DC Appeals Court Overrules Judge Chutkan Gag Order

November 3, 2023 | Sundance |

A three-judge panel of the D.C. Circuit Court of Appeals has lifted District Judge Tanya Chutkan’s gag order prohibiting Trump from criticizing the special counsel, Jack Smith, or “any foreseeable witness” in the case. [2-Page Opinion Here]In my opinion, it was the generalized “foreseeable witness” part of the Chutkan order that became the central issue for the appellate court. Jack Smith could name anyone as a potential witness, just to silence the accused.

President Trump’s team previously indicated in their filing to the appeals court thatthey are prepared to seek immediate relief at the Supreme Court. However, at least now, that approach will not be needed as the DC Appellate Court has blocked the gag.

It is a win for Donald Trump amid a highly political DC Circuit.

If the appeals court had ruled to uphold the gag order, they would have opened the door for the U.S. Supreme Court to weigh in and potentially overturn the lower rulings. Therefore, appeals courtwas most likely not willing to see their own credibility rest on the language of a motion written by Judge Chutkan.

In the ruling, the appeals court will accept briefings and oral arguments prior to making their own ruling on the matter. That will make any advancement to the Supreme Court much less likely to succeed.

WASHINGTON – A federal appeals court on Friday lifted a gag order reining in Donald Trump’s comments about the criminal election-subversion case pending against him in Washington.

At the former president’s request, a three-judge panel of the D.C. Circuit Court of Appeals temporarily lifted U.S. District Court Judge Tanya Chutkan’s order prohibiting Trump from using his public statements to target special counsel Jack Smith and his team, court officials and potential witnesses in the case.

The appeals court’s action makes it likely that the gag order, which Trump contends violates his First Amendment rights and those of his supporters, will be sidelined for more than two weeks and perhaps longer. The D.C. Circuit set oral arguments on the gag order issue for Nov. 20. The panel issuing the orderconsisted of two Obama appointees — Patricia Millett and Cornelia Pillard — as well as the court’s newest member, Biden appointee Bradley Garcia.

…”No court in American historyhas imposed a gag order on a criminal defendant who is actively campaigning for public office—let alone the leading candidate for President of the United States. That centuries-long practice was broken on October 17, 2023, when the district court entered its Opinion and Order, A1 (the “Gag Order”), muzzling President Trump’s core political speech during an historic Presidential campaign.

Given the Gag Order’s extraordinary nature, one would expect an extraordinary justification for it. Yet none exists.

President Trump has made months of public statements about this cas, but the Department of Justice (“the prosecution”) submitted no evidence of any actual or imminent threat to the administration of justice. Instead, when asked about the supposed threat to the case, the prosecution admitted, “of course this prejudice is speculative.”

Based this speculation_, the district court entered a sweeping, viewpoint-based prior restraint on the core political speech of a major Presidential candidate, based solely on an unconstitutional “heckler’s veto.” The Gag Order violates the First Amendment rights of President Trump and over 100 million Americans who listen to him__.

President Trump’s uniquely powerful voice has been a fixture of American political discourse for eight years, and central to the American fabric for decades. The prosecution’sclaim that his core political speech suddenly poses a threat to the administration of justice is baseless..

President Trump’s viewpoint and modes of expression resonate powerfully with tens of millions of Americans. The prosecution’s request for a Gag Order bristles with hostility to President Trump’s viewpoint and his relentless criticism of the government—including of the prosecution itself. The Gag Order embodies this unconstitutional hostility to President Trump’s viewpoint. It should be immediately stayed.

President Trump requests a ruling on this motion by November 10, 2023, and requests an administrative stay pending the Court’s ruling. President Trump respectfully asks that this appeal be expedited to the greatest extent possible.”..

Conniption in Court: Gasps as Breitbart Exposé on Trump New York Judge’s Clerk Takes Center Stage

Nick Gilbertson3 Nov 2023

Former President Donald Trump’s counsel, Christopher Kise, suggested in court Friday that the legal team may consider pursuing a mistrial in the civil suit brought by the state of New York in light of a report from Breitbart News.

At the center of the argument is Breitbart News Washington Bureau Chief Matthew Boyle’s report that New York County Supreme Court Justice Arthur Engoron’s top clerk, Allison Greenfield, “appears to have violated judicial rules preventing officers of the court from making excessive political donations.”

