A federal appeals court handed another legal defeat Thursday to a Russian-born academic who claims she was libeled by press accounts that she says insinuated she had an affair with former National Security Adviser and Defense Intelligence Agency chief Michael Flynn.

 

The academic, Svetlana Lokhova, sued several news organizations in 2019 over the reports and also named as a defendant Stefan Halper, a United Kingdom-based former professor who was a central figure in the FBI investigation into alleged collusion between the Trump campaign and Russia.

 

A ruling issued by the Richmond, Va.-based 4th Circuit Court of Appeals Thursday upheld an earlier district court decision throwing Lokhova’s suit out in its entirety.

 

The appeals court said most of the articles Lokhova claimed were libelous were too old to be included in the suit she filed two years ago. Under Virginia’s one-year statute of limitations for defamation claims, the only publications that were fairly subject to the suit were a Washington Post story and some tweets sent by MSNBC national security contributor Malcolm Nance.

 

The Post reported that at a 2014 dinner, Halper and a colleague “were disconcerted by the attention the then-DIA chief showed to a Russian-born graduate student…according to people familiar with the episode.”

 

Writing for the appeals court, Judge Stephanie Thacker said that language could not fairly be read as an attack on Lokhova.

 

“We conclude that it cannot be reasonably read to defame [Lokhova,] either directly or through implication or innuendo,” wrote Thacker, an appointee of President Barack Obama. “Even if we infer the unnamed graduate student is [Lokhova,] it says nothing of her behavior toward General Flynn – it only addresses his behavior toward her.”

 

Flynn and Lokhova have denied any affair.

 

Lokhova asserted that Halper was a source for the news stories. A former Republican political operative in the U.S., in recent decades Halper has been a University of Cambridge professor active in foreign policy circles. Halper hasn’t spoken publicly about his role in the Trump-Russia investigation, but numerous press reports say the FBI dispatched him to covertly contact Trump campaign adviser George Papadopoulos and assess reports that he had information about Russian-backed hacking of Democratic candidate Hillary Clinton’s emails.

 

In the new ruling, the appeals court also ruled that Lokhova’s claims against MSNBC over Nance’s tweets fell short because there was no indication Nance was acting for the network when he sent the messages Lokhova sued over.

 

Judge James Wynn, another Obama appointee, joined Thacker’s ruling in full. Judge A. Marvin Quattlebaum Jr. dissented on one point: he said one of Lokhova’s claims based on a hyperlink in a New York Times article should have been considered on the merits.

 

The district court and the majority on the appeals panel said simply adding a link wasn’t enough to constitute republishing a story and giving Lokhova another chance to sue over it. But Quattlebaum, an appointee of President Donald Trump, said the link to the earlier story did amount to a republication.

 

In his dissent, Quattlebaum even used the term “clickbait” to refer to the Times’ relatively common practice.

 

”Here, Lokhova has plausibly alleged that rather than using the hyperlink as a citation, The New York Times used it as a means of redistributing previous material with the goal of expanding its readership,” the judge wrote. Denying plaintiffs the ability to sue over hyperlinks, Quattlebaum wrote, “would effectively permit publishers to hyperlink their way to consequence-free promotion.”

 

Halper’s lawyers asked the appeals court to impose sanctions on Lokhova’s lawyer Steven Biss, a Charlottesville-based attorney who has drawn notoriety for filing a series of libel suits on behalf of Rep. Devin Nunes, (R-Calif.) now the ranking minority member of the House Intelligence Committee.

 

Halper’s lawyers said Biss’ handling of the Lokhova case violated bar rules. Thacker was sharply critical of Biss, saying: “His history of unprofessional conduct is long.” She declined to order sanctions though, saying the issue remained up to the district court.

Chinese Asset Manager Suffers Bond Selloff After Delaying Results

 

Debt from one of China’s biggest asset managers has plunged in value, sending tremors through the market for U.S. dollar bonds of Chinese companies.

 

The selloff in bonds issued by China Huarong Asset Management Co., a giant state-owned financial institution, came after the company missed an end-March deadline to release its 2020 financial results. Investors dumped its bonds, sending some of their prices down to as low as 60 cents on the dollar, according to Tradeweb, indicating they see a high likelihood of default.

