The Supreme Court on Thursday ruled in favor of an illegal immigrant who was facing deportation, stating that they are entitled to discretionary relief because the government did not follow the rules.

Federal law says that an illegal immigrant in such a situation can avoid deportation at the attorney general's discretion if they have been in the U.S. for at least 10 years. The clock officially stops when they receive "a notice to appear" with information about their hearing. But in cases like plaintiff Agusto Niz-Chavez's, the government sent multiple documents containing different pieces of information. The court's majority ruled that because the law says "a" notice, that means it must be a single document.

"At one level, today’s dispute may seem semantic, focused on a single word, a small one at that," Justice Neil Gorsuch wrote in the court's opinion. "But words are how the law constrains power. In this case, the law’s terms ensure that, when the federal government seeks a procedural advantage against an individual, it will at least supply him with a single and reasonably comprehensive statement of the nature of the proceedings against him."

Gorsuch led an unusual collection of justices in the 6-3 decision. Siding with him were liberal Justices Elena Kagan, Sonia Sotomayor and Stephen Breyer, as well as conservatives Amy Coney Barrett and Clarence Thomas. Justice Brett Kavanaugh penned the dissent, joined by Chief Justice John Roberts and Justice Samuel Alito.

Niz-Chavez came to the U.S. in 2005, and the Supreme Court began the removal process in 2013, after which he was ordered to leave the U.S. voluntarily or be deported. He had received two notices, one in March 2013 with his charges, and another in May 2013 with the time and place of the hearing.

"I find the Court's conclusion rather perplexing as a matter of statutory interpretation and common sense," Kavanaugh wrote in his dissent, noting that Niz-Chavez had received all of the necessary information by May 2013, well within the 10-year period.

The government argued that it is difficult to send all of the information in one notice, because the time or place of a hearing could change.

"But as this Court has long made plain," Gorsuch countered, "pleas of administrative inconvenience and self-serving regulations never 'justify departing from the statute's clear text.'"

‘Worse than Solyndra’: Republicans Press for Information on Biden Admin’s Favorite Electric Battery Company

Energy Secretary Jennifer Granholm has up to $5 million invested in company Biden promoted

Republican senators are working to make the electric battery company President Joe Biden toured to promote his $1.9 trillion infrastructure plan this administration's Solyndra.

Biden's promotion of electric battery and bus manufacturer Proterra has struck a nerve on Capitol Hill after the Washington Free Beacon reported that Biden's energy secretary, Jennifer Granholm, still has up to $5 million invested in the company. The administration's $1.9 trillion infrastructure plan includes a $174 billion investment in electric vehicles, as well as plans to replace diesel-powered buses with electric-powered buses—the very product Proterra specializes in.

Sen. Ted Cruz (R., Texas) says the conflict of interest created by Biden's visit has the potential to be "even worse than Solyndra," the solar panel company that went bankrupt after receiving hundreds of millions of dollars in government-backed loans from the Obama administration.

"President Biden's decision to heavily promote a business where his energy secretary holds a multimillion-dollar stake has all the potential to be even worse than Solyndra," Cruz told the Free Beacon. "President Biden and Secretary Granholm should immediately remove themselves from their glaring conflict of interest."

The Solyndra boondoggle became a lasting symbol of failure during the Obama administration, which awarded the green energy firm a $535 million loan guarantee through the 2009 stimulus package. The loan was announced with fanfare by then-vice president Biden and Energy Secretary Steven Chu during a Sept. 4, 2009 speech at Solyndra's California headquarters. Obama, even after being warned that the company was on the brink of failure, visited its headquarters a few months later and hailed it for "leading the way toward a brighter and more prosperous future."

The company months later shut down all operations and declared bankruptcy.

The overt promotion of Solyndra bears resemblance to the current treatment of Proterra, which in the first hundred days of the Biden administration won a visit by the president as well as a visit by Vice President Kamala Harris to one of its largest partners. Biden predicted during his virtual visit that companies like Proterra were "going to end up owning the future." Biden also promised the company he would return for an in-person visit in the near future.

The White House says Granholm, who has been given a major role in both crafting and selling the infrastructure package, played no role in planning the visit to Proterra. Granholm resigned from the company's board but has yet to divest her up to $5 million in the company, which was acquired for $1.6 billion this January.

Sen. John Barrasso (R., Wyo.), the ranking member of the Senate Energy and Natural Resources Committee, has asked the Department of Energy's inspector general to investigate any conflicts of interest created by Granholm's stake in Proterra.

Barrasso pointed in the letter to assurances made by Granholm during her confirmation hearing that she would not only resign from Proterra but also recuse herself from any issue with an "effect on the financial interests of Proterra" until fully divested. Biden has since used an executive order to place Granholm in charge of "identifying risks in the supply chain for high-capacity batteries, including electric-vehicle batteries, and policy recommendations to address these risks."

"Secretary Granholm leads the Department of Energy, which plays a central role in the nation's development of electric vehicles, batteries, and charging infrastructure," Barrasso said.

Bill Gates, China, 23andMe, and Your DNA

Recent reports reveal that a Chinese company with connections to the Gates Foundation is involved in COVID-19 testing and poses a potential threat to American privacy, particularly the medical and health data of those who have been tested for COVID-19.