“There’s a news story out [today]…about particular political contributions made by your court staff…it raises questions of impartiality,” Kise said, according to Law360’s Stewart Bishop.

He added the “defense will have to give serious consideration to seeking a mistrial.”

According to Pix11 reporter Henry Rosoff, Engoron — who placed a gag order on Trump regarding Greenfield and has fined him twice for gag order violations — became frustrated.

“…I’ll let everyone in the room think what they will about Breitbart,” he added.

There were “audible scoffs in the courtroom” when it was revealed the defense was referencing a Breitbart News report, according to Politico legal reporter Erica Orden.

As Boyle reported, it seems Engoron was advised of the violations laid out in a complaint filed to his court from a third party:

…it appears Engoron was advised of Greenfield’s violations in a 72-page complaint addressed to his court via email that was also filed with the New York State Bar Association the same day he decided to issue a gag order against former President Donald Trump in his case currently playing out in Engoron’s Manhattan courtroom.

Engoron said Friday, “It’s not information, it’s an allegation!” according to Rosoff.

“This idea someone has notified me, absolutely untrue, absolutely untrue,” he added.

Boyle pointed out that “in 2022 alone, Greenfield gave thousands of dollars” in political donations that apparently exceeded a $500 threshold for court officials in aggregate donations for a calendar year:

The donations, which can be found in New York’s elections database, total several thousand dollars. She gave $200 to the Four Freedoms Democratic Club in New York on May 2, 2022. She gave $175 to the Chelsea Reform Democratic Club in New York on April 5, 2022—and gave that group another $210 on July 25, 2022. She gave $350 to the West Side Democrats, Inc. in New York on June 15, 2022. She gave $50 more to New Yorkers For Alex Bores on Sept. 8, 2022. On Oct. 26, 2022, she gave another $50 to the Four Freedoms Democratic Club. On Sept. 12, 2022, Greenfield gave $100 to the Grand Street Democrats. On Dec. 2, 2022, Greenfield gave another $100 to Hell’s Kitchen Democrats. On Nov. 10, 2022, and on Nov. 21, 2022, Greenfield gave $250 each time to Downtown Independent Democrats. On Sept. 6, 2022, she gave $250 to Village Independent Democrats. On Dec. 27, 2022, Greenfield gave $500 to the Jim Owles Liberal Democratic Club. She gave that group another $500 spread over two $250 donations back on June 1, 2022, as well. On March 3, 2022, she gave $50 to Sivin for New York. On March 10, 2022, Greenfield gave another $100 to Sivin for New York. On May 15, 2022, she gave another $125 to Sivin for New York. She gave $25 to the New York County Democratic Committee on Feb. 13, 2022. She gave the New York County Democratic Committee another $50 on July 17, 2022.

Trump allies slammed Engoron and Greenfield after the report came to light.

“It’s a disgrace. And many members of the family are under a gag order, so they can’t even defend themselves,” wrote Sen. J.D. Vance (R-OH).

“What these corrupt Democrats are trying to do to the Trump family in New York is something straight out of a 3rd world banana republic,” Republican Ohio Senate candidate Bernie Moreno wrote in a post on X.

Republican Arizona Congressional candidate and former prosecutor Abe Hamadeh chimed in as well, writing, “Their bias is blatant and their derangement will destroy the rule of law.”

(Freakin Hysterical, now the Circuit and SC cannot defend this assholes gag order. The judge knew how compromised she and he were, so he illegally did a gag order, but worse than that. I suspect there’s a lot more to come. Book of Revelations may blow up NY Courts)

The Meatgrinder – REPORT: U.S. and EU Officials Gently Discussing Need for Ukraine to Enter Peace Negotiations with Russia

November 4, 2023 | Sundance |

All things considered, this is a positive first step and the first significant indication thatWestern propaganda around World War Reddit is failing. According to sources who are speaking to NBC News, U.S. and EU officials are gently beginning to talk to Ukraine government officials about what steps might need to be taken to bring an end to the Ukraine-Russia war. Obviously, for those who do not pretend, we all know the decision to end this conflict comes down to the USA telling Ukraine President Zelenskyy to open peace talks with Russia.

