Alex Berenson tells RFK, Jr.: “I Can Now Bring a Claim Directly Against the White House”

In a recent episode of “RFK Jr. The Defender Podcast,” former New York Times reporter Alex Berenson discussed his big legal win in his lawsuit against Twitter and why he’s now in a good position to sue the White House for censoring him for asking questions about COVID-19 vaccines.

Alex Berenson didn’t initially have a strong negative feeling about the COVID-19 vaccines — but that changed after he saw the lack of safety and efficacy testing done on them.

When Berenson — a former New York Times reporter and the author of 13 novels — started raising questions about the vaccines in his Twitter posts, he soon found himself targeted by the Biden administration as a source of “disinformation.”

In a recent episode of “RFK Jr. The Defender Podcast,” Berenson told Robert F. Kennedy, Jr., how those questions led to Twitter suspending his account, to Berenson filing a lawsuit against the social media platform, to his latest big legal win and why he believes he’s now in a good position to sue the Biden administration for censoring his questions.

“I had covered the drug industry for a long time, so I was pretty familiar with the games that they played — especially in clinical trial design and testing,” Berenson told Kennedy. “I pretty rapidly came to the conclusion that the vaccines really hadn’t been very well tested, despite the size of the clinical trials.”

In July 2021, Twitter locked Berenson out of his account a few hours after President Biden said the social media companies were “killing people” by allowing vaccine skeptics to speak.

About a month later, Twitter permanently banned Berenson, who also has a Substack page called “Unreported Truths.”

So in December 2021, Berenson sued Twitter in federal court, claiming the company had made a breach of contract because it previously assured him that he was doing nothing wrong according to their rules and that everything he said on their platform had been accurate.

Police Groups Backing Sheriff Lombardo for Nevada Call on Anti-Gun Group Pull Anti-Cop Ads

On Friday, two law enforcement groups, the Public Safety Alliance of Nevada and the Las Vegas Police Protective Association, called on the gun control group Everytown for Gun Safety to pull down their political ads.

Ads targeting Nevada’s Republican Gubernatorial Candidate, Sheriff Joe Lombardo have been criticized by law enforcement groups for their anti-police rhetoric and misinformation that risk public safety.

These statements come on the heels of a police officer who was fatally shot while on duty Thursday in Las Vegas. Officer Truong Thai, 49, was fatally shot in the chest while responding to a domestic disturbance call. He had been with Las Vegas Metropolitan Police Department since 1999. The suspect was arrested and had a prior gun charge and is accused of firing 18 rounds. Last month, another LVMPD officer was non-fatally shot while on duty.

One of Everytown’s ads tells the public that Lombardo has disbanded the domestic violence unit.

In a statement, Officer John Abel, Director of Governmental Affairs at the Las Vegas Police Protective Association said,

“The ad accuses Sheriff Lombardo of removing resources for domestic violence victims. That is blatantly false. It deeply concerns me that a current victim of domestic violence could see that and mistakenly believe that there is no way to get help through LVMPD.”

The reorganization of the domestic violence unit has been considered a success at LVMPD, increasing timeliness and follow-up while giving more resources to officers at area commands. The gang unit was never disbanded but decentralized so gang intelligence could share intel with patrol units and all substations shared the responsibility for dealing with gang-related activities. In 2017, with a rise in violent crime attributed to California’s gangs in the Las Vegas area, Sheriff Lombardo reconstituted the gang unit to focus on the core issue of violent crime.

As Sheriff, Joe Lombardo supported Marcy’s Law, a constitutional amendment twice passed in the legislature and approved by Nevada voters in 2018. The amendment guarantees rights to victims of violent crime. Lombardo is specifically listed on the Marcy’s Law website as an advocate.

LVMPD is a massive police agency, the 7th largest in the nation. Their website lists 45 departments. The agency focuses on community policing, with over a dozen programs and partnerships. Transparency is another theme of law enforcement in Clark County, mandatory press conferences are held to address the press and public within 3 days of any officer-involved shooting.

In 2020, under Sheriff Lombardo, the department overhauled its use of force policies, with input from the ACLU, NAACP, academic studies, and assessments from other police departments. De-escalation and Duty to Intervene (stopping any officer from using inappropriate force) were given elevated importance, and additional guidance was included to address breathing issues; assigning an officer to monitor breathing and implementing breathing recovery positions.

Last year, homicides increased in at least nine major cities. Homicide Lt. Ray Spencer said police departments across the nation solve an average of 64% of homicides. As of Jan. 1, 2022, the Las Vegas police solvability rate for 2021 homicides was 91%.