In late January, CBS’ 60 Minutes reported:

“60 Minutes has learned Chinese company BGI Group, the largest biotech firm in the world, offered to build COVID labs in at least six states, and U.S. intelligence officials issued warnings not to share health data with BGI.

The largest biotech firm in the world wasted no time in offering to build and run COVID testing labs in Washington, contacting its governor right after the first major COVID outbreak in the U.S. occurred there. The Chinese company, the BGI Group, made the same offer to at least five other states, including New York and California, 60 Minutes has learned. This, along with other COVID testing offers by BGI, so worried Bill Evanina, then the country’s top counterintelligence officer, that he authorized a rare public warning.”

“Foreign powers can collect, store and exploit biometric information from COVID tests” declared the notice. Evanina believes the Chinese are trying to collect Americans’ DNA to win a race to control the world’s biodata.”

Evanina said a foreign entity could learn about a person’s current or future medical conditions by studying their DNA and using this information to gain a monopoly over necessary drugs and treatments.

BGI Group declined to be interviewed by 60 Minutes and said the idea that Americans genomic data has been compromised by BGI is “groundless”.

Concerns around BGI also arose in late January when Reuters reported that more than 40 publicly available documents and research papers show BGI’s links to the People’s Liberation Army (PLA). Reuters said the research dealt with topics as varied as mass testing for respiratory pathogens to brain science.

The Gates Foundation and BGI

In March, journalist Natalie Winter of National Pulse uncovered documentation of a relationship between the Bill and Melinda Gates Foundation and BGI going back nearly a decade. Winter found a Memorandum of Understanding (MOU) between the Gates Foundation and BGI to “form a collaboration on global health and agricultural development with the goal of achieving common objectives in health and agricultural development.”

Specifically, this collaboration deals with developments in human, plant, and animal genomics, the study of DNA. In the press release for the MOU, the co-founder of BGI directly mentions the partnership as focused on genomics.

“BGI looks forward to partnering with the Bill & Melinda Gates Foundation in this significant collaboration to apply genomics research to benefit global human health,” said Dr. Huanming Yang, Chairman and Co-Founder of BGI.

Bill Gates also visited BGI headquarters in 2010, according to a report from the Financial Times. The Times stated that BGI “is working towards a goal of building a huge library based on the DNA of many millions of people.” BGI’s goal is to use this information for new drugs, genetic research, and “transforming public health policy”.

It would appear the COVID-19 crisis has helped BGI and the Gates Foundation step into the role of influencing and transforming international health policy.

Winter’s report also notes that:

“the Gates Foundation has also funded BGI projects relating to genome sequencing alongside Chinese Communist Party bodies such as the Ministry of Science and Technology and Academy of Agricultural Sciences.

Similarly, Dr. Tadataka Yamada, the former president of the Bill & Melinda Gates Foundation’s global health program, serves as the Chairman of BGI’s Scientific Advisory Board.”

It’s clear that BGI Group and the Gates Foundation have a documented relationship over the last the decade. It’s equally apparent that BGI Group has an extensive relationship with the Chinese military and government. It is these connections – the relationship that exists between the Chinese government, the BGI Group, and the Gates Foundation – which has sparked fears regarding the potential misuse for the COVID-19 tests manufactured by BGI.

BGI and the DNA Testing Industry

Since March 2020, BGI has sold millions of their COVID-19 test kits around the world, including the United States, Europe, and Australia. Reuters reports that shares of BGI Genomics Co. have doubled in the last year, giving BGI a market value of around $9 billion USD.

Judicial Watch is investigating a race-based, taxpayer funded reparations program instituted by the City of Evanston, Illinois which allocates $10 million to provide Black/African-American residents or their descendants with a $25,000 reparation payment. Judicial Watch President Tom Fitton has described the program, which excludes all other residents or direct descendants of residents, as having “self-evident” moral and legal issues. The program, as he continues, is part of a broader effort on the part of the Left to “destroy this country using the crucible … of racial division.”

Describing it as an “extremist policy,” Fitton noted that as “a government program that provides taxpayer money to individuals based on race, [reparations], plainly violates the law.”

As Fitton further observed, “is one payment enough? How does that fix the legacy of racism if that’s what they’re truly concerned about? The equivalent of a stimulus check? How much money is it? And is it ever going to be enough money?” Regardless of the thinking behind reparations, Judicial Watch has filed a lawsuit and asked for records from the City of Evanston to find out more about what appears to be a “racially abusive” program. BRUSSELS, April 29. /TASS/. The European Parliament has approved the resolution on Russia with calls for sanctions against the Nord Stream 2 gas pipeline project, Rosatom nuclear corporation, ‘Russian oligarchs’ and disconnection from SWIFT. 569 members of the European Parliament voted for approval of the resolution, with 67 against the approval.

The European Parliament "Demands that the EU should reduce its dependence on Russian energy, and urges the EU institutions and all Member States, therefore, to stop the completion of the Nord Stream 2 pipeline and to demand a stop to the construction of controversial nuclear power plants built by Rosatom," the document says.

It "underscores that if such a military build-up [on the border with Ukraine-TASS] were in the future to be transformed into an invasion of Ukraine by the Russian Federation, the EU must make clear that the price for such a violation of international law and norms would be severe; insists, therefore, that in such circumstances imports of oil and gas from Russia to the EU be immediately stopped, while Russia should be excluded from the SWIFT payment system, and all assets in the EU of oligarchs close to the Russian authorities and their families in the EU need to be frozen and their visas cancelled," the resolution notes.