 

Defaults by state-backed Chinese companies have become more common in recent years, as China has tried to dispel the idea that it will always make creditors whole. Investors are now grappling with the possibility that this new approach could extend to a company as large and important as Huarong—a major player in Chinese finance with about $22 billion of offshore debt and investment-grade ratings from global credit raters.

 

Huarong, which is majority owned by China’s Ministry of Finance, is the largest of four asset managers that were created by Beijing in the late 1990s when the country’s banks were struggling with large portfolios of bad debt. At the time, Huarong and its peers bought nonperforming loans from China’s biggest state-owned banks and worked to dispose of them by auctioning off and selling the loans to other investors, including foreign banks.

Chicago bodycam footage that captured the fatal police shooting of Adam Toledo, 13, will be released on Thursday, according to the Civilian Office of Police Accountability.

 

The materials related to Toledo's March 29 shooting death will include footage from body-worn cameras, third-party video and other recordings, COPA said Wednesday in a news release.

 

Toledo died of a gunshot wound to his chest, according to the Cook County Medical Examiner’s Office. Officers responded to an area on Chicago's West Side after learning that gunshots were detected by police-operated technology. Toledo and a 21-year-old man fled on foot when confronted by police and an officer shot the teen once, authorities said. The department described it as an armed confrontation.

 

A handgun the teen was carrying was recovered at the scene, police said. Prosecutors allege that Toledo had gun residue on his hand.

 

The police accountability board initially said it was legally prohibited from releasing video of the shooting because the teen was a minor, but that changed after Chicago Mayor Lori Lightfoot and Police Superintendent David Brown called for the video's release.

COPA said in a statement Wednesday that the video and other materials would be released Thursday.

 

"COPA has remained sensitive to the family's grief and is carrying out this release in accordance with the City's Video Release Policy," COPA said in a statement.

 

The footage has been widely anticipated in the city after other videos of violent police encounters around the country sparked civil unrest. The family praised the community for non-violent protests a day after they viewed video of the fatal police shooting.

 

"We appreciate the community support and are grateful that events so far have remained peaceful," the family said in a statement issued Wednesday by their attorneys.

 

Police said the other person who fled from police officers, Ruben Roman Jr. was arrested on a misdemeanor count of resisting arrest.

UK Government release most frightening report yet on Adverse Reactions to Covid Vaccines

 

The U.K. Governments report (which you can find here)

 

has collated data inputted up to the 28th March via the MHRA Yellow Card Scheme. At this point an estimated 10.9 million first doses of the Pfizer/BioNTech vaccine and 19.5 million first doses of the Oxford University/AstraZeneca vaccine, had been administered. There were also around 3.7 million second doses, mostly of which were the Pfizer / BioNTech vaccine.

 

Our earliest analysis of the data which we brought you back at the beginning of February showed that there had been 49,472 adverse reactions to the Pfizer vaccine, and 21,032 adverse reactions to the Oxford vaccine up to the 24th January 2021, with a rate of 1 in every 333 people receiving the jab suffering a serious adverse reaction.

 

Well we can confirm that in the space of nine weeks the number of reported adverse reactions to the Pfizer vaccine has increased to 124,371 as of the 28th March. The Oxford jab has fared much worse though with an astounding increase of 419,839 reported adverse reactions as of the 29th March, now standing at a total of 440,871. This now means the current rate of people suffering a serious adverse reaction after having one of the experimental Covid vaccines stands at 1 in every 166 people, however it is thought around only 1% of adverse reactions are actually reported to the MHRA Yellow Card scheme with many people not knowing of its existence.

 

The line from the MHRA and UK Government is that ‘it may be difficult to tell the difference between something that has occurred naturally and a suspected adverse reaction. Sometimes these events can be part of the condition being treated rather than being caused by the vaccine’. Repeatedly suggesting that the current rate of adverse reactions is in line with what we would expect to see in the “non-vaccinated” population.

 

Well we disagree that it’s difficult, and we also disagree that it is in line with the natural rate. If the rate of adverse reactions was in line with the natural rate expected to occur in the “non-vaccinated” population then what we should be seeing is a similar amount of occurrence for each vaccine in relation to how many vaccines have been adminsitered.

