Chairman Thompson and Members of the Committee:

We write in response to your letter dated August 26, 2021 asking 8kun to produce a broad range of

information related to โ€œ[m]isinformation, disinformation, and malinformation related to the 2020

election.โ€ Without doubt, it is the duty of all citizens to cooperate with congressional efforts to obtain

relevant facts needed for legislation. Equally so, it is incumbent upon Congress to respect the

constitutional rights of the witnesses it calls upon. To be more direct, the โ€œBill of Rights is applicable

to investigations as to all forms of governmental action.โ€1

8kun will respond to appropriate requests issued by this Committee. But as the Supreme Court

reminded Congress just last year, congressional investigatory and subpoena requests are valid only

when they are โ€œrelated to, and in furtherance of, a legitimate task of Congress and must serve a valid

legislative purpose.โ€2 Because of constitutional and pertinence concerns, we seek to narrow and better

identify the information this Committee would like produced.

  1. Introductory Constitutional Principles

Congress has sporadically wrestled with contentious issues of the day by means of investigatory

committees. Unfortunately, Congress also has a history of abusing that power through targeting

disfavored political actors and associations.3 This is forbidden by the First Amendment and the Due

Process Clause of the Fifth Amendment to the Constitution.

a. New Deal and โ€œUn-American Activityโ€ Analogues

The D.C. Circuit Court of Appeals and Supreme Court struck down congressional investigatory

attempts to chill political speech and association in U.S. v. Rumely. There, the New Deal Congress was

irritated with the conservative agitator Dr. Edward Rumely and the Committee for Constitutional

Government (โ€œCCGโ€). They organized business opposition to New Deal legislation, perhaps too

effectively.

5 The House Committee on Lobbying Activity demanded the names of anyone who

purchased books, pamphlets, or other literature from CCG.6 The D.C. Circuit found this inquiry to

be outside the power of Congress.7

The Court concluded the House Committee could never be constitutionally empowered to generally

investigate all aspects of lobbying. It could investigate particular abuses, particular people, particular

records, or particular criminal endeavors. But the First Amendment would forbid Congress from

examining, publicizing, or reporting the โ€œnames and addresses of purchasers of books, pamphlets and

periodicalsโ€ because that would serve as a โ€œrealistic interference with the publication and sale of those

writings.โ€8 The investigation into Rumely and CCG suffered from another malady: the congressional

mandate to investigate was flawed. Congressional desires to examine attempts to influence, encourage,

promote, or retard legislation or to influence public opinion are simply void under the First

Amendment.9

Courts have sometimes upheld limited inquiries where authorizing resolutions are sharply focused

about threats to overthrow the government. But the congressional power to investigate even serious

threats to overthrow the government is not limitless. In Watkins I, Congress stressed the urgency of

its need to root out domestic extremists and to โ€œbe informed of efforts to overthrow the Government

by force and violence so that adequate legislative safeguards can be erected.โ€10 But the Supreme Court

cautioned that broad congressional authorizations for investigations could produce disastrous results:

From this core, however, the Committee can radiate outward infinitely to any topic

thought to be related in some way to armed insurrection. The outer reaches of this

domain are known only by the content of โ€˜un-American activities.โ€™ Remoteness of

subject can be aggravated by a probe for a depth of detail even farther removed from

any basis of legislative action. A third dimension is added when the investigators turn

their attention to the past to collect minutiae on remote topics, on the hypothesis that

the past may reflect upon the present.

In short, congressional resolutions setting few boundaries on nebulous topics violate constitutional

norms.12

b. Constitutional Limits at Hand: Watkins II13

Forcing raucous businessmen of the 1930s or unorthodox platforms of the 2020s to answer questions

about the most nebulous of topicsโ€”the underlying causes of political violenceโ€”is an unworkable

congressional command. Worse yet, prying into intimate ideologies and thoughts is a serious censorial

chokehold. As courts have realized, the requirement that one reveal purchasers of books, pamphlets,

or papers marks the start of a surveillance state. And just as courts would not embrace a surveillance

state arising out of congressional investigations in the past, so too is this approach inappropriate today.

Compelling online platforms to share information about users who posted about efforts to โ€œoverturn,

challenge, or otherwise interfere with the 2020 election or certification of electoral college resultsโ€

chills the First Amendment rights of millions of Americans who were concerned about electoral

integrity during the 2020 election. They have every bit as much a First Amendment right to peacefully

gather with others, exchange ideas, and let their discontent be known by public officials as Rumely and

CCG did.

14 Demanding that platforms produce mal-, mis-, or disinformationโ€”terms that are

undefined but that are usually euphemisms for speech the powers that be disagree withโ€”works an

equally pernicious chill against political speech in America. Once government is free to demand the

names of users espousing unpopular, unorthodox ideas, free speech and free press rights on the

internet disappear.