The European Parliament also "underlines that EU Member States should no longer be welcoming places for Russian wealth and investments of unclear origin; calls on the Commission and the Council to increase efforts to curb the Kremlin’s strategic investments within the EU for the purposes of subversion, undermining democratic processes and institutions, and spreading corruption; continues to insist that Member States such as Cyprus, Bulgaria and Malta must abandon their ‘golden passport’ regimes," according to the document.

This resolution of the European Parliament, just like all others, is advisory by nature and is not binding on EU institutions.

Trump hits McConnell again, saying GOP needs new leadership

Former President Trump on Thursday renewed his feud with Senate Minority Leader Mitch McConnell (R-Ky.) by calling for Senate Republicans to find a new leader ahead of the midterm elections, suggesting doing so would boost their chances of taking back the upper chamber next year.

Asked by Fox Business’s Maria Bartiromo how Republicans will fare in the 2022 elections, Trump said he expects GOP candidates to do very well but said the party needs new leadership in the Senate.

“I think we’re going to do very well. We need good leadership. Mitch McConnell has not done a great job, I think they should change Mitch McConnell,” Trump said during an hourlong interview Thursday morning.

But Trump said his own support of GOP candidates would help Republicans win back Congress.

Most Senate Republicans remain solidly unified behind McConnell and have repeatedly defended the GOP leader from Trump’s attacks.

No Republican senator has stated any desire to challenge McConnell, whom many GOP lawmakers view as one of the smartest tacticians in Washington.

Trump highlighted his work with House Minority Leader Kevin McCarthy (R-Calif.), who traveled to Trump’s Palm Beach resort in January to meet with the former president.

“I’m working in conjunction with Kevin McCarthy and the group and I think we’re going to take back the House,” he said.

McConnell, by contrast, hasn’t spoken to Trump since mid-December and rarely invokes the former president by name after denouncing him on the Senate floor in February for inciting an unruly mob of supporters to storm the Capitol on Jan. 6. McConnell, however, did not vote to convict Trump on a House-passed article of impeachment accusing him of inciting an insurrection.

Trump ripped McConnell afterward in a lengthy statement that warned “the Republican Party can never again be respected or strong with political ‘leaders’ like Sen. Mitch McConnell at its helm.”

He declared if “Republican senators are going to stay with him, they will not win again.”

Trump took another shot at the GOP leader at a fundraising event at Mar-a-Lago earlier this month, ripping him as a “dumb son of a bitch” and a “stone-cold loser.”

McConnell tried to put the feud to rest when asked about Trump’s attacks.

“What I’m concentrating on is the future and what we are confronted with here is a totally left-wing administration, with a slight majority in the House, a 50-50 Senate trying to transform America into something no one voted for last year,” McConnell told reporters earlier this month.

Two Year Old Baby Died Within Six Days Of Taking Second Shot Of Pfizer Vaccine In Clinical Trials On Children

A two year old baby has died within six days of taking the second shot of the Pfizer COVID-19 vaccine in the ongoing experimental clinical trials on more than 10,000 children under the age of 5 to 11.

Pfizer and Moderna are going through clinical trials for their mRNA shots on more than 10,000 children as young as six months old. The trials of these vaccines started in mid-March.

Lynam registered her two teenage daughters for clinical trials of Pfizer. She enrolled her six year old daughter for clinical trial of Moderna.

Clinical Research Partners in Richmond, Virginia is facilitating the guinea pig trial of children by Moderna in the state.

There is very low possibility that people would know about any negative results of these trials. However, the Vaccine Adverse Event Reporting System (VAERS) provide an insight on the effects of the experimental mRNA shots on these children.

A two-year-old girl received her second (Dose 2) experimental Pfizer mRNA shot on February 25. She apparently developed some sort of serious adverse reaction on March 1. The baby was dead on March 3. No further details were provided.

On April 29, the Kurdistan Workers’ Party (PKK) announced that his fighters had attacked a secret Turkish base near the village of Sheladize in the Iraqi Kurdistan Region.

15 arrests across the Capital Region for human trafficking

CAPITAL REGION, NY (WRGB) — “The threat of human trafficking is here in the Capital Region,” said FBI Assistant Special Agent in Charge Peter Magnetto.

During a four-day period last week, 15 people were charged in a human trafficking operation.

The sting netted arrests in 4 of our local counties.

“So in the capital region alone right, you had Albany County, Saratoga County, Schenectady County, Rensselaer County all affected by this threat of human trafficking,” said Magnetto.

Magnetto says dozens of agencies were involved including the Child Exploitation and Human Trafficking Task Force from the Albany Division of the FBI, State Police Troop G, local law enforcement, and district attorneys.

“Over that four day span, we certainly had upwards of nearly 100 different law-enforcement professionals working on this,” he said.

Magnetto says out of these 15 people who were arrested by State Police, the FBI was able to bring a federal charge against one man a few days later.

25 year old Bradley Boisen of Waterford appeared in court this week on a charge that he attempted to pay $60 to an adult in order to have sex with a 14 year old child.

Magnetto says that arrest highlights the importance of their task force bringing multiple different agencies together.