 

So if we use the MHRA’s own estimated numbers we can see that as of the 28th March 2021 approximately 20 million doses of the AstraZeneca vaccine had been administered. Whereas approximately 14 million first doses of the Pfizer vaccine had been administered. This accounts for a 43% difference between the two jabs. Therefore the number of specific reactions, and the overall number of reactions should reflect the same difference and be around 43%.

 

But the number of reported adverse reactions to the AstraZeneca vaccine is 254.4% higher than the number of adverse reactions to the Pfizer vaccine, with AstraZeneca standing at 440,871 and Pfizer standing at 124,371. This doesn’t suggest a rate in line with the “statistical norm.” to us.

 

So we took a look at the specific reactions to see if there were any serious cause for concerns, and this is what we found…

The total number of blood disorders reported as adverse reactions to both the Pfizer and AstraZeneca vaccine now stands at 6728 as of the 28th March 2021. This includes ailments such as thrombocytopenia which is where your body has a low level of platelets in the blood, this is also the condition that has been occurring alongside blood clots which the Government have finally admitted is due to the AstraZeneca vaccine, but have of course played it down. Severe forms of this ailment can lead to bleeding spontaneously from the eyes, gums, or bladder and can result in death. Which is exactly what has happened in the case of the Pfizer vaccine, with 29 cases of thrombocytopenia being reported which have resulted in 1 death thus far

Imaad Zuberi, a major Democratic fundraiser facing 12 years in prison, has filed an extraordinary complaint with the CIA's chief watchdog alleging he witnessed "flagrant problems, abuses, violations of law" while working as an asset for U.S. intelligence, according to documents and interviews.

 

Zuberi, of Los Angeles, recently hired the CIA's retired acting general counsel Robert J. Eatinger Jr. to review his case and help to appeal his conviction on a plea deal with federal prosecutors.

 

After reviewing evidence, including secret communications between Zuberi and his alleged CIA handlers that were enumerated in a secret Classified Information Protection Act filing in his criminal case, Eatinger prepared and delivered two complaints to the CIA inspector general earlier this month.

 

Shortly afterwards, the former CIA lawyer faxed letters to key members of the House and Senate intelligence committees alerting them to the allegations and offering to share a confidential summary if the IG did not formally open a probe.

 

New Director of National Intelligence Avril Haynes and CIA Director William Burns also were alerted to the complaints, according to the congressional letters reviewed by Just the News.

 

Eatinger, a highly respected intelligence community lawyer who retired from the CIA about a decade ago, used unmistakable language drawn from intelligence laws to describe to Congress the nature of Zuberi's allegations.

 

He wrote that he had "submitted two reports to the Acting Inspector General of the Central Intelligence Agency (CIA) that contained complaints or information regarding serious or flagrant problems, abuses, violations of law or executive order, or deficiencies relating to the funding administration or operations of an intelligence activity."

 

He added that if the CIA did not confirm it "will forward the reports to the intelligence committees within 14 days, we will do so directly."

 

Zuberi's legal team spokesman, Chad Kolton, declined comment. A spokesman for the CIA did not immediately return a call and email seeking comment Wednesday night.

 

Eatinger's letter to Congress did not formally identify Zuberi, but rather stated he was taking the action on "behalf of a U.S. citizen client." But multiple sources confirmed to Just the News that the information in the IG complaints involved Zuberi and that his name appeared in the memos.

 

For two decades, Zuberi was a larger-than-life figure on the political stage, hobnobbing with Republicans and Democrats alike from California to Washington as he raised millions for campaigns and globe-trotted with a successful international business. Eyewitness testimony from a Portland police informant with a history of providing “credible and reliable information on multiple prior investigations” is one of the Multnomah County prosecutors’ strongest pieces of evidence in charging a 19-year-old woman with arson for allegedly setting fire to the Portland Police Association headquarters.

 

On Wednesday, the district attorney’s office filed charges of arson, criminal mischief and felony riot against Alma Raven-Guido. The charges follow an April 13 protest against racist policing where some of the protesters marched to the union hall on North Lombard Street and set fire to a portion of it.

 

The most substantial information in the probable cause affidavit filed Wednesday by the Multnomah County District Attorney’s Office comes from the alleged firsthand account of an unnamed informant.