The EU NATO alliance has recently started to show less interest in the maintenance of a U.S. proxy war against Russia, and more open public statements that the current status of a stalemate is unsustainable given the amount of money, hardware and political energy required to maintain it. Additionally,Zelenskyy is running out of men to throw into the meat grinder; the troops and military leaders are actually defying his orders now.

Therefore, if the Biden administration (State Dept and CIA) concede to the reality, Zelenskyy will have no alternative except to talk to Russia about ending the conflict. This is the baseline of non-pretending honestythat President Trump has been saying in his remarks about his ability to end the “killing and death” within 24 hours. The reality of the situation is not complex.

Ukraine pledges not to join NATO, the USA pledges not to use Ukraine as a proxy nation to conflict with Russia, the untrusting Russian government keeps part of Eastern Ukraine as a safety mechanism, and the war/bloodshed ends.

However, given the use of Ukraine as a financial mechanism for U.S. politicians to get rich, and given the financial stakes for multinationals like Blackrock, there are other financial considerations which will play out in the background of any potential peace talks. In the end, just like in the beginning, it’s all going to come down to money.

(Via NBC) – WASHINGTON — U.S. and European officials have begun quietly talking to the Ukrainian government about what possible peace negotiations with Russia might entail to end the war, according to one current senior U.S. official and one former senior U.S. official familiar with the discussions. The conversations have included very broad outlines of what Ukraine might need to give up to reach a deal, the officials said. Some of the talks, which officials described as delicate, took place last month during a meeting of representatives from more than 50 nations supporting Ukraine, including NATO members, known as the Ukraine Defense Contact Group, the officials said.

U.S. and Europe, officials said. They began amid concerns among U.S. and European officials that the war has reached a stalemate and about the ability to continue providing aid to Ukraine, officials said.Biden administration officials also are worried that Ukraine is running out of forces, while Russia has a seemingly endless supply, officials said.

And there is unease in the U.S. government with how much less public attention the war in Ukraine has garnered since the Israel-Hamas warbegan nearly a month ago, the officials said. Officials fear that shift could make securing additional aid for Kyiv more difficult. Some U.S. military officials have privately begun using the term “stalemate”..

“Any decisions about negotiations are up to Ukraine,” (Full of Shit Statement, Liars) Adrienne Watson, spokesperson for the National Security Council, said in a statement. “

Ultimately the decision to end the Ukraine-Russia war is not up to Joe Biden. At a certain point the CIA and State Dept will tell him the cost -v- benefit analysisis no longer worth it, politicians are getting too many angry calls from Americans, and it’s time to end the conflict.

Bidenwill do what he’s told and read what is prepared for him, while thepeople around him try to position the end of the Ukraine conflict to gain Joe Biden the Nobel Prize for peace. The political propaganda at the conclusion of a proxy war that NATO and Biden started is very clear to see.

Russia must protect Zelensky

The Ukrainian leader’s erratic behavior and growing messiah complex means he’s now an asset to Moscow

By Sergey Poletaev, co-founder and editor of the Vatfor project.

The November issue of Time magazine features a cover with a small portrait of Vladimir Zelensky and the word "Nobody" above it. The word in larger type is part of the longer headline "Nobody Believes in Our Victory Like I Do" but, whatever the designers had in mind, it was unmistakable:Zelensky equals a nobody.

The similarly illustrated article was no less scandalous. It made everything clear: we Russians must keep Zelensky as the apple of our eye, because no one brings more chaos to the conduct of hostilities on the Ukrainian side and more discord to Kiev's relations with the West than he does.

The article describes how Zelensky, who sees himself as the savior of humanity, loses touch with reality the further he goes:it was he who demanded that Bakhmut be held at all costs, burning reserves there which were intended for the summer counteroffensive. It is he who is still calling for an offensive in the south, once again destroying his people and valuable Western equipment in pointless attacks, and thus intensifying his conflict with the army’s leadership. It is he who is demanding an offensive on Gorlovka and,as long as he is president, no one in Ukraine dares to make a peep about negotiations with Russia, the necessity of which is becoming more and more obvious. And all this against a backdrop of gargantuan levels of theft.

The Time article is a black mark. American elites have realized that as long as Zelensky is in power in Ukraine, Western support will either be burned for one man's ambitions or simply plundered -both to Russia's advantage.