Like the problematic scope of inquiry in Watkins I, the present inquiries at hand here in โ€œWatkins IIโ€

are just as troubling. Where Congress sets out to investigate nebulous topics like โ€œsubversion and

subversive propaganda,โ€ unlimited โ€œinfluencing factorsโ€ behind the January 6 attack, or how misogyny

and racism might impact political violence, constitutional problems grow exponentially.

scope of this authorization is beyond Congressโ€™s power due to its invasion into protected First

Amendment rights and its failure to offer pertinent queries related to its otherwise legitimate

concernโ€”the spread of real political violence. Much like Rumely, particular queries focusing on

particular people, particular records, or particular criminal acts may be examined. Fishing expeditions

into the closely-held thoughts and beliefs of the American people rest beyond Congressโ€™s prying eyes.

The controversies surrounding the 2020 election, well settled within the Beltway, are hardly settled for

many Americans. Roughly one-third of Americansโ€”almost 110 million peopleโ€”believe that

President Bidenโ€™s 2020 victory was the result of widespread voter fraud.16 The First Amendment

encourages citizens to debate and talk about issues of self-governmentโ€”without fear of the

government collecting and pouring over their communications. As Congress continues in this

direction, some citizens will fear to espouse, and some will fear to read, messages that those in power

dislike. The million-fold eyes of Argus Panoptes become a reality by congressional fiat.17 The resulting

shadow the government will cast over online discussion that does not conform to the dominant partyโ€™s

narrative should frighten every American.

  1. Past Compliance with the Committee on Homeland Security

Mr. Watkins, as a representative of 8kun (formerly 8chan) freely appeared before the House

Committee on Homeland Security in September 2019 to address that committeeโ€™s concerns over the

proliferation of online extremist content. In doing so, 8kun produced relevant documents and Mr.

Watkins answered relevant inquiries about the siteโ€™s operations. We attach the submitted

โ€œCongressional Primer on 8chanโ€ for your reference as ADDENDUM A. Notably, 8kun included

more than fifty pages of voluntary interactions with law enforcement about particular criminal

investigations. Where requests are focused and particular and do not run afoul of constitutional norms,

8kun is enthusiastic to aid Congress and law enforcement in their operations. We hope we may be

equally helpful here.

  1. Clarification of Existing Requests

It is Mr. Watkinsโ€™s desire that we continue 8kunโ€™s practice of responding to lawfully issued requests

and to provide as much respectful cooperation with your committeeโ€™s investigation as the First

Amendment allows. However, the requests contained in your form letter dated August 26, 2021 are

an unworkable starting point for cooperation. For example, item 1 requests production of โ€œAll . . .

data . . . regarding your platform . . . .โ€ Even if this sentence is read in conjunction with the items

described in items โ€œi.โ€ through โ€œiv.,โ€ this request is so broad as to render compliance impossible.

Other form requests, such as requests for โ€œinternal or external reviews and reportsโ€ regarding 8kunโ€™s

โ€œalgorithmsโ€ seem misdirected. 8kun is a small organization and a relatively simple website. There are

no โ€œinternal or external reviewsโ€ nor are there website โ€œalgorithms.โ€ This is but an entrรฉe of errorsโ€”

the requests, as written, need substantial clarification and focus for 8kun to attempt cooperation.

Please contact Mr. McDonald at your convenience to discuss your requests and determine if there is

any specific information that the Committee is constitutionally empowered to seek and that Mr.

Afghanistanโ€™s Lesson: Reclaim America

 

Our corrupt elites have stolen the valor of American heroes. Time to take it back.

On the day suicide bombers killed 13 U.S. troops in Afghanistan, 18 American veterans died by suicide. On average, suicide claims the lives of that many veterans every day in the United States. If we count together veterans, active-duty troops, guardsmen, and reservists, that number jumps to roughly 20 a day. Our regime, in other words, is responsible for more deaths of more service members than any jihadist attack on American soil.

 

Is the United States worth dying for? The short answer is no; the long answer is yes. But if you ask Republicans who have shed the populist put-on and reverted to marching beneath the flag of neoconservatism, the answer is always and only yes. Side with them, they say, to save America because President Joe Biden, they cry, has made a mockery of the United States military specifically and its government generally. But Republicans would have no bloody shirt to wave were their palms not stained by the same gore now on Bidenโ€™s face. Both parties have created a regime that is not worth the price of blood spilled abroad.