I love that about LVMPD. I know they are gonna’ catch whoever did it, and the community sees it happen in real-time. When a local journalist, Jeff German, was found murdered in September, arrested a sitting public official and an incumbent Governor Sisolak (D) appointee, Robert Telles (D) in mere days. During LVMPD’s announcement, Captain of the Homicide Bureau Dori Koren said,

“We are very fortunate in Las Vegas. We have the best homicide unit in the country with the highest solvability rate in the country. They worked tirelessly, as the Sheriff pointed out, to succeed in this case.”

When a convicted pipe-bomb murderer escaped prison, under another Sisolak appointee’s oversight at the Nevada Department of Corrections, nobody was alerted for four days. Even with a four-day head start, LVMPD with the help of the community (a theme here) located and captured the escaped inmate right before he attempted to flee on a bus to Mexico.

Community members frequently get to celebrate these successes. We are rooting for our law enforcement officers. Las Vegas is a gambling town but when crime does happen, we bet on our police department– with good odds, too.

Another ad funded by Everytown blames Joe Lombardo for increases in crime. Steve Grammas, President of The Las Vegas Police Protective Association called for the ads to be removed saying,

“When Everytown attacks Sheriff Lombardo like this, they are attacking all of law enforcement. These attacks are inaccurate and misleading, but worst of all – they try to blame law enforcement for crime. Steve Sisolak is to blame for Nevada’s soft-on-crime policies that enable criminals and handcuff police.”

Two of the individuals seen in Everytown’s ads are also used in an abortion ad by A Stronger Nevada PAC. It appears the video shots used in the ads for both PACs were filmed on the same day and in the same locations.

There are other disingenuous claims in these ads. LVMPD did not lay off any police officers due to the revenue losses in the state, implemented by Governor Sisolak’s decrees. They cut some part-time civilian employees, who have all since been re-hired.

The PACs running these ads seem out of touch with Nevadans and specifically the residents of Clark County. We are mourning an officer’s death. We are celebrating the swift capture of murderers, with solvability rates that make us proud of our law enforcement community. We don’t appreciate attacks on LVMPD because not only are they a respected agency but in the summer of 2020 when “Defund the Police” and other protestors took to the streets of our community, one protestor shot Officer Shay Mikalonis, then 29-years old, near-fatally, in his head. This happened at a time when use-of-force policies had already been overhauled with input from the NAACP, ACLU, and others, remember? Nobody had to protest for LVMPD to take initiative in reviewing best practices and setting the standards for other police agencies in the nation to follow suit. But due to anti-police movements not originating from the Las Vegas area, our community has an officer whose life was forever altered and is still in recovery, years later.

Not only are police groups like the Las Vegas Police Protective Association and Public Safety Alliance of Nevada calling to end the ads using misinformation and anti-police rhetoric, but the wider community sentiment is also concerned for our officers when they are maligned. Their jobs are not easy. The risks they take daily are real. Using our law enforcement officers as political pawns to shift public sentiment against them is not only wrong, it’s dangerous. And, our police officers don’t get harmed in the line of duty in theory, but in real life, on Thursday was our most recent line-of-duty loss. Las Vegas area residents do not appreciate rhetoric that endangers lives and public safety.

Joe and Nancy: Shameless Midterm Border Hawks

In a desperate attempt to ward off an electoral shellacking, the president and the speaker both talked tough about border security.

“Gentlemen, those are my principles. And if you don’t like them … well, I’ve got others.”

So said Groucho Marx, but it seemed as if Joe Biden and Nancy Pelosi were taking a page from his comedic book this week. At issue is border security, or the lack thereof, and the toll that the Democrats’ open border is taking on the party’s midterm electoral prospects. In brief: It ain’t good.

After having enjoyed a brief, mainstream media-induced boomlet a few weeks back, Biden’s party has seen its fortunes fall back once again into shellacking territory. And they’re getting desperate. So much so that Joe and Nancy have donned their Halloween costumes a bit early and are now masquerading as border hawks.

Too little, too late. But it’s good to see them grovel.

Biden, no doubt in an effort to deflect attention from his administration’s smears of our Border Patrol agents, announced Wednesday that he’s finally come to appreciate Donald Trump’s highly effective “Remain in Mexico” policy — not in so many words, of course, and only through Election Day, but imitation is the purest form of flattery. As The Wall Street Journal reports:

Venezuelan migrants who cross the U.S.‘s southern border illegally to seek asylum will be expelled back to Mexico using a pandemic-era border policy known as Title 42, under a new migration agreement announced jointly by the U.S. and Mexico on Wednesday.

At the same time, the Biden administration also is creating a new immigration program to allow up to 24,000 Venezuelans to move to the U.S. legally, to deter them from attempting to cross into the U.S. illegally, the announcement said.

Even soon-to-be-impeached Homeland Security stooge Alejandro Mayorkas was trying to talk tough: “These actions” he said, “make clear that there is a lawful and orderly way for Venezuelans to enter the United States, and lawful entry is the only way.”