“It allows us to be flexible to bring folks to justice no matter what the crime is or where the best fit is to prosecute it, that model allows us to go out and make an impact on the threat.”

The Fugitive Apprehension Unit arrested five individuals in Mathis for Trafficking of Persons Under 18 Years of Age and Sexual Assault of a Child.

These arrests stem from an investigation conducted by the Human Trafficking Unit. This case was received as a tip from the Polaris National Hotline, as well as a request for investigative assistance from the Mathis Police Department regarding a minor that made multiple outcries of being trafficked.

During the course of the sex trafficking investigation, it was determined that Viviana Rivas trafficked the child to Francisco Silvas, who sexually assaulted her for the payment of narcotics.

A separate offense occurred when Jason Morales arranged for the child to travel to his residence for the use of narcotics, where she was subsequently sexually assaulted by Michael Bentancur and Manuel Caranza Jr. During the assault, Bentancur displayed a weapon to the victim.

Massachusetts Woman Pleads Guilty to Drug Trafficking

CONCORD – Arnetta Harris, 60, of Fitchburg, Massachusetts, pleaded guilty in federal court on Tuesday to one count of aiding and abetting the distribution of a controlled substance, Acting United States Attorney John J. Farley announced today.

According to court documents and statements made in court, on April 14, 2018, Harris sold crack cocaine to another individual who in turn sold the crack cocaine to an undercover officer. Shortly after the sale, officers conducted a traffic stop of the vehicle Harris was driving and a search revealed crack cocaine in a DVD case located in the footwell of the car. After her arrest, Harris admitted that she drove another individual to conduct the drug transaction. She further confirmed the DVD case was used in the drug transaction.

Harris is scheduled to be sentenced on August 31, 2021.

Harris is one of eleven individuals charged in this drug trafficking case. All have pleaded guilty. Several members of the conspiracy have received substantial prison sentences. Melvin Nooks, Jr. was sentenced on April 2, 2020, to 120 months. George Cruz was sentenced on July 30, 2020, to 63 months. Mallory Nooks was sentenced on February 25, 2020, to 60 months. Marvin Morrison was sentenced on May 13, 2020, to 15 months. Don Johnson was sentenced on February 13, 2020, to 42 months. Isaiah Kinard pleaded guilty on December 18, 2019, Lawrence Fortenberry pleaded guilty on January 7, 2020, William Greenleaf pleaded guilty on January 14, 2020, and Melvin Stanford pleaded guilty on April 9, 2021. They are all awaiting sentencing.

“Drug trafficking endangers public health and safety in our communities,” said Acting U.S. Attorney Farley. “Working closely with our law enforcement partners, we are targeting the organizations that distribute dangerous drugs in Nashua and throughout the Granite State. While this organization has been dismantled, we continue to work each day to identify and target other criminal organizations that threaten our citizens.”

“Arnetta Harris and her criminal cohorts thought they were above the law and could traffic crack cocaine in the neighborhoods of Nashua without getting caught. The hard work of the NH Safe Streets Gang Task Force in dismantling this organization and disrupting the flow of dangerous drugs to our area has paid off, but there is much more work to be done to ensure that other criminal enterprises don’t try to fill the void left by this one,” said Joseph R. Bonavolonta, Special Agent in Charge of the FBI Boston Division.

The case was a collaborative investigation that involved the FBI New Hampshire Safe Streets Gang Task Force; the Nashua Police Department; the New Hampshire State Police; the Manchester Police Department; New Hampshire Probation and Parole; DEA; Massachusetts State Police Department; Portsmouth Police Department and the Federal Protective Service. Federal Charges Brought Against Four Madera Men for Trafficking Fentanyl and Methamphetamine

FRESNO, Calif. — A federal grand jury indicted three Madera residents today, charging Emilio Hernandez Yesca, 27; Jorge Perez, 24; and Jorge Luis Hernandez Gonzalez, 30, with trafficking fentanyl and methamphetamine, Acting U.S. Attorney Phillip A. Talbert announced.

An associate of the trafficking ring, Eli Quiroz Hernandez, 26, also of Madera, was indicted in a related case on April 1.

According to court documents, the charges arose out of a months-long investigation into a drug trafficking organization. At the center of the organization were Hernandez and Perez. Between October 2020 and March 2021, the two conspired to distribute thousands of fentanyl pills and pounds of methamphetamine. As part of their plan, they sold 1,400 fentanyl pills in two separate drug deals in October and November 2020. Then, in February 2021, they sold a pound of methamphetamine. On March 2, law enforcement stopped the drug-dealing partners in a vehicle on their way to deliver 5,000 fentanyl pills and 3 pounds of methamphetamine. A loaded firearm was found under the driver’s seat of the car. The two other defendants are charged with selling methamphetamine: Eli Quiroz Hernandez sold a quarter pound of methamphetamine on December 10, 2020, and Jorge Gonzalez distributed a pound of methamphetamine in February 2021.

This case is the product of an investigation by Homeland Security Investigations, the Drug Enforcement Administration, the Madera County Sheriff’s Office, the California Highway Patrol, the California Department of Corrections and Rehabilitation, the Chowchilla Police Department, the Madera Police Department, and the Madera Narcotics Enforcement Team. Assistant U.S. Attorney Justin J. Gilio is prosecuting the case.