 

Though they are out of power, for now, it was Republicans who drew us into these wars and refused to get us out of them. They turned September 11 into a cheap catchphrase but attempted to filibuster the James Zadroga 9/11 Health and Compensation Act. Named after the first New York Police Department officer to die of toxic chemical exposure at Ground Zero, the bill granted $4.3 billion for treatment services and medical benefits for first responders and survivors of 9/11. Republicans, then into the first decade of what would be a $2,000,000,000,000 war, whined about the Zadroga Actโ€™s cost. Democrats, of course, politicized the fundingโ€”but the GOP lost the basis for any principled opposition to โ€œBig Governmentโ€ spending when it signed Americans on to interminable foreign wars marked by corruption and waste.

 

Then the GOP did it again in 2015. Once again, Democrats politicized the money, and once more, Republicans allowed it to happen. This time, 9/11 survivors surrounded McConnellโ€™s office. โ€œItโ€™s absolutely disgusting that we have to keep on coming back down here and to keep on begging, itโ€™s like weโ€™re beggars,โ€ said Anthony Flammia, a retired police officer who stormed the World Trade Center on September 11.

 

Finally, in 2019, Donald Trump signed a bill that permanently reauthorized the September 11th Victim Compensation Fund. But deaths from 9/11-related diseases have eclipsed the number of Americans killed by terrorists that dayโ€”and veteran suicides already had every year from 2005 to 2018, according to Defense Department statistics. In 2020, data from the World Trade Center Health Program placed the number of deaths attributed to a variety of illness related to the attackโ€™s aftermath at 3,496.

 

The Department of Veterans Affairs graphed the rise and fall of these deaths as we wandered through the distant deserts. Suicides dramatically increased in 2007 during the Iraq War troop surge, when we sent more harbingers of โ€œwhite rageโ€ to fight for a government that does not care if they die.

Actually, on balance, their deaths, by enemy gunfire or self-inflicted gunshot, are counted as a net good on the regimeโ€™s abacus. As one Associated Press headline cheered at 2020 Census data: โ€œUS is diversifying, white population shrinking.โ€ Regime lackey Jennifer Rubin hailed the suicides and overdoses of rural whites as โ€œfabulous news,โ€ and propagandist Michael Moore called the day of the Census announcement the โ€œbest day ever.โ€

 

The regime sent off the sons of Appalachia to die in Afghanistan, chalked up their deaths as victories for diversity, and helped those who have survived to get hooked on poisonous opioids for the chronic pain of their battle wounds. But that was, to be sure, only the guarantee of a slower death, as veteransโ€™ rate of overdose deaths from all opioids increased by 65% from 2010 to 2016.

 

And while Democrats were elevating the likes of Representative Ilhan Omar, who dismissed 9/11 as the day โ€œsome people did something,โ€ conservative think tanks like the American Enterprise Institute took money to lie to the public about the addictiveness of Purdue Pharmaceuticalsโ€™ prized opioid, OxyContin, which by 2012 was prescribed to roughly 1 in 3 veterans.

 

Just last week, members of the Sackler family, who own Purdue Pharma, received immunity from future opioid lawsuits in a bankruptcy settlement. The Sacklers will keep the bulk of their fortunes made on the genocide of Middle America while AEI continues to rattle the saber of war, even as the national security apparatus is turned on Americans in a hunt for dissidents.

 

What was it all for? The spread of pedophilia by our Afghan โ€œalliesโ€? Their penchant for raping little boys, often on U.S. military bases, cost concerned American troops their careers when they could not look away. These are the people whose safety the oligarchic ruling class, no matter their party affiliation, seems to have prioritized over Americans.

 

Was it for the first Gender and Womenโ€™s Studies program at Kabul University? โ€œAccording to an USAID observer,โ€ The Spectator reported, โ€œthe gender ideology included in American aid routinely caused rebellions out in the provinces, directly causing the instability America was supposedly fighting.โ€ Did our troops ever see parallels back home between Americans and Afghans when police arrested parents at Virginia school board meetings for rebelling against the ideology of critical race theory? Of course, in Afghanistan, the United States kills children with airstrikes; Democrats and Republicans merely facilitate their chemical castration back home.

 

And yet, all this, believe it or not, has happened before. โ€œThe wild beasts that roam over Italy,โ€ the Roman tribune Tiberius Gracchus would say, โ€œhave every one of them a cave or lair to lurk in; but the men who fight and die for Italy enjoy the common air and light, indeed, but nothing else; houseless and homeless they wander about with their wives and children.โ€

 

โ€œAnd it is with lying lips that their imperators exhort the soldiers in their battles to defend sepulchers and shrines from the enemy,โ€ Tiberius concluded, โ€œfor not a man of them has an hereditary altar, not one of all these many Romans an ancestral tomb, but they fight and die to support others in wealth and luxury, and though they are styled masters of the world, they have not a single clod of earth that is their own.โ€ These words should sound familiar to Americans who feel alienated by the United States regime and its politicians who make hollow patriotic sounds.

