Democratic Grassroots Groups Trying To Get Black Georgia Residents Out To Vote In Senate Runoff Elections

The Republican Party would be wise not to underestimate the Democrats’ resolve when it comes to winning the Senate runoff elections in Georgia. A recent report reveals that several left-wing grassroots organizations are working around the clock to ensure that their key voter bases show up on the day of the election.

The Hill reported that the same activists that helped former Vice President Joe Biden’s efforts in Georgia are hoping to do the same with the Senate race. “Activist groups in Georgia that were the backbone of the effort to turn Georgia blue this election cycle haven’t slowed down, their newest goal being to drive Georgians to the polls once again on Jan. 5 for the state’s Senate runoff elections,” the report explained.

The author noted that “Biden’s narrow win in Georgia has given Democrats hopes of winning the January contests.”

From The Hill:

“Biden’s victory was the first time that a Democratic presidential candidate has carried the state since 1992, and much of the credit for flipping the state has gone to a strong coalition of grassroots organizations, including New Georgia Project and the groups supported by former gubernatorial candidate Stacey Abrams (D), that worked on driving Black and other underrepresented voters to the polls while also combating voter suppression.”

Nse Ufot, the CEO of a grassroots organization called New Georgia Project, told The Hill about the activities his group engaged in to dredge up support for Biden.

“We’re talking about, you know, millions of text messages, millions of phone calls. We knocked on nearly half a million doors in the middle of a pandemic, millions of impressions with our digital ad content that was designed to neutralize the disinformation and misinformation that black voters and brown voters are subject to,” he explained. “And we’re going to have to do it again.”

These organizations believe that getting black voters out to vote again will help them win the senatorial races. But this could be a challenge for the left as black turnout in Georgia in 2020 was slightly less than it was for Hillary Clinton in 2016.

But it is important to acknowledge that this is still an uphill battle for the Democrats.

“In the Nov. 3 election, Sen. David Perdue (R) topped Democratic challenger Jon Ossoff by less than 100,000 votes but failed to secure 50 percent of the vote. The Rev. Raphael Warnock (D) actually beat Sen. Kelly Loeffler (R) in the state’s special Senate election by over 340,000 votes, but also failed to get half of the vote.”

While Loeffler received fewer votes that Warnock, she stands a much better chance of winning the runoff election. She is “expected to receive a hefty boost from Georgians who voted for Rep. Doug Collins In November,” according to The Hill. Collins, the other Republican candidate came in third place, and his voters will likely support Loeffler, giving her an extra boost.

Young voters are also one of the areas of focus for left-leaning grassroots groups in Georgia. The Center for Information and Research on Civic Learning and Engagement at Tufts University estimated that more than half of voters under 30 voted in this election cycle. They also made up 17 % of all of the votes in the country. In Georgia, they made up 20% of all votes in the state.

The Hill also pointed out that “90 percent of Black youth voters in the state voted for Biden. Because of this, Biden outpaced Trump with 18-to-29-year olds in Georgia by 187,000 votes.”

The runoff races in Georgia are particularly important because they will determine which party controls the Senate. Democrats must win both seats to make for a 50/50 split. If a vote on legislation comes down on party lines, Kamala Harris, if elected, would make the tiebreaking vote.

If the Democrats exercise this level of power over the Senate, it would make it much easier for a potential Biden administration to achieve its goals. Hopefully, the Republican Party are doing what needs to be done to make sure that this does not happen.

Pennsylvania Supreme Court Dismisses Challenge to Mail-in Voting on Equitable Doctrine of "Laches"

Earlier on Saturday the Pennsylvania Supreme Court issued a short decision ordering dismissal of the complaint filed by Congressman Mike Kelly and seven others challenging the legality of “no excuse” mail-in voting adopted by the Pennsylvania Legislature. The complaint alleged that such a system violated express provisions of the Pennsylvania Constitution, which require in-person voting subject only to very limited exceptions for “absent electors” within four very narrow classes.

The Pennsylvania Supreme Court did not address the merits of the allegations. It dismissed the complaint solely on the equitable doctrine of “laches,” which can be applied when one party to a dispute is seen by the Court as having “sat on its rights” with regard to a legal claim, and the opposing party would be unfairly injured to allow the party asserting its rights to prevail after having failed to act when it was first aware of the claim.

Here is what the Court wrote:

Upon consideration of the parties’ filings in Commonwealth Court, we hereby dismiss the petition for review with prejudice based upon Petitioners’ failure to file their facial constitutional challenge in a timely manner. Petitioners’ challenge violates the doctrine of laches given their complete failure to act with due diligence in commencing their facial constitutional challenge, which was ascertainable upon Act 77’s enactment. It is well-established that “[l]aches is an equitable doctrine that bars relief when a complaining party is guilty of want of due diligence in failing to promptly institute an action to the prejudice of another.”