Obviously, Washington needs to replace the disgraced Napoleon-wannabe with someone more manageable – the question is how.Preferably in a good way(kek), by organizing presidential elections in due course next spring, and some movement in this direction has already begun: the political scene has been revived, yesterday's heroes like Pyotr Poroshenko and Yulia Timoshenko have re-emerged, even Zelensky's former adviser Alexey Arestovich, who a year ago spoke enthusiastically of Ukraine's imminent victory, has cleverly changed his shoes and started to reveal the truth about the disastrous leadership of his old boss.

But Zelensky is against it, as he has repeatedly saidwith varying degrees of hysteria: who needs elections, he suggests, when I am saving humanity? If you want elections, hold them yourself at your own expense, and so on. Society is also against it (according to various polls, 60%-80% of Ukrainians believe that the next vote should be held after the end of hostilities).

Public opinion could have been ignored (this corresponds to the standards of Western democracy), but if Zelensky goes to the polls, he will win them: he is still the most popular politician among Ukrainians (76% approval, with only the army having a higher rating). Zelensky is more popular than all other possible candidates combined. This is down to two years of rolling military propaganda and the information bubble that has trapped Ukrainian society, which has been brainwashed into believing that the country is winning.

In addition, Zelensky and his entourage, led by the Grey Cardinal Andrey Yermak, wiped out the opposition inside the country, destroying the traditional intra-elite system in which oligarchs organized party projects and elected presidents to suit themselves. Zelensky and Yermak created a power vertical unprecedented by Ukrainian standards, restricted to a narrow circle of friends. In general, the process of dismantling traditional regional privileges that began under Poroshenko has been completed: now the direction must be obtained in Kiev, and all financial flows (which have been reduced almost entirely to Western money) pass through the capital. The information field has been cleaned up - there is almost no media independent of the presidential administration left in the country.

All this means that the US will not be able to quickly create a political project to replace Zelensky: paradoxically, since the beginning of the Russia-Ukraine conflict, its control over internal Ukrainian processes has diminished and isnow reduced to control over Zelensky, who, it seems, cannot be controlled. In fact, he is uncontrollable.

There are two options left:either to persuade Zelensky to leave amicably by pointing to Washington's chosen successor, or simply to kill him: a dead hero is better than a living psycho.

Of course, all this is to our advantage: the longer Zelensky remains in power, the longer Ukraine will continue to fight, bringing its collapse closer.

Therefore, we should take care of Zelensky, and protect him as best we can.

Man this little dwarf should have read the Western articles six months slowly but surely criticizing Zelensky and their failure. Zelensky and staff took an opposite maneuver criticize and blame Western training, western arms, western expectations andNot enough if western money. Anyone with eyes to see would have noticed it.

I think Zelensky thought the blackmail they had on the west was more than they had in him and the leaders, he didn’t understand his “loyal leaders” hated his guts and were paid by CIA from the beginning to keep an eye on him.

And they are Azov and he is a Jew, how was that going to work?

Zelensky has one major flaw, he was never a politician or even a leader, he was an entertainer (not a real actor) that did willingly the most perverse “comedy” and he was praised for it. He didn’t know the debasement of himself and those watching was not funny at all.

But when he became the president by the Oligarch that he willingly arrested for corruption because the West demanded it,he was praised for progress. The problem is he believed the praise and lies because he believed the press and people thought his perverse acting was funny.

So being praised and lied to was Zelensky’s biggest flaw, he actually believed Joe Bidan that the West would protect him forever. He didn’t know “forever” loyalty or support doesn’t exist and politics is more diabolical than acting.

The poor “rich” boob never saw it coming! Everyone knew from day one he had a Napoleon complex, but he actually made worse mistakes than him.

Everyone that lives in Western Countries do not trust our leaders, why on earth would this little gnome trust them?

Call to fight ‘snow penises’ issued in Russia

A plague of frozen phalluses has infested Ekaterinburg

Officials in the Russian city of Ekaterinburg have called on the police to investigate aseries of penis-shaped snow sculpturesthat keepcropping upacross the city. Vice-Mayor Alexey Bubnov has instructed the public to smash theoffensive organson sight.