If convicted of the charged offenses, Perez, Hernandez and Gonzalez each face a statutory mandatory minimum penalty of 10 years in prison up to a maximum of life in prison, and a $10 million fine. Eli Quiroz Hernandez faces a statutory mandatory minimum penalty of five years in prison up to 40 years in prison, and a $5 million fine. Any sentence, however, would be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines, which take into account a number of variables. The charges are only allegations; the defendants are presumed innocent until and unless proven guilty beyond a reasonable doubt.

This effort is part of an Organized Crime Drug Enforcement Task Forces (OCDETF) operation. Former National Guard Member Pleads Guilty to Using the Internet to Commit Sexual Exploitation Offenses While Stationed in Qatar

SACRAMENTO, Calif. — Jaziz Jesahias Cea, 23, formerly of Galt, pleaded guilty today to transportation of child pornography and receipt of child pornography, Acting U.S. Attorney Phillip A. Talbert announced.

According to court documents, Cea used internet communications platforms and social media to commit the offenses. In particular, on May 13, 2018, Cea uploaded to his YouTube channel child pornography videos showing prepubescent girls being abused by adult males. Cea also separately used his Skype account to receive child pornography videos depicting prepubescent minor females being sexually exploited, to share links to such material, and to communicate with others about his interest in sexually exploiting children.

Between September 2017 and July 2018, Cea was a member of the California National Guard serving on active duty with the United States Army in Qatar. He was discharged from the California National Guard on July 23, 2020, under other than honorable conditions.

This case is the product of an investigation by the Federal Bureau of Investigation, the Sacramento County Sheriff’s Office, the Sacramento Internet Crimes Against Children (ICAC) Task Force, and the Galt Police Department. Assistant U.S. Attorneys Rosanne Rust and Christina McCall are prosecuting the case.

Cea is scheduled to be sentenced by U.S. District Judge Morrison C. England Jr. on July 22. The two counts to which Cea pleaded guilty carry a mandatory minimum five-year prison sentence, a maximum sentence of 20 years in prison, and a fine of up to $250,000 for each count. The actual sentence, however, will be determined at the discretion of the court after consideration of any applicable statutory sentencing factors and the Federal Sentencing Guidelines, which take into account a number of variables.

This case was brought as part of Project Safe Childhood, a nationwide initiative launched in May 2006 by the Department of Justice to combat the growing epidemic of child sexual exploitation and abuse. Led by the United States Attorneys’ Offices and the Criminal Division’s Child Exploitation and Obscenity Section, Project Safe Childhood marshals federal, state, and local resources to locate, apprehend, and prosecute those who sexually exploit children, and to identify and rescue victims. Grovetown, Ga., man sentenced to federal prison for possession of child pornography

Illegal images discovered during GBI investigation

AUGUSTA, GA: A Grovetown, Ga., man has been sentenced to nearly six years in federal prison after admitting to possession of child pornography.

Johnathan Malone, 23, of Grovetown, was sentenced to 68 months in prison by U.S. District Court Chief Judge J. Randal Hall after pleading guilty to one count of Possession of Child Pornography, said Acting U.S. Attorney David H. Estes. He also was ordered to pay a total of $21,000 in restitution to victims in the case. After completion of his prison sentence, Malone will be required to serve 25 years of supervised release, and register as a sex offender.

There is no parole in the federal system.

“Protection of our most vulnerable citizens is essential for a safe and secure society,” said Acting U.S. Attorney Estes. “Our law enforcement partners perform outstanding work in monitoring cyber networks to protect children from exploitation – and hold accountable those who do them harm.”

As described in court documents and testimony, the Georgia Bureau of Investigation (GBI) received information from the National Center for Missing and Exploited Children that led to the execution of several search warrants. Agents found hundreds of images and videos of child pornography on devices belonging to Malone.

“The GBI will continue to work tirelessly to protect innocent child victims of online exploitation,” said GBI Director Vic Reynolds. “We are grateful for the relationships we maintain with our federal partner agencies to bring these offenders to justice.”

The cases were investigated by the GBI, and prosecuted for the United States by Assistant U.S. Attorney and Project Safe Childhood Coordinator Tara Lyons.

Ghislaine Maxwell pictured for the first time behind bars — with a bruise

An attorney for Ghislaine Maxwell on Thursday released the first photograph of the accused madam since she was arrested last summer, showing the former socialite with a wrinkly face and a bruise under her eye.

The photo of Maxwell was included in a letter filed in her Manhattan federal criminal case by her attorney Bobbi Sternheim, who wrote that the apparent injury has caused friction between her and guards at the jail, the Metropolitan Detention Center in Brooklyn.

“Last night, she was confronted by MDC staff due a visible bruise over her left eye,” Sternheim wrote in the letter.

“No guard addressed the bruise until Ms. Maxwell, who has no mirror, caught a reflection of her aching eye in the glean of a nail clipper. At that point, MDC staff confronted Ms. Maxwell regarding the source of the bruise, threatening to place her in the SHU if she did not reveal how she got it,” she added, referring to the special housing unit.

Sternheim added that guards at the MDC put inmates in the special housing unit if they’ve been injured in the jail or subjected to abuse by other inmates.

But Maxwell’s attorneys believe she got the bruise because she’s forced to cover her eyes with a sock or towel every night because guards shine lights in her cell every 15 minutes.