If we didn’t know better, we’d swear these people have finally realized that opening our southern border to three million illegal immigrants is going to cost them votes — a whole lot of votes, and many of them Hispanic.

B-b-b-but, we can hear ol’ Joe sputtering, it wasn’t supposed to be this way. We were supposed to let all the lettuce pickers, er, all the brown people in, and they were supposed to vote for us. What about the emerging democratic majority that those two political science experts were crowing about 20 years ago?

Demographics, as it turns out, isn’t necessarily destiny. And Hispanic Americans seem poised to vote for Republicans in record numbers this cycle.

As for San Fran Nan, the soon-to-be-former Speaker of the House pushed herself away from that $24,000 refrigerator and those $13 pints of ice cream to gaslight a few gullible voters in New York City on Wednesday. How? By showing off her phony border-security bona fides.

“What we must do in our country is to have comprehensive immigration reform,” she blathered. “We all know that we must secure our border. That’s our responsibility as a country.”

Indeed, we all know it, and that is our responsibility as a country, but those in a position to do something about it seem more interested in picking stock winners.

“It’s a new phenomenon,” Pelosi continued. “The answer to almost every problem is to have comprehensive immigration reform” blah blah blah blah. “We can’t get that under the present set of circumstances. Short of that though, we’ll have to address the issue.”

Ah, that pesky issue of border security. Here we just wish she’d make up her mind. Does she want a secure southern border, or does she want a steady flow of illegals to, as she so eloquently put it, “pick the crops”?

Biden Blackmails Saudis to Rig Midterms

If soliciting a foreign government’s interference in our election is an impeachable offense, then Joe Biden has some serious ‘splaining to do.

We’re sure it was a perfect call. A perfect phone call.

It was the call to that foreign head of state that ended up getting the president impeached. You remember: the one in which he tried to get them to interfere in the upcoming election.

We’re getting ahead of ourselves. Republicans haven’t even taken the House of Representatives from the Democrats yet, and we’re already looking back fondly on Joe Biden’s impeachment for having tried to strong-arm Saudi Arabia into delaying the OPEC+ announcement of a two-million-barrels-per-day cut in oil production until after November’s midterm elections.

When Biden requested the month-long delay — which we’re sure had nothing to do with the timing of the upcoming midterms — the Saudis forcefully shut him down. From their statement:

[The] Government of the Kingdom clarified through its continuous consultation with the US Administration that all economic analyses indicate that postponing the OPEC+ decision for a month, according to what has been suggested, would have had negative economic consequences.

Of course, it doesn’t matter that the Saudis once again told Biden to pound sand. What matters is Biden’s intent, which was clearly to solicit their interference in our upcoming midterms. And so, to refresh our memory, we reviewed the language within Article I, Abuse of Power, in the Democrats’ first impeachment of Donald Trump:

Using the powers of his high office, President Trump solicited the interference of a foreign government, Ukraine, in the 2020 United States Presidential election. He did so through a scheme or course of conduct that included soliciting the Government of Ukraine to publicly announce investigations that would benefit his reelection, harm the election prospects of a political opponent, and influence the 2020 United States Presidential election to his advantage.

Hmm… It seems pretty clear that by the Democrats’ own standard, soliciting the interference of a foreign government in a U.S. election is an impeachable offense. So, below, with just a few italicized edits, we’ve saved the House Republicans some time in drawing up their own Abuse of Power impeachment article for Joe Biden:

Using the powers of his high office, President Biden solicited the interference of a foreign government, Saudi Arabia, in the 2022 United States midterm election. He did so through a scheme or course of conduct that included soliciting the Government of Saudi Arabia to delay the announcement of oil production cuts in a way that would benefit his party’s reelection, harm the election prospects of a political opponent, and influence the 2022 United States midterm election to his advantage.

Of course, all this is made worse by Biden’s naked attempt to strong-arm the Saudis — to blackmail them, as it were. The Saudis’ quid was supposed to be postponing that oil announcement. Biden’s quo was revealed by National Security Advisor Jake Sullivan, who warned that the president will “examine” the U.S.-Saudi relationship, which he and Democrats in Congress make clear includes “the question of arms sales.”

The impeachment docket is already getting a bit crowded, though. Ol’ Joe might have to take a number; might have to wait his turn behind Alejandro Mayorkas.

“No one f***s with a Biden,” our weak and cognitively addled president bragged on a hot mic last week. Unfortunately for him, and for every one of us who has to pump gas into a car, the Saudis didn’t get the memo. Or maybe they did, but they simply weren’t impressed.

As our Nate Jackson noted Wednesday, the Saudis know electoral shenanigans when they see them. And, we suspect, they know a weak American president when they see one.

Trump Subpoena Election Theater

Democrats are desperate to distract from their own horrendous record by making Trump the focus of the 2022 election.