The first winter snow in the Urals last month brought some unusual snowballs to the streets of Ekaterinburg. A towering snow-penis –complete with anatomically-correct veins– appeared in a park outside the city’s opera house, where itstood proud(Pfizer help) for an entire day before municipal workers toppled it with a front loader and broke it apart with shovels.

“Law enforcement probably needs to get to work,” Vice-Mayor Alexey Bubnov told local news outlet It’s My City on Friday. “If they insult someone, it’s probably an administrative offense. Involve law enforcement and demolish it. This is a provocation, and we need to fight these people.”

Bubnov also called on the publicto take matters into their own hands (kek)and bringdown the ice-bound bonerswhere they see them, and to send him pictures of the penises so municipal workers could be dispatched to fell them.

Residents of Ekaterinburg, however, do not share the vice-mayor’s puritanical zeal. An online petition demanding that the sculptors cease and desist has only attracted 33 signatures in more than 24 hours.(KEK)

Abortion an ‘acute’ problem in Russia – Putin

The president has proposed a range of measures to deal with the demographic situation

Russian President Vladimir Putin on Friday described the number of abortions in the country as a problem that may require government intervention, offering a variety of ideas on how to deal with it. The state Duma (Russian parliament) is reportedly debating a proposal that would tighten abortion restrictions.

“Of course, the problem of abortion is so acute. The question is: what to do about it?”Putin said at a meeting with the new convocation of the Civic Chamber, a 168-member consultative body charged with government oversight.

Moscow could “ban the sale of drugs that terminate pregnancy, or improve the socio-economic situation in the country, increase the level of well-being, real wages, social services, [and] assistance to young families in purchasing housing,” the president added, noting there were many ways to “support motherhood and childhood.”

Putin cautioned that the issue may not require a government strategy, or to be handled by the National Security Council, noting that “everyone should mind their own business,”but added that he will still give it some thought, “because the issue is extremely important for the future of our state.”

He reminded the civil society representatives that Russia underwent a birth-rate crisis in 1991 comparable to that of 1943, at the height of the Second World War, but noted that the government has done a lot in recent years to promote parenthood.

The number of abortions in Russia has decreased drastically since Putin first became president, going from2.13 million in 2000 to 506,000 in 2022, according to official statistics. As late as 2017, the number was almost 780,000.

A package of amendments to abortion laws, including those proposed by theRussian Orthodox Church, is currently working its way through a parliamentary committee. According to media reports last month, proposals include requiring the consent of the husband or family members before an abortion, limiting abortions to eight to 12 weeks down from the current 12-22, banning private clinics from performing the procedure, and penalizing the “encouragement” or “propaganda” of abortion.

Russia’s total fertility rate is at 1.43, which is in line with the European average butbelow the 2.1 required for stabilizing the population.

Putin explains why he ordered military operation in Ukraine

Moscow did not have a choice as Russia had already been “attacked” before February 2022, the president has said

Russia had no option but to launch its military operation against Ukraine in February 2022, President Vladimir Putin said at a meeting with the country’s Civic Chamber on Friday. The Russian leader reaffirmed his belief that the decision was the right one, despite the difficulties resulting from it.

“We had no other choice,” Putin replied when asked if he would make the same decision again, knowing what the consequences would be. He added that “removing the assault rifle covers” must never be done lightly, but said he had reached the conclusionthat military action against Ukraine was unavoidable.

“Why? Because we had already been attacked,”the Russian leader stated, without elaborating.

Putin has repeatedly explained the reasons for Moscow’s military campaign, citing Ukraine’s NATO aspirations and the looming prospect of the US-led military bloc expanding even closer to Russia’s borders as major sources of concern.

He has also stressed the need to protect the people of Donbass and end the nearly eight-year conflict that had raged between local rebels and Kiev’s forces. This was coupled with the increasingly nationalist stance of the Kiev government and its treatment of the Russian-speaking population, with Putin previously explaining the need to “denazify”Ukraine.

At the annual Victory Day Parade in May 2022, Putin described Moscow’s operation in Ukraine as a “preemptive” one, again maintaining that it was “the only right decision.” “Russia gave a preemptive rebuff to aggression,” the president insisted at the time, arguing the move had been “forced” but was the only correct decision that a “sovereign” and “independent” country could have taken.