Maxwell is awaiting trial for sex trafficking and other charges related to her allegedly procuring underage girls for Jeffrey Epstein to abuse in the 1990s and early 2000s.

She has pleaded not guilty and faces trial this summer.

Correctional officer sentenced for sexual abuse of a ward, accepting bribes and smuggling contraband into the Northeast Ohio Correctional Center

Acting U.S. Attorney Bridget M. Brennan announced that Barbara Davis, 47, of Youngstown, Ohio, was sentenced to five months imprisonment and five months of home confinement by U.S. Judge Sara Lioi. Davis, a former Northeast Ohio Correctional Center (NEOCC) correctional officer, pleaded guilty in January of 2021 to sexual abuse of a ward, accepting bribes and providing a cell phone and tobacco to an inmate.

“Exploiting a position of trust by sexually abusing an inmate and receiving bribe payoffs for smuggling contraband into a correction center threatens to undermine the public’s trust in our criminal justice system,” said Acting U.S. Attorney Bridget M. Brennan. “Let this matter be a reminder to the public that anyone who seeks to harm and exploit inmates or detainees can and will be held accountable.”

“Davis sexually abused an inmate and accepted bribes for smuggling contraband into a federal prison. Today’s sentencing shows that when correctional officers abuse their authority, the Department of Justice Office of the Inspector General will ensure they are held accountable,” said William J. Hannah, Special Agent in Charge of the Department of Justice Office of the Inspector General Chicago Field Office.

According to court documents, from on or about November 13, 2017, to November 7, 2018, Davis engaged in sexual conduct with an inmate at the NEOCC. During this same time, Davis smuggled contraband, specifically a cell phone and tobacco, to the inmate at the NEOCC. In return, Davis received payments made from other parties through a mobile payment application.

This investigation was conducted by the Cleveland Federal Bureau of Investigation and Department of Justice, Office of the Inspector General. This case was prosecuted by Assistant U.S. Attorney Justin Seabury Gould.

As far as I know, this story is being broken right here. Following is a guest post from a reliable source, with personal knowledge of the situation, who wishes to remain anonymous:

For reasons not totally known at this point, the Carmelite Sisters of Philadelphia have abruptly abandoned their monastery.

According to sources close to the monastery, the sudden move took place over this past weekend. On Friday, after the daily Mass, a van was noticed by the entrance to the monastery used by the cloistered sisters. Later that day, word began to spread that the sisters had suddenly departed. The sisters were reportedly driven to another Carmelite monastery in Valparaiso, Nebraska. One elderly sister is said to have remained behind in Philadelphia but all of the others, believed to be 15 young Carmelites who arrived in 2017, have all departed.

The Philadelphia Carmel of Jesus, Mary, Joseph and Anne was established in 1902, less than five years after the death of St. Therese of Liseux. It has been a treasure for the Archdiocese of Philadelphia and for the nation. By the early 21st century, faced with a shortage of sisters, the fate of the monastery was in question. Then in 2017, former Archbishop Charles Chaput welcomed a branch of traditionalist Carmelites to Philadelphia and they accepted. These new arrivals were mostly younger women coming from Nebraska as well as another monastery in Pennsylvania.

With the departure of these 15 Carmelites over the weekend, and the recent deaths of most of the original sisters in Philadelphia, the beloved monastery is left with just one elderly sister and an uncertain future. The Archdiocese of Philadelphia has not yet addressed what happened. Catholics in the Philadelphia Archdiocese learning about the departure are devastated. The presence of a Carmelite Monastery is considered to be an honor and a blessing to have within a diocese. Historically, the Carmelites have been major drivers of the Faith and have had, amongst their sisters: St. Therese of Liseux and St. Theresa of Avila – both revered saints and Doctors of the Church. In fact, first class relics of St. Therese of Liseux and her family are in residence at the Philadelphia monastery. During the French Revolution, it was the martyrdom of the Carmelites that ended the Reign of Terror. The Brown Scapular is a noted devotion within the order and with lay Catholics.

Unlike many orders of Religious Sisters, the Traditional Carmelites have been flourishing with vocations in recent years making their departure from Philadelphia especially tragic. Locally, four young women are known to have joined the Traditional Carmelites in Philadelphia since 2017 with others that were in formation.

*While we don’t know the reason for the developments in Philadelphia, it is hard not to recall a recent document issued by the Vatican – Cor Orans – targeting communities of contemplative nuns which is what the Carmelites are. Cor Orans instructs monasteries to belong to a “federation of monasteries”, tied together with a similar charism or shared geographical location. This basically erodes the autonomy of individual monasteries operated by individual orders such as the Carmelites. In addition, the length of formation for new nuns, previously six years for Carmelites became nine to twelve years under Cor Orans, which is an impediment to new vocations. Another requirement of Cor Orans is a “religious assistant,” a priest monitoring the monastery in addition to a chaplain, assigned by the federation. This further erodes the monasteries’ autonomy by giving unprecedented powers to the “religious assistant.”

This is Mark again. I contacted the communications office of the archdiocese for a statement, but neither my call nor email were immediately returned. I’m withholding judgment on the matter until we find out more information. I was physically present at the cloister the day the FSSP arrived there in 2017. Trust me, it’s a special place. The FSSP were consequently given a mission just outside the city, at a beautiful large church in Conshohocken. I do hope they’re not next. The only other access to the traditional sacraments in the entire five-county metro is the SSPX outpost in Eddystone, which isn’t even a full time parish. The priest drives down from Connecticut for the weekends, and their chapel holds fewer than a hundred faithful.