 

“The informant observed the defendant pour a flammable liquid on the building from three plastic bottles which the informant described as having labels which were either blacked out or taped over with black tape,” the affidavit says. “The informant further explained that when the defendant was pouring the liquid on the fire and causing the fire to grow, one of the bottles caught on fire and started to melt.”

 

The informant allegedly witnessed Raven-Guido place all three bottles into her backpack, court records say.

 

The informant reportedly provided a description of Raven-Guido and her alleged “actions associated with the fire,” court filings say. Officer Le then arrested her with the assistance of Officer Ryan Potter, according to the affidavit. They then searched Raven-Guido’s backpack, where they reportedly found lighters and plastic bottles containing “what appeared to be an accelerant.” Prosecutors allege that one of the bottles they recovered was partially melted.

Russia pledges retaliation, summons US envoy over new sanctions, as NATO & EU back Biden’s move to target country’s national debt

 

The Russian Foreign Ministry announced on Thursday that it would soon respond in kind to a new package of sanctions unveiled against the country by US President Joe Biden, with Washington also expelling ten of Moscow’s diplomats.

 

Maria Zakharova, the ministry’s spokeswoman, told reporters that retaliation against the move was “unavoidable,” and that the American ambassador, John Sullivan, had been summoned for “tough talks.” She said, “I would hardly have said this before, but I can say it now: It’s not going to be a pleasant meeting for him.”

 

Biden signed the decree on Thursday morning, ushering in sanctions against more than 30 Russian individuals and organizations over claims that Moscow meddled in the 2020 US presidential election and was behind the colossal SolarWinds cyber-espionage case that saw hackers gain access to more than 100 corporate networks, as well as nine American government agencies. The Kremlin has denied accusations it was involved in either case.

 

The new measures include a ban on American financial institutions directly purchasing Russian sovereign debt, which is traditionally used by governments as a way to shore up their economies.

 

Just weeks ago, the country’s Deputy Foreign Minister Alexander Pankin warned that the US may resort to attacking bonds as part of “a deliberate calculation to create a toxic atmosphere around Russian securities in order to reduce their investment potential.” He revealed that Moscow has already been working to create a battle plan to limit the effect such sanctions would have on the economy.

 

White House National Security Advisor Jake Sullivan defended the move later on Thursday, saying that the package of sanctions comprised “proportionate measures to defend American interests in response to harmful Russia actions including cyber intrusions and election interference.” Ned Price, the State Department spokesman, also tweeted that “we are sending a clear message to Moscow” with the new measures.

 

However, Dmitry Polyanskiy, Russia’s deputy permanent representative to the UN, replied saying that “now it is our turn to ‘hold the US to account’ for promoting unsubstantiated allegations and unfriendly moves. That’s how it works in diplomacy.”

 

Vyacheslav Volodin, the speaker of Russia’s State Duma, claimed the measures demonstrated that the “whole arsenal of accusations has been exhausted, and the US is going in a circle.” He added that “by imposing sanctions, they punish themselves. In the end, they will have to build relationships that they themselves have destroyed.”

France’s controversial ‘global security’ bill that sparked widespread protests adopted by parliament

 

The French parliament has passed a controversial bill on “global security” and its heavily criticized provision on penalizing the malicious dissemination of images of the police, after deputies voted in its favor.

 

On Thursday, the National Assembly gave the government’s global security bill the green light, passing the motion with 75 votes for and 33 against, despite sustained opposition from civil society groups who claim the bill will limit public freedoms.

 

Interior Minister Gerald Darmanin said the law would protect officers from online calls for violence and has widely been supported by law enforcement unions.

 

The left has already announced their intention to take the matter to the Constitutional Council in the hope that the bill will not be implemented. Venting his opposition, Alexis Corbière of the party, La France Insoumise, said this is “a text of global insecurity because it casts suspicion on the police” and prevents “citizen criticism.”

 

The bill includes the particularly controversial Article 24, which provoked major demonstrations in the autumn and new year despite the pandemic. Article 24 has been rewritten since its first reading, but still penalizes the sharing of images that maliciously identifies police officers in operations by face or name.

 

Images shared with the intention of identifying the spouse, partner, or child of a law enforcement officer will also be punished, with sentences of up to five years in prison and a €75,000 fine.