As I have pointed out many times, judges in Pennsylvania, including Supreme Court judges, are elected in partisan contests where representatives from political parties run against each other. There are currently five Democrats and two Republicans on the seven-member Court.

The vote today was 7-0, but both Republican members dissented from the outright dismissal of the complaint. Their view is that the constitutionality of the mail-in voting system established by statute is in question, and the plaintiffs in the case are entitled to pursue that claim. But they agreed with the five Democrats that issuing an injunction preventing certification of the election was too drastic a remedy because of the impact it would have on the outcome of Pennsylvania’s election.

The want of due diligence demonstrated in this matter is unmistakable. Petitioners filed this facial challenge to the mail-in voting statutory provisions more than one year after the enactment of Act 77. At the time this action was filed on November 21, 2020, millions of Pennsylvania voters had already expressed their will in both the June 2020 Primary Election and the November 2020 General Election and the final ballots in the 2020 General Election were being tallied, with the results becoming seemingly apparent. Nevertheless, Petitioners waited to commence this litigation until days before the county boards of election were required to certify the election results to the Secretary of the Commonwealth. Thus, it is beyond cavil that Petitioners failed to act with due diligence in presenting the instant claim. Equally clear is the substantial prejudice arising from Petitioners’ failure to institute promptly a facial challenge to the mail-in voting statutory scheme, as such inaction would result in the disenfranchisement of millions of Pennsylvania voters.

The Pennsylvania Supreme Court knows with this decision “They have sown the wind, they shall reap the whirlwind.”

Joe Biden is an illegitimate President, but while the law may not allow him to be recognized as such, history will know.

Here Are Some More Troubling Questions About the Election Numbers

Folks on the left and in media have been downplaying or mocking any questions about the legitimacy of the election.

This despite sworn affidavits as to a variety of issues in multiple states.

You would think that media would want to report on some of the allegations. But in large measure, the national media has mostly turned a blind eye, any of the actual affidavits from witnesses. The only coverage has been from conservative or local media.

But the results of the election themselves raise questions.

As I wrote previously, the “red wave” in the House, with 27 toss-up races all going to the Republicans and with Republicans even winning some lean Democrat races, the holding of the Senate and the winning of state legislatures all raised the question of how all that could be happening, yet not giving President Donald Trump a win?

Yet there are more troubling numbers, as the Spectator observes in an article from Patrick Basham, who is similarly very troubled by what the numbers show.

Trump got 11 million more votes than when he won in 2016, receiving more votes than any incumbent running for re-election. Ok, so let’s accord some of that to the additional mail-in nature of this election.

But the president also made gains among minorities, getting from 8 percent of the black vote in 2016 to getting at least 12% in 2020, according to some measures. Normally that much would have doomed Joe Biden’s candidacy.

Trump also gained with 35% of the Hispanic vote nationally. Bellwether states like Florida, Ohio and Iowa went more to Trump than they had in 2016. Usually the Rust Belt states would go with Ohio as they had in 2016. As Basham notes, there have only been one who “lost” the Electoral College after winning those three states since 1852 – Richard Nixon in 1960 but that’s when there was a lot of question about “help” received by John Kennedy.

Moreover while there were spikes in exactly the cities that Biden needed in the critical swing states, there weren’t comparable spikes in comparable cities. Because while Biden supposedly won more votes than anyone in history (despite not being able to get out people to fill his circles in anemic events), he “won a record low of 17 percent of counties; he only won 524 counties, as opposed to the 873 counties Obama won in 2008.” But supposedly had more total votes. What that says is the increase was where it needed to be, not across the board, in what one would have to say was very unusual.

As I’ve written before, the non-polling metrics had all been going to Trump including party registrations trends; the respective primary votes; candidate enthusiasm; social media followings; broadcast and digital media ratings; online searches; the number of (especially small) donors; and the number of individuals betting on each candidate. So you would have to believe that all these historically accurate measures all suddenly were wrong to believe that Trump lost.

Basham also points to a variety of different irregularities that require answers including:

1. Why late on election night did swing states stop counting votes when Trump was way ahead? Why were some observers stopped from getting to viably observe the counting?

1. Unusual vote counts coming in batches of hundreds of thousands with unusually high numbers for Biden.

1. “Historically low absentee ballot rejection rates despite the massive expansion of mail voting.”

1. Witnesses reporting ballots in pristine condition (not folded), missing votes, invalid residential addresses.

1. In Georgia, Biden overtook Trump with 89 percent of the votes counted. For the next 53 batches of votes counted, Biden led Trump by the same exact 50.05 to 49.95 percent margin in every single batch. It is particularly perplexing that all statistical anomalies and tabulation abnormalities were in Biden’s favor. Whether the cause was simple human error or nefarious activity, or a combination, clearly something peculiar happened.