Following his arrest, feds would then have asked a grand jury to indict him. This contingency plan did not materialize as the jury found him guilty on all charges - 2nd-degree murder, 3rd-degree murder and 2nd-degree manslaughter. The DOJ is now planning to indict him and the three other cops involved in Floyd's death on civil rights charges, a source said. Chauvin is to be indicted over both Floyd's death and a 2017 incident where he knelt on a black 14-year-old boy's neck for nearly 17 minutes. J. Alexander Kueng, Thomas Lane and Tou Thao to be indicted over Floyd's death. They face trial together on August 23 on state charges of aiding and abetting second-degree murder and manslaughter.

SAP Admits to Thousands of Illegal Exports of Its Software Products to Iran and Enters Into Non-Prosecution Agreement with DOJ

BOSTON – SAP SE, a global software company headquartered in Waldorf, Germany, has agreed to pay combined penalties of more than $8 million as part of a global resolution with the Departments of Justice, Commerce, and the Treasury.

In voluntary disclosures the Company made to the three agencies, SAP acknowledged violations of the Export Administration Regulations and the Iranian Transactions and Sanctions Regulations. As a result of its voluntary disclosure to DOJ, extensive cooperation, and remediation costing more than $27 million, United States Attorney’s Office for the District of Massachusetts and DOJ’s National Security Division entered into a Non-Prosecution Agreement with SAP. Pursuant to that agreement, SAP will disgorge $5.14 million of ill-gotten gain.

Beginning in approximately January 2010 and continuing through approximately September 2017, SAP, without a license, willfully exported, or caused the export, of its products to Iranian users. SAP’s violations occurred in two principle ways.

First, between 2010 and 2017, SAP and its overseas partners released its U.S-origin software, including upgrades, and/or software patches more than 20,000 times to users located in Iran. SAP senior management was aware that neither the Company nor its U.S.-based Content Delivery Provider used geolocation filters to identify and block Iranian downloads, yet for years the Company did nothing to remedy the issue. The vast majority of the Iranian downloads went to 14 companies, which SAP Partners in Turkey, United Arab Emirates, Germany, and Malaysia knew were Iranian-controlled front companies. While this conduct constituted serious violations of U.S. law involving the release of U.S. origin technology and software through cloud servers and online portals, this Non-Prosecution Agreement recognizes the importance of voluntary self-disclosure and cooperation with the government. DOJ and the District of Massachusetts reached this resolution with SAP based upon its voluntary self-disclosure as well as SAP’s extensive internal investigation and cooperation over a three-year period. During this time, SAP worked with prosecutors and investigators, producing thousands of translated documents, answering inquiries, and making foreign-based employees available for interviews in a mutually agreed upon overseas location. AP also timely remediated and implemented significant changes to its export compliance and sanctions program, spending more than $27 million on such changes, including, among other things detailed in the NPA: (1) implementing GeoIP blocking; (2) deactivating thousands of individuals users of SAP cloud based services based in Iran; (3) transitioning to automated sanctioned party screening of its CBGs; (4) auditing and suspending SAP partners that sold to Iran-affiliated customers; and (5) conducting more robust due diligence at the acquisition stage by requiring new acquisitions to adopt GeoIP blocking and requiring involvement of the Export Control Team before acquisition.

Concurrently with this agreement, SAP is entering into Administrative Agreements with the Department of Commerce, Bureau of Industry and Security (“BIS”) and the Department of the Treasury, Office of Foreign Assets Control (“OFAC”). Among other things, the BIS settlement agreement requires SAP to conduct internal audits of its compliance with U.S. export control laws and regulations, and produce audit reports to BIS for a period of three years.

'Antifa' issues veiled death threat against Portland Mayor Ted Wheeler in alarming video

A person purporting to represent Antifa has reportedly targeted Portland, Oregon, Mayor Ted Wheeler (D) after he issued a plea for the community to assist in "unmasking" rioters and members of Antifa.

Just last week, Wheeler asked the public to identify any violent or destructive demonstrators as riots have continued to erupt across the city for more than a year.

What are the details?

According to a Thursday report from PJ Media, a person purporting to represent Antifa threatened Wheeler in a video shared Wednesday night.

In the video, a masked person threatens the Democratic mayor and even goes as far as to publish Wheeler's home address.

The person concluded, "Ted, we are asking for the last time that you resign. If you ignore this message outright, the destruction to your precious way of life is going to escalate. Blood is already on your hands, Ted. The next time, it may just be your own."

Jim Middaugh, a spokesman for the mayor, said that he and his office learned of the video Wednesday evening.

Middaugh added that the city's police bureau also notified the Federal Bureau of Investigation.

"Middaugh said the mayor's office has seen a dramatic uptick in messages following the press conference, most of them critical of Wheeler and the remarks he made," the outlet reported. The American Civil Liberties Union of Oregon condemned Wheeler's request in a statement.