 

The bill is not limited to Article 24. The text aims to establish a “security continuum” for state security forces, municipal police forces and the private security sector. The bill also contains provisions for the extended use of police body cameras and drones.

Biden Admin Arrests Journalist Who Recorded Ashli Babbitt Murder As DOJ Hides Identity Of Shooter

 

Federal agents smashed down Samuel Montoya's front door and charged him with four counts

 

As the Department of Justice continues to hide the identity of the officer who shot and killed Ashli Babbitt, the Biden administration has arrested a journalist who recorded her murder.

 

Ashli Babbitt, the unarmed election integrity protestor and USAF veteran, was gunned down by a Capitol Police officer on January 6th, during the protests at the US Capitol in Washington DC. On Wednesday, the Department of Justice announced that they would not pursue charges against the officer responsible, claiming that there was “insufficient evidence” to determine whether her civil rights had been violated.

 

Video footage of Babbitt’s killing was seen around the world, documenting the tragic incident, and one journalist who filmed the “clearest” footage was Samuel Montoya, a video journalist from Texas. Montoya, however, was arrested by federal agents on Wednesday morning, and charged with four counts, including “interfering with government business,” and “disorderly and disruptive conduct in a Capitol Building.”

 

According to the FBI arrest warrant affidavit, Montoya had repeatedly “described himself to others inside the Capitol Building as a ‘reporter’ or ‘journalist’ as he attempts to get through crowds,” but because “no one by that name has Congressional press credentials as an individual or via any other organizations,” he couldn’t apparently count as a journalist, despite documenting much of the day’s events, including Babbitt’s killing, for Infowars, a major media outlet.

 

Fox News’s Tucker Carlson discussed Montoya’s arrest on his show Wednesday night, noting that his footage proves that Babbitt did not pose a threat to any officers at the time of her death. “We’re grateful we have that tape. If we didn’t, the New York Times would be telling us that Ashli was beating people to death with a fire extinguisher when she was killed,” Carlson said.

A FOIA request has been filed to obtain the name of the Capitol Hill police officer who fatally shot Ashli Babbitt on January 6.

 

Successful trial attorney Norm Pattis, described by the media as being “brilliant and audacious” and a “legal top gun”, has filed a Freedom of Information Act request to obtain the name of the Capitol Hill police officer who shot and killed Ashli Babbitt during the civil unrest that transpired in Washington, D.C. on January 6. National File has obtained a copy of the FOIA request.

 

The Biden administration’s Department of Justice is refusing to name or charge the police officer responsible for Babbitt’s death, despite admitting that the officer had no reasonable cause to discharge his firearm against her. The Babbitt family attorney has pledged to continue fighting on behalf of his clients, and suggested civil litigation against the federal government and the unnamed police officer may be impending.

 

To further complicate matters, yesterday the Department of Justice took the unprecedented move of arresting the video journalist who captured clear video of the fatal shooting. Many conservatives decried the seemingly political persecution, including Conservative commentator Tucker Carlson, who compared the action to authoritarian silencing of dissident journalists that is commonplace in the third world.

 

“Questions still remain in the public’s mind over whether the officer’s use of force was justified. The United States Department of Justice obviously shared those concerns because it opened its own investigation into whether the officer should be charged with a federal crime,” wrote Pattis in the FOIA request. “That investigation concluded that the officer should not be charged, and the Department publicly announced its conclusion.”

 

“The public now desperately wants to know why the Department of Justice did not charge the officer. It also wants to know who that officer is,” Pattis explained. “The Department of Justice’s press release offers little information about how it reached its conclusion and the evidence supporting or disproving its conclusion. It offered no clue as to who the officer is.”

 

“The public’s interest in Ms. Babbitt’s unfortunate death at the hands of a Capitol police officer is more intensified than usual in light of the circumstances ongoing in the United States during 2020 and 2021. The public’s confidence in police officers, prosecutors, and other law enforcement officials is at an all-time low due to the numerous law-enforcement involved deaths that occurred in 2020 and 2021,” Pattis continued, explaining why the officer’s name should be released to his client, Alex Jones’ Infowars.

