hope to Trump supporters like he did Monday in Georgia when he said that “we will have our day come Wednesday.”

“He’s not going to unilaterally step in and make a decision,” said David McIntosh, the president of the anti-tax Club for Growth and a friend of Mr. Pence’s. “He’ll let the Senate consider it, and if they certify it, there’s no way he as the president of the Senate is going to change that decision.”

Mr. Trump has sought input from another of his personal lawyers, Rudolph W. Giuliani; his trade adviser, Peter Navarro; and John Eastman, a lawyer who represented the president during a case brought by several Republican attorneys general against a handful of battleground states. The lawsuit was tossed out, but Trump advisers believe that Mr. Eastman is among the people counseling Mr. Trump that Mr. Pence has expansive powers.

Mark Meadows, the White House chief of staff, who has often been at odds with Mr. Pence’s chief of staff, Marc Short, has been described by several senior advisers as essentially enabling Mr. Trump’s hope of finding a magic pill to change the electoral results.

Mr. Meadows facilitated the president’s call with the secretary of state of Georgia on Saturday, during which Mr. Trump implored the official to “find” enough votes in the state to flip it from Mr. Biden’s column.