There are serious questions here and it’s the folks who just want to shut aside any of the questions who have the issue, not those who want answers.

Reviewing the Appeals Court's Decision Affirming Dismissal of Trump Campaign Lawsuit in Federal Court in Pennsylvania

Two points to make before I delve into what the Third Circuit did and said in affirming the district court’s dismissal of the suit with prejudice.

First, I predicted that the Third Circuit would reverse the lower court, and allow the Trump campaign to file a Second Amended Complaint — which I expected Judge Brann to once again dismiss based on a lack of standing. But doing so would have resulted in a better and more “coherent” record for appellate review in terms of the factual allegations being made, the legal theory for relief being advanced, and the “standing” determination that Judge Brann was nonetheless required by case law to use one again to dismiss. But the record for the Trump Campaign going forward would be better than the mess that had been made in the filing of the original complaint, the filing of a First Amended Complaint, the request to file a Second Amended Complaint — which as set forth in Court was going to be simply returning to the Original Complaint which was defective already.

Second, I said multiple times the handling of the case was poorly executed, leading to a turnover of counsel, and mish-mash of legal claims and factual “conclusions” seemingly tossed into a “word salad” complaint which read more like a transcript of “Fox and Friends” than a coherent and well thought out legal pleading.

This record of filings was made worse during oral argument on the motions where Rudy Giuliani, who argued the case — his first appearance in a courtroom in nearly 30 years according to some — stated on the record that the case was not about “fraud.” That was a huge concession — made long before all the facts were known — one that both the district court judge and the appeals court noted in their rulings.

But I expected the Third Circuit to grant the motion to file a Second Amended Complaint because Judge Brann in the District Court had not gone through the normal exercise of establishing why another effort at amending the complaint would be “futile.” In fact, Judge Brann suggested it would not be futile, as he was not ruling that a losing candidate in an election would never have standing to file a lawsuit in federal court — only that the manner in which the Trump Campaign had written its complaint did not establish standing.

But the Third Circuit ruled that it would, in fact, have been futile to amend. In doing so, however, it did something that Judge Brann did not do — it looked at the proposed Second Amended Complaint and said even if they allowed it to be filed, it still suffered from the fatal defects of the Original.

This is a bit of a procedural issue — normally when a plaintiff makes a motion to amend their complaint, a copy of the proposed amended complaint is filed along with the motion. The Court then reviews the proposed amended version, and makes a decision as to whether or not to allow it to be filed. Judge Brann did not do that here. His opinion dismissing the case and denying leave to file an amended complaint did not go through the various counts of the proposed amended complaint and address why it did not solve the problems he found to be present in the First Amended Complaint he was dismissing. He found that allowing a reinstatement of claims that were dismissed via the filing of the First Amended Complaint would likely prevent the Counties from certifying their results by the November 23 deadline. On that basis he denied the motion for leave to amend without further analysis.

So, did the Third Circuit simply do what all the commentators claim it did — toss the Trump Campaign out on its ear while castigating it for bringing facially meritless claims into federal court to prevent certification of the election result in Pennsylvania? Yes — and no.

Nor does the Campaign deserve an injunction to undo Pennsylvania’s certification of its votes. The Campaign’s claims have no merit. The number of ballots it specifically challenges is far smaller than the roughly 81,000-vote margin of victory. And it never claims fraud or that any votes were cast by illegal voters.

Those criticisms all concern drafting errors in the way the complaint was written. None address whether the Trump Campaign lacked the legal right to challenge the election.

But the Court did address the issue of election challenges in a different way, one that I found interesting. It may be a complete “false flag” signifying nothing, or it might be something different.

Multiple times when dismissing allegations made by the Trump Campaign, the Third Circuit states that the Pennsylvania Supreme Court has already resolved the issue against the Trump Campaign as a matter of state law in some other litigation. The Third Circuit avoids offering its own views on the issues by simply waving them off as state law claims, and the Pennsylvania state courts have already addressed them. Here are some examples:

The Pennsylvania Supreme Court ruled against the Campaign, holding: “[T]he Election Code does not require boards of elections to disqualify mail-in or absentee ballots submitted by qualified electors who signed the declaration on their ballot’s outer envelope but did not handwrite their name, their address, and/or date, where no fraud or irregularity has been alleged.” Id. at *1. That holding undermines the Campaign’s suggestions that defective ballots should not have been counted.