Lawmakers call for IG's removal: 'the only thing this watchdog appears to hunt is her own employees'

"She should be removed from office, in a manner consistent with applicable statutory notification requirements," Sens. Grassley and Johnson wrote in an April 28 letter to President Biden. Sens. Chuck Grassley and Ron Johnson are calling for Federal Housing Finance Agency (FHFA) Inspector General Laura Wertheimer to be ousted from office. "Her behavior certainly falls far short of your calls for unity, transparency, and integrity. To put it mildly, the only thing this watchdog appears to hunt is her own employees," the Republican lawmakers wrote in an April 28 letter to President Biden. "She should be removed from office, in a manner consistent with applicable statutory notification requirements," they said. The two senators noted that they have previously received whistleblower complaints about Wertheimer, and they also highlighted the finding of the Council of Inspectors General on Integrity and Efficiency's (CIGIE) Integrity Committee (IC) that Wertheimer had engaged in misconduct.

"The IC's report is long anticipated, following a series of separate letters from our offices to various governmental bodies requesting documents, evidence, and interviews. Those letters include requests from 2017 to the Office of Special Counsel and the IC to investigate allegations brought to us by multiple whistleblowers of misconduct by the IG," the lawmakers wrote in their letter to Biden. "IG Wertheimer was nominated by then-President Obama and confirmed by the Senate in September of 2014. Just over a year later, in October 2015, we began investigating whistleblower allegations," they wrote. In a letter to President Biden, Integrity Committee chair Kevin Winters noted: "After thoroughly reviewing the evidence and responses, the IC finds by a preponderance of the evidence that IG Wertheimer abused her authority in the exercise of her official duties and engaged in conduct that undermines the integrity reasonably expected of an IG. In particular, the IC finds that IG Wertheimer showed a disdain and resistance towards Congressional and IC oversight by fostering a culture of witness intimidation through a pattern of staff abuse and fear of retaliation. Furthermore, she wrongfully refused to cooperate with the IC's investigation by denying IC investigators full access to FHFA OIG personnel and documents." The letter from Winters also stated: "The IC concludes that misconduct of this nature warrants consideration of substantial disciplinary action, up to and including removal."

Oregon city issues emergency declaration to fight liberal governor's COVID edicts. Now other local governments are asking them how they did it.

The state of Oregon suffers a problem similar to its neighbor to the north, Washington. Much of the state — especially the east side — is conservative but is dominated by the hard-core liberalism of its biggest urban center in the northwest corner. For Washington it's Seattle. For Oregon it's Portland.

Because of the left's power, the Democratic governors of those states have been emboldened to push pandemic restrictions, mask mandates, and health edicts upon their subjects.

Oregon Gov. Kate Brown (D) ordered all indoor dining to stop, forced gyms and entertainment activities to be shuttered, closed outdoor recreation, required businesses to mandate work-from-home and close offices to the public, limited churches to 25 people, kept kids out of school, told Oregonians to call the police to rat on neighbors who violate her lockdown orders, and even reportedly used CPS to retaliate against a salon owner for reopening early.

Last month, one Eastern Oregon city decided it had had enough and came up with a unique way to fight Brown's orders — and now other cities and counties are coming to its leaders asking how they did it.

What happened?

Immediately after Baker City Mayor Kerry McQuisten was sworn in to her first term on Jan. 12, business leaders began asking her for help fighting Brown's mandates, the mayor told PJ Media this week.

The push started with a discussion of how to make Baker City a "sanctuary city."

“After we were all sworn in back on January 12th, local businesses brought forth to [city] council an idea of a Common Sense Sanctuary City," McQuisten said. "The idea was pretty funny, actually. It was a good idea. They were asking for local businesses to be able to adhere, or not adhere to the mask mandates, the OSHA [Oregon Occupational Safety and Health Division] restrictions, as they saw fit individually."

The mayor told PJ Media that a town hall meeting on the issue showed how concerned her constituents were.

"Business owners poured in to give testimony," she said. "Some questioned whether the city could protect them from state OSHA regulations and targeting by these agencies."

As time went on, the discussions and meetings led to action. The city council sent a letter to Brown with their concerns and discussed a possible resolution.

They soon learned that would not be enough.

"After we got no response from the governor," McQuisten told PJ Media, "we brought forth the Emergency Declaration, and batted the language back and forth for a couple of weeks."

That led to the emergency declaration the city council passed March 23. The declaration cites Brown's "arbitrary, ineffective, and draconian" executive orders and the lack of legal ability the city has to "flout" the mandates, which keeps the municipality from defending local businesses.

It also notes that "that neither city, county nor state government has the legal right to flout the Oregon State Constitution or the United States Constitution" and that "our citizens are fully capable of making their private, individual healthcare and lifestyle decisions themselves."

The declaration also cites other negative impacts Brown's edicts have had and the legal dubiousness of the orders.

Italian Police Nabs Gang that Allegedly Trafficked Cocaine from Peru

Italian authorities ordered on Tuesday the preventive detention of 15 suspected members of an international gang believed to have imported cocaine from South America in cooperation with the ‘Ndrangheta, one of Italy’s four major mafia groups.

A court in Milan ordered the arrests of eight Peruvian and seven Italian citizens in the northern region of Pavia, while five gang members are believed to have left the country and are being traced by police, local law enforcement agencies said in a statement.

The cocaine made its way from Peru to northern Italy through Spain. It was supposed to be distributed by the clan across the regions of Lombardy and Calabria.