Kiev has repeatedly claimed that Russian actions were “completely unprovoked.” The US and its allies in Europe and elsewhere have also pinned the blame for the conflict squarely on Moscow, while providing Ukraine with massive military and financial assistance.

Western nations ‘changing tune’ on defeating Russia – Putin

The stronger the nation is, the less its enemies will try to hurt it, the Russian president said

Western nations, which previously insisted that Ukraine should defeat Russia on the battlefield, are gradually changing their position, President Vladimir Putin noted on Friday.

“They are changing their tune now, saying different things,” the Russian leader told members of the Civic Chamber, a civil society body tasked with consulting the government on policymaking.

Putin argued that the nation should become stronger in all aspects, including the economy, military, and political stability. Such strength deters hostile actors from trying to isolate Russia, he said.

“They (EU nations) excluded our energy. So what? What is the result? Our GDP will grow [up to] 3% this year, and the leading European economies are shrinking,” he noted.

“They suffer; they have real problems,” Putin added, noting that he was saying this without joy. “This doesn’t mean that we should behave aggressively. It means we must be sovereign in every sense of the word,” he concluded.

The US and its allies have accused Russia of launching an “unprovoked” attack on Ukraine last year and have pledged to support Kiev for “as long as it takes” to defeat Moscow. Washington has stated that its goal in Ukraine is to inflict a “strategic defeat” on Russia.

Moscow said the hostilities were caused by Western refusal to address Russia’s concerns about NATO expansion and Kiev’s discriminatory policies against Russian speakers after the 2014 armed coup. The US allegedly stopped the Ukrainian government from striking a truce in the first weeks of the ongoing conflict, which would have made it a neutral nation.

Kiev has declared that the only outcome it would accept is to push Russia out of all territories that it claims as its own, including Crimea. It has failed to secure any significant gains on the frontline during the so-called summer counteroffensive this year.

“Despite the supply of new kinds of NATO weapons, the Kiev regime is losing,” Russian Defense Minister Sergey Shoigu said earlier this week, assessing the battlefield situation.

(I really wouldn’t want to be any of those arrogant assholes in Kiev that wanted to kill every Russian on the face of the earth right now, ICA’s advice doesn’t sound very wise right now.)

She lost her mind (seriously I’ve never heard or seen that before), she yelled, yes yelled at the top of her lungs, “I’ve told you before, I NEVER want to hear that name”. I was like holy shit, what is wrong with her. Seriously in all my life I’ve only heard her raise her voice like maybe 5 times. And she never told me not to mention the name.

I said, are you serious? (Yes she was), So i said, I get it, you have “Trump Derangement Syndrome” and. OK I won’t mention that name again.Apparently that was the wrong thing to say (who knew?)so she shouted like 4 octaves higher, I AM HIGHLY OFFENDED at the statement!

I’m like, what do I do? So I say,I guess we can talk later, I’ve gotta go, bye

Seriously I think this covid and Trump hatred virus and other issues have made her lose it. But its so strange to me, I detested Obama but when I saw him on TV saying “we can’t blame the Muslim faith for San Bernardino shootings, I’d just Shouted at the top of my lungs FUCK YOU ASSHOLE and turn off the TV.

Something id really really wrong with these people (5 other siblings are the same way but they don’t scream), they all had the vaccine asap.

She did text me this below, but she didn’t lose her cool, it was a few notches higher than that, but it was a sincere apology, and think she realized how odd it was, because she has never asked for me forgiveness and she never needed to.I’m really worried about people and family that seems demon possessed

“I am sorry I lost my cool with you. I haven’t been feeling well for a few days and my mood is off. Please forgive me.”

Excellent advice, but she reminded me lately she has a degree and has been welcome in all kind of societies and I haven't. This is definitely not the sister I know. Even when I agree with her she takes the opposite side. It’s weird, I used to like talking to her

I’m just gonna pray, because I tend to tell the truth all the time, and I haven’t managed to care what people think.

I will never have a job as a diplomat for sure!

Yeah I considered that, but she will send me five articles from her approved outlets, to prove I am wrong.

They have sone kind of resource they believe, access it, send it and expect me to get in dialogue with them. I gave up two years ago, and i just say prayers for them daily.