The Pennsylvania Supreme Court held that the Election Code requires only that poll watchers be in the room, not that they be within any specific distance of the ballots. In re Canvassing Observation Appeal of: City of Phila. Bd. of Electors, No. 30 EAP 2020, A.3d , 2020 WL 6737895, at *8–9 (Pa. Nov. 17, 2020)

The Pennsylvania Supreme Court has long “liberally construed” its Election Code “to protect voters’ right to vote,” even when a ballot violates a technical requirement. Shambach v. Bickhart, 845 A.2d 793, 802 (Pa. 2004). “Technicalities should not be used to make the right of the voter insecure.” Appeal of James, 105 A.2d 64, 66 (Pa. 1954) (internal quotation marks omitted). That court recently reiterated: “[T]he Election Code should be liberally construed so as not to deprive, inter alia, electors of their right to elect a candidate of their choice.” Pa. Dem. Party, 238 A.3d at 356. Thus, unless there is evidence of fraud,

Pennsylvania law overlooks small ballot glitches and respects the expressed intent of every lawful voter. In re: Canvass of Absentee and Mail-in Ballots, 2020 WL 6875017, at *1 (plurality opinion). In our federalist system, we must respect Pennsylvania’s approach to running elections. We will not make more of ballot technicalities than Pennsylvania itself does.

I note this because it takes me back to the point that four Justices of the US Supreme Court have already expressed concern with the Pennsylvania Supreme Court’s election law jurisprudence — specifically with regard to its decision changing the plain text of an election law statute after the General Assembly had refused to pass an amendment with the changes. There seem to be four Justices who would examine the Pennsylvania Court’s decisions under the “Electors Clause” of the Constitution, which commits the “manner” of conducting elections to the “legislature” of each state. Some of the decisions which the Third Circuit refers to in the opinion are decisions likely to end up as petitions for review before the US Supreme Court.

I believe there is a sentiment among some of the Justices to “dial back” the “lawfare” which takes place in federal courts every four years, often leading to federal judges imposing alterations by injunction on state election processes under the guise of “equal protection.” That won’t go away completely, but if the Court staked out very clear ground that election proceedings in the states shall proceed in the manner set forth in the text of state election law, that would curtail the 11th-hour litigation every four years to a significant degree. If there are multiple challenges pending which all involve decisions traceable to the Pennsylvania Supreme Court — including this one where the Third Circuit seems to go out of its way to say it is following the lead of that Court, the US Supreme Court might take them all up as part of one omnibus matter.

Ted Cruz Rips John Brennan to Shreds in Throwdown Battle Over Assassination of Iranian Nuclear Scientist

We reported yesterday on how the execrable John Brennan melted down over the assassination of Iran’s top nuclear scientist Mohsen Fahrizade, the man who had allegedly been behind their secret nuclear program.

Now, you would think that such an act against our enemies would elicit favorable response.

But Brennan and the Obama bros who have always stood up for Iran were not at all happy. Brennan even was upset over the killing of Soleimani who had just been behind the effort to take over the U.S. Embassy in Baghdad and who was behind the killing of countless Americans.

This was a criminal act & highly reckless. It risks lethal retaliation & a new round of regional conflict.

That prompted a nasty response from Brennan. He told Cruz he was “lawless” and “simple-minded,” two things that definitely don’t apply to Cruz, but do apply to Brennan himself.

Brennan’s CIA infamously spied on Congress and broke into their computers. Brennan lied about it and was caught. But because it was the Obama administration who never prosecuted any of their own people, he never suffered any consequences for his actions.

He tried to argue that his tweet didn’t involve the Logan Act. Yet, the Obama administration tried to hang that on Flynn for essentially the same statement.

In contrast, an individual tapped to be National Security Advisor (but not yet one) in an incoming Administration who privately contacts a foreign government official & advises how to conduct relations with the U.S. could be in violation of the Logan Act.

With the sheer breadth of insanity visited upon Donald Trump by the mainstream media, it can sometimes be hard to keep up with it all. Yet, their pettiness truly knows no bounds, and that was shown early on when the President was chastised for not having a pet in the White House. You see, he was breaking decades of tradition and it was clearly a sign he’s evil incarnate. I’m only half-joking with those paraphrases.

She’s right. This is a preview of what we are going to see from the media if Joe Biden takes office in January. Concerns over COVID are going to disappear. At the very least, the media will stop blaming it on the president. The Middle East will become a distant land except to brag about our relations with Iran. Any economic contraction will just be Trump’s fault.

But he’s got a cat!

Keep in mind, our media couldn’t find one positive story to publish about Donald Trump after four long years of him being in office, yet they’ve got cat stories ready to go before Biden is even inaugurated. If that doesn’t tell you how fundamentally unserious our news media are, I’m not sure what will. These are mediocrities disguised as intellects. They are the very kind of people who have brought the country the divisions we now suffer through. They have no ability to operate fairly, nor think rationally. Everything is couched in a partisan lens, and everything must serve whatever narrative they want to push.

The result of that is getting cat stories instead of critical looks at Hunter Biden or his father’s mental health. And these are the people who want to be our gatekeepers.