 

The American people, and the tradition of self-government to which they still cling, remain valiant, admirable, and worth fighting for. But like the Roman veterans who labored under the depredations of their callous elites, Americans are now groaning beneath the heel of heedless, heartless rulers who value nothing so much as their own self-gratification. To reframe the original question: is the regimeโ€”the real, not ideal, established political orderโ€”worthy of Americansโ€™ love and blood? Not today. But it shouldโ€”and still couldโ€”be.

Biden Admin. Confronted By Decision To Work With Taliban

 

Members within the Biden administration are working to downplay the U.S. cooperation with the Taliban. During her briefing on Wednesday, Press Secretary Jen Psaki attempted to deny that the White House is close to recognizing the Taliban as a legitimate international authority.

 

โ€œFirst of all, no one in this administration, not the president nor anyone on the National Security team, would suggest that the Taliban are respected and valued members of the global community,โ€ she asserted. โ€œThey have not earned that in any way and we are not, we have never assessed that.โ€

 

In the same answer, however, Psaki explained to the bewilderment of the Press Corps that the U.S. government is indeed engaging with the group despite the fact the new Taliban government includes wanted terrorists. This includes their new Acting Interior Minister Sirajuddin Haqqani, leader of the Haqqani network, whoโ€™s wanted for a bombing that killed six people, including an American. Haqqani is also believed to have participated in cross-border attacks against U.S. troops.

 

โ€œWhat weโ€™re working to do is to engage with them because they oversee and control Afghanistan right now,โ€ she stated. โ€œTo get American citizens, legal, permanent residents, SIV applicants out of Afghanistan, we have to engage with them.โ€

 

Meanwhile in Germany, Secretary of State Antony Blinken also attempted to downplay any efforts made by the U.S. to engage with the terrorist group. He claimed any international legitimacy or any support from the U.S. would have to be earned by the Taliban. Blinken went into further detail about a problem the administration is having despite โ€œengagementโ€ efforts.

Another corporation involved in Chinaโ€™s real estate bubble is about to pop.

Yesterday the Bangkok Post reported:

 

Embattled Chinese property giant Evergrande on Wednesday suffered a second credit rating downgrade in two days, raising fears the worldโ€™s most indebted company will default and sending its shares tumbling below their listing price 12 years ago.

 

The Hong Kong-listed firm has run up a mountain of liabilities totalling more than $300 billion after years of borrowing to fund rapid growth and a string of real estate acquisitions as well as other assets including a Chinese football team.

 

This morning the situation is reportedly worse, this time reports out of Hong Kong show that China real estate giant, Evergrande, is in severe financial trouble due to its more than $300 billion in debt outstanding.

 

Shares in the embattled Chinese property giant Evergrande have slumped again after two credit downgrades in two days amid concerns that it will default on parts of its massive $300bn debt pile.

 

Evergrande, which is one of the worldโ€™s most indebted companies, has seen its shares tumble 75% this year. They fell by almost 10% on Thursday morning to HK$3.35, which is below the listing price when the company floated on the Hong Kong market in 2009.

 

Trading in one of the companyโ€™s bonds was suspended by the Shenzhen stock exchange on Thursday morning after the price plunged 20%.

 

The online market trading platform IG said Evergrande posed โ€œa risk of contagionโ€ after Bloomberg reported that Credit Suisse and Citibank were no longer accepting the bonds of another highly indebted Chinese property developer, Fantasia, as collateral.

 

Evergrande issues commercial paper (unsecured IOUโ€™s) to pay its debts. It happens to be the largest issuer of commercial paper in China with $305 billion in debt and it is in financial duress.

 

Evergrande is Chinaโ€™s largest issuer of commercial paper, unless something dramatic happens its on a direct path to bankruptcy.

 

It is $305 billion in debtโ€ฆ the trillion dollar question is this:

Biden Mandates COVID-19 Vaccine for All Federal Employees

 

As Joe Biden attempts to make good on his failed promise to crush COVID-19 and divert attention away from Afghanistan, heโ€™s just mandated vaccines for the one workforce he can.

 

Biden just signed an executive order requiring COVID-19 vaccines for all federal employees, with no option for people to take weekly tests instead. The order also applies to all workers contracting with the federal government. Itโ€™s unclear if there will be any religious exemptions.

 

This represents the latest not-at-all shocking case of Biden lying. Back in December 2020 Biden said that he wouldnโ€™t make vaccines mandatory for anyone as President.

 

If their record on Afghanistan is any indication, itโ€™s unlikely that the Biden administration thought through the ramifications of this. Are they prepared to fire a sizeable percent of the federal workforce if they donโ€™t comply? While vaccine side effects are rare, that some will suffer them is a virtual certainly when youโ€™re working with a sample size of millions of federal employees and contractors โ€“ how does legal liability for that work? Have they prepared for the inevitable tsunami of lawsuits from fired employees?