 

Meanwhile, journalist Tayler Hansen claims to have identified the officer responsible for the shooting as Lieutenant Mike Byrd, who once left his service pistol unattended in a bathroom and claimed that he “will be treated differently” because of his senior rank. Hansen says that Byrd is apparently in hiding, and is no longer employed or living at his address.

Texas Senate Defies NCAA, Gives Transgender Athlete Ban Initial Approval

 

The Texas Senate approved legislation limiting transgender athletes to competing only in categories that correspond to their birth gender in contravention to the NCAA’s recent decision to allow transgender people to play in their choice of categories.

 

The Texas bill focuses on “biological sex.” It maintains that athletes born as males will be banned from competing in girls’ sports, although girls would be permitted to play with biological boys if there is no comparable female sport.

 

“This is about protecting female athletes and recognizing their accomplishments within their biological peer group,” said Sen. Charles Perry, R-Lubbock, author of the bill, according to the Austin-American Statesman.

 

The Texas Senate’s vote comes on the heels of the NCAA’s warning that it could pull events from states that approve bills restricting transgender athletes.

 

On Monday, the NCAA Board of Governors insisted colleges and universities that participate in NCAA tournaments must allow transgender athletes to play in any sport they want. The board insisted that it “firmly and unequivocally supports the opportunity for transgender student-athletes to compete in college sports.”

 

The NCAA added that it is considering pulling tournaments from states that don’t toe the transgender line.

 

When determining where championships are held, NCAA policy directs that only locations where hosts can commit to providing an environment that is safe, healthy, and free of discrimination should be selected. We will continue to closely monitor these situations to determine whether NCAA championships can be conducted in ways that are welcoming and respectful of all participants.

 

Texas is not alone in considering laws to restrict athletes from competing in categories that correspond only to their birth gender. Mississippi, Tennessee, Arkansas, and Idaho have already put similar laws in place. And up to a dozen other states are considering similar measures.

Jeffrey Epstein’s attorneys, who were hoping to persuade a judge to release the accused sexual predator on bail while awaiting trial, submitted a bare bones accounting of his financing this week.

 

Prosecutors — and the judge — were skeptical.

 

Now, documents obtained by McClatchy and the Miami Herald provide a more detailed — but still very limited — look at Epstein’s wealth. They also underscore the challenge his accusers and the U.S. legal system might face in seeking restitution if he is convicted of the federal sex trafficking charges filed last week.

 

Documents released without authorization from Swiss banks show that Epstein in February 1997 was ensconced in the offshore banking world, and he appears in other offshore documents, part of an unauthorized release from Appleby, a Bermuda-based law firm specializing in the creation of offshore companies and investment vehicles for the ultra-wealthy. A client bank profile cryptically describes Epstein’s job as “Manager of Fortune.”

 

These documents also show that from at least 2000 to 2007 Epstein was chairman of a company called Liquid Funding Ltd., which was initially 40 percent owned by the Wall Street investment bank Bear Stearns. Bear Stearns’ spectacular collapse and sale to JP Morgan Chase in March 2008 set in motion what months later devolved into the worst U.S. financial crisis since the Great Depression.

 

Epstein’s wealth became a flash point as his legal team argued that he deserved to gain his release from jail pending trial. Federal prosecutors in New York cited his enormous wealth as adding to the risk he would flee.

 

The judge Thursday ruled that Epstein must stay locked up.

 

When asked to document his wealth, lawyers for Epstein told Senior U.S. District Court Judge Richard M. Berman that the answer is complex.

 

It’s unclear how longEpstein ran Liquid Funding, which tied back to a similarly named company in Delaware, and how much it contributed to the known narrative of Epstein losing big sums during the financial crisis.

 

But coupled with the fact that many of his businesses were operated in or with help from Caribbean offshore tax havens, the documents raise the likelihood that Epstein’s wealth is spread secretly across the globe. Wealthy people commonly employ opaque offshore companies to mask their true fortunes from tax authorities and creditors, although the companies also have legitimate business and tax-planning uses.

JPMorgan to Sell $13 Billion of Bonds in Largest Bank Sale Ever

 

JPMorgan Chase & Co. is poised to sell $13 billion of bonds, setting a record for the largest bond sale ever from a bank, according to data compiled by Bloomberg.