In 2016, Hillary Clinton’s campaign colluded with Barack Obama’s FBI and the Leftmedia to falsely accuse Donald Trump of working with the Russians to win the election. That relentless effort handicapped the first three years of Trump’s presidency with Robert Mueller’s investigation and then, after GOP defeat in the 2018 midterms thanks to the fabricated narrative, the first (and arguably second) impeachment. In 2020, Democrat activists in the media and Big Tech suppressed key information about pay-to-play corruption involving Hunter Biden at the direction and to the lucrative benefit of Joe “Big Guy” Biden. Had voters known, we’re convinced the election would have turned out differently.

Yet heading into next month’s critical midterm elections, Liz Cheney and the Democrats (but we repeat ourselves) want you to focus on Trump’s role on January 6, 2021.

That’s why the big headline news this morning is that the sham House committee investigating January 6 voted unanimously to subpoena the former president.

“Why didn’t the Unselect Committee ask me to testify months ago?” Trump demanded to know. Because the committee has an election to win in less than four weeks and Trump makes a compelling villain. Trump issued a 15-page statement today shredding the “highly partisan political Hacks and Thugs” on the committee.

“A key lesson of our investigation is this: Our institutions only hold when men and women of good faith make them hold, regardless of the political cost,” opined Cheney, who recently lost her Wyoming primary, in self-aggrandizing remarks yesterday. “We have no guarantee that these men and women will be in place next time.” They sure aren’t in place now.

Others in the former president’s orbit have either refused to testify or done little more than plead the Fifth while doing so. Will Trump challenge the subpoena, refuse to show up, or take the opportunity in front of a huge audience to argue his case?

Trump’s behavior on and leading up to January 6 was reprehensible and utterly unworthy of the office he held. The committee certainly seems to think it proved Trump knew he lost and still, in Cheney’s words, carried out a “premeditated plan to declare the election was fraudulent and stolen before Election Day,” followed by leading an Insurrection™. In a new video clip shown yesterday, Nancy Pelosi exclaimed on January 6, “It’s just horrendous, and all at the instigation of the president of the United States.”

So, let’s do the unthinkable and shed some context on events.

Democrats threw a four-year-long caterwauling tantrum over Trump’s 2016 victory. They poked and prodded and hectored and maligned and falsely accused and investigated and impeached President Trump. The deep state attempted to oust him in a veritable coup. Given that Trump’s primary brash New Yorker attribute is that he behaves like a Democrat, it’s no wonder he spent the two months after the election lashing out and trying every which way from Sunday to prove that the election was, as he said again today, “rigged and stolen.”

Most red-blooded Americans in his position probably would have responded similarly. A Democrat most certainly would have.

Does that make it presidential character? Not even close, but presidents of character are pretty hard to come by. We sure don’t have one now. In any case, do voters in the midterms care more about January 6, or Biden’s economic calamity and a host of other ills he’s brought upon our country?

In other Trump news, the Supreme Court denied his request to have a special master review the classified materials he kept at his Mar-a-Lago home. Frankly, Attorney General Merrick Garland’s investigation into Trump’s alleged mishandling of classified information after he left office presents a greater threat to him than anything brought by the January 6 Committee.

With that, however, we’ll turn back to where we started — the whole Russian-collusion hoax. Special Counsel John Durham’s probe into all of that appears increasingly likely to fizzle out entirely. It was always probable that the only justice Hillary Clinton would ever face for pulling off the worst political scandal in American history was losing to Trump. It seems ever more apparent that even her cutouts at the FBI and elsewhere won’t face justice.

During the trial of Russian-born lawyer Igor Danchenko this week, we learned that the FBI offered dossier author Christopher Steele $1 million for evidence proving his charges. Steele couldn’t provide it, and yet the FBI proceeded anyway, acting before even interviewing Danchenko, Steele’s principal source.

Perhaps it’s 4D chess, but Durham is taking the same losing tack as he did with the acquitted Michael Sussmann — acting like the FBI was just duped instead of a willing participant in the hoax. Danchenko’s attorneys are the ones making the damning case against the FBI, and Durham’s only lasting accomplishment may end up being conviction in the court of public opinion.

As for the 2020 scandal of Hunter and Joe Biden, the president barely even faces questions about all of his corruption. There is speculation that Hunter will work out some sort of plea deal over his tax fraud and lies on an ATF form when buying a gun, and that his legal troubles will provide pretext for Joe to step aside because, let’s face it, he’s not running in 2024. But that would involve at least a modicum of accountability from the Bidens, which seems unlikely.

So, again — Democrats at every level of government and the media have acted shamelessly and deplorably to win elections at all costs. Trump and his rioters were no better on January 6, but Democrats are the ones who are making far more consequential progress undermining “democracy” and Rule of Law.

In March of 2022, the United States Election Commission (EAC) quietly released a report identifying anomalies found on the voting machine software sold by Dominion Voting Systems in Williamson, TN.