 

The longest portion of the five-part offering, a 31-year security, is expected to yield 107 basis points above Treasuries, according to a person familiar with the matter. The sale comes a day after JPMorgan reported strong first-quarter earnings, including a 15% increase in fixed-income, currency and commodity trading revenue and a $5.2 billion release from its credit reserves. Rival Goldman Sachs Group Inc. is also selling bonds Thursday.

 

The previous largest sale by a bank also came from JPMorgan, a $10 billion offering in April 2020, the Bloomberg-compiled data show.

 

JPMorgan is the sole bookrunner of the sale, and the proceeds are marked for general corporate purposes.

U.S. spy agency leaders said on Wednesday that China is an "unparalleled" priority, citing Beijing's regional aggression and cyber capabilities as they testified at a public congressional "Worldwide Threats" hearing for the first time in more than two years.

 

"Given that China is an unparalleled priority for the intelligence community, I will start with highlighting certain aspects of the threat from Beijing," Director of National Intelligence Avril Haines told the Senate Intelligence Committee.

 

She described China as increasingly "a near-peer competitor challenging the United States in multiple arenas."

 

Federal Bureau of Investigation Director Christopher Wray said his agency opens a new investigation linked to China every 10 hours.

 

Haines also cited Russian efforts to undermine U.S. influence, Iran's contribution to instability in the Middle East, global terrorism and potential North Korean efforts to "drive wedges" between Washington and its allies as significant threats.

 

The appearance by Haines and the other intelligence directors was the first such public "Worldwide Threats" hearing since January 2019. Former President Donald Trump, who often clashed with security agencies, did not send officials last year to testify at what is normally an annual event.

 

Democratic Senator Mark Warner, the committee's chairman, said he was "dismayed" there had been no hearing last year.

 

EMPHASIS ON TECHNOLOGY

 

Much of the hearing focused on technology - the threat from hacking, the importance of leading-edge development and the malign influence of social media.

 

"Today's technology environment allows adversaries to wreak havoc,' panel Republican Vice Chairman Marco Rubio said.

 

Warner noted the effort Beijing had put into making the Chinese firm Huawei (HWT.UL) a leader of advanced 5G systems, and said he was concerned it might make similar efforts in other emerging technologies.

 

Noting the dangers of international computer hacking like the recent SolarWinds attack, Warner said: "We may also want to develop new international norms where certain types of attacks are prohibited, just as the use of chemical or bio-weapons is banned."

 

Central Intelligence Agency Director William Burns, National Security Agency Director General Paul Nakasone and Defense Intelligence Agency Director Lieutenant General Scott Berrier also testified.

 

Burns said nearly a third of the CIA's workforce is focused on cyber issues.

 

Nakasone and Wray said intelligence agencies could benefit from more information from companies about cyber threats, but did not directly endorse calls from some members of Congress for legislation that would demand more of firms like Facebook (FB.O) and Twitter (TWTR.N).

 

Wray said social media has become "the key amplifier" to domestic violent extremism and malign foreign influence. "The same things that attract people to it for good reasons are also capable of causing all sorts of harms," Wray said.

 

U.S. intelligence agencies on Tuesday released a sweeping report on global threats. Disease, the rich-poor gap, climate change and conflicts within and among nations will pose greater challenges, with COVID-19 already worsening some of those problems, the report by the National Intelligence Council said. MINNEAPOLIS, MN – Some interesting new details have come to light regarding the case against former police officer Derek Chauvin, as there was once reportedly a plea deal offered to him days after the death of George Floyd.

 

And apparently, former AG Bill Barr was the person to have stopped the plea bargain from going through.

 

Here’s the details on this latest development.

 

By now, most everyone is familiar with the case lodged against Chauvin as he has been charged in connection with the in-custody death of Floyd from back in May of 2020. Currently, Chauvin is facing charges of second-degree unintentional murder and second-degree manslaughter.

 

Yet, just days after the death of Floyd, there was reportedly a plea bargain offered to Chauvin for third-degree murder – which Chauvin was reportedly willing to agree to.

 

Said plea bargain would have seen Chauvin serve a decade or more behind bars for the death of Floyd, which officials were in the process to rally up the press and announce that Chauvin had agreed to plead guilty.

 

But in order for the deal to go through, it would’ve had to have gotten the greenlight from then-AG Bill Barr, which Barr at the time said to pull the deal.

 

The reason Barr needed to approve the deal was that said deal would’ve seen Chauvin serve his sentence in federal prison.

 

The reported rationale for Barr’s decision was multifaceted, according to reports, with Barr at the time expressing concerns that a plea deal for third-degree murder would seem too lenient and that the investigation into the incident was far too early to begin entertaining potential plea bargains.

 

Furthermore, Barr was also said to have noted that the case was about to fall into the hands of state prosecutors who he felt would be best suited how to handle the case moving forward.

Judicial Watch Sues for Records about Reparations Program in Evanston, Illinois

 

(Washington, DC) – Judicial Watch announced today that it filed a Illinois Freedom of Information Act (FOIA) lawsuit against the city of Evanston, Illinois for records about its controversial, taxpayer-funded “reparations” program (Judicial Watch v. City of Evanston (No. 2021 CH 01761)).

 

On March 22, 2021, the Evanston City Council adopted Resolution 37-R27, authorizing the implementation of the Evanston Local Reparations Restorative Housing Program and Program Budget. The program allocated $10 million to provide $25,000 to Black/African American individuals who are either Evanston residents or direct descendants of Evanston residents to the exclusion of all other residents or direct descendants of residents.

 

Concerned that this program violates the Equal Protection Clause of the U.S. Constitution as well as other state and federal laws, Judicial Watch opened an investigation into the program and requested information under the Illinois FOIA. Specifically, Judicial Watch requested:

 

A. Records identifying discriminatory housing policies and practices that the Restorative Housing Reparations Program seeks to remedy;

 

B. Records identifying the ways in which the Restorative Housing Reparations Program will remedy discriminatory housing policies and practices; C. Records identifying all methods of remedying discriminatory housing policies and practices the Evanston City Council examined before enacting the Restorative Housing Reparations Program;

 

D. Records identifying all reasons why the Evanston City Council enacted the Restorative Housing Reparations Program instead of any alternative method of remedying discriminatory housing policies and practices;

 

E. Records relating to the development of criteria by which recipients of Restorative Housing Reparations Program funds will be selected;

 

F. Records identifying the ways in which providing Restorative Housing Reparations Program funds to the selected recipients will remedy discriminatory housing policies and practices; and

 

G. Records relating to any other discrimination of any kind, regardless of racial group, the Evanston City Council considered remedying as part of the Restorative Housing Reparations Program or any other proposed reparation programs.

 

After Evanston officials failed to search for and provide the requested records, Judicial Watch sued in the Circuit Court of Cook County, Illinois.

 

“A government program that provides taxpayer money to individuals based on race plainly violates the law,” said Judicial Watch President Tom Fitton. “The City of Evanston is unlawfully hiding records about its extremist reparations program that will spend tax dollars in a racially-discriminatory manner.”

Various press outlets have reported, but largely under-reported, a developing scandal regarding the Montana Supreme Court and their refusal to abide by information requests for their email correspondence on publicly-owned servers. But what lies under the surface of the scandal – and what is currently developing – will likely lead to the biggest news story in Montana politics in decades. Ultimately, as this saga continues, the scandal might lead to the impeachment of Supreme Court Justices and the arrest of at least one employee of the court. In the end, Governor Gianforte might be able to appoint new justices to the court, overthrowing the last liberal stronghold in the Montana state government.

 

 

The following days, particularly Monday, will be especially important for the State of Montana. Indiana lawmakers vote to override Gov. Holcomb's veto on emergency powers bill

 

"If HEA 1123 becomes law and can be used by the General Assembly, it will create significant uncertainty and solidify the controversy over its constitutionality. This is a matter of immediate and substantial public interest. In addition, any legislative actions taken during an unconstitutional special session will be void and thus open and subject to legal challenges to set them aside. Government should serve as a steady foundation during a time of crisis. Avoidable legal challenges during a state of emergency will only serve to be disruptive to our state."

 

Republican legislative leaders praise the governor’s actions during the pandemic but say the bill is meant to allow the input of lawmakers during extended emergency situations. For things like the stay-at-home orders, the mask mandates and the business restrictions, some Republicans lawmakers say they should have more of a say on such things in a public emergency.

 

The whole thing could also end up in court.
